我國人質(zhì)危機處置指揮體制初步研究

【摘要】： 隨著國內(nèi)人質(zhì)危機事件的不斷發(fā)生,如何有效化解人質(zhì),成功解救人質(zhì),成為專家、學(xué)者、執(zhí)法部門必須認真對待的問題。本文試圖從人質(zhì)危機處置的指揮體制角度來探索如何高效處置我國人質(zhì)危機事件。 人質(zhì)危機處置的指揮體制,是關(guān)于人質(zhì)危機處置指揮在機構(gòu)設(shè)置、職能劃分和相互關(guān)系等方面的組織制度,是關(guān)于領(lǐng)導(dǎo)指揮的組織體系、機構(gòu)設(shè)置、職能劃分、關(guān)系確定及法規(guī)制度的統(tǒng)稱。 本文在廣泛參考國內(nèi)外相關(guān)領(lǐng)域眾多研究成果的基礎(chǔ)上,先后闡述了危機與人質(zhì)危機、危機管理與人質(zhì)危機管理、危機管理的制度研究與人質(zhì)危機處置指揮體制的相關(guān)理論,并大膽總結(jié)了人質(zhì)危機處置指揮體制的三種常用模式,分別是寶塔式、輻射式和網(wǎng)狀式指揮體制模式。接著,本文充分借鑒西方國家在人質(zhì)危機處置指揮體制方面的先進經(jīng)驗,一是機構(gòu)設(shè)置合理高效、二是情報信息一體化達到較高程度、三是指揮系統(tǒng)內(nèi)各子系統(tǒng)形成優(yōu)化的結(jié)構(gòu)關(guān)系。然后,本文又客觀分析了國內(nèi)目前人質(zhì)危機處置指揮體制的現(xiàn)狀和存在不足之處,一是機構(gòu)職能劃分不明確,缺乏法律保障、二是情報信息獲取安排不合理、三是多頭指揮現(xiàn)象嚴重。最后,本文采用理論結(jié)合實際的方法,提出了構(gòu)建我國人質(zhì)危機處置指揮體制的設(shè)想,一要建立明晰順暢的指揮關(guān)系即建設(shè)富有彈性的、多維的指揮關(guān)系、明確諸多聯(lián)合力量的現(xiàn)場隸屬關(guān)系和理順子系統(tǒng)內(nèi)部的指揮關(guān)系,二要建立以信息化為核心的指揮機構(gòu)即樹立綜合性的情報意識、建立嚴密的信息情報系統(tǒng)和合理配置情報人員要素,三要建立以網(wǎng)狀式拓展的網(wǎng)絡(luò)式科學(xué)指揮體制。 隨著社會日益發(fā)展,經(jīng)濟、政治、民族矛盾將會愈來愈復(fù)雜,人質(zhì)危機事件將隨時會發(fā)生。面臨著日趨嚴峻的社會形勢,我國亟需要有一套符合國情的、完善的、科學(xué)的人質(zhì)危機處置指揮體制,這需要全社會乃至整個國際社會的支持與合作。
[Abstract]:With the continuous occurrence of the domestic hostage crisis, how to effectively dissolve the hostage, successfully rescue the hostage, become experts, scholars, law enforcement departments must seriously deal with the problem. This paper attempts to explore how to deal with the hostage crisis in China efficiently from the perspective of the hostage crisis handling command system. The command system of hostage crisis disposal is about the organizational system of hostage crisis disposal command in the aspects of organization setting, function division and mutual relationship, and it is about the organizational system, organization setting and function division of leading command. The definition of the relationship and the general name of the legal system. On the basis of extensive reference to numerous research achievements in related fields at home and abroad, this paper has expounded the theories of crisis and hostage crisis, crisis management and hostage crisis management, crisis management system research and hostage crisis handling command system. Three common modes of hostage crisis management command system are summarized boldly, which are pagoda, radiation and mesh command system. Then, this paper fully draws lessons from the advanced experience of the western countries in the hostage crisis handling command system. First, the institution is set up reasonably and efficiently, the second is the integration of information and information to a high degree. Third, each subsystem in the command system forms the optimized structure relation. Then, this paper objectively analyzes the present situation and shortcomings of the domestic hostage crisis handling command system. Firstly, the division of agency functions is not clear, the lack of legal protection, and the second is the unreasonable arrangement of obtaining information. Third, the phenomenon of long command is serious. Finally, this paper uses the method of combining theory with practice, and puts forward the assumption of constructing the command system of hostage crisis management in our country. One is to establish a clear and smooth command relationship, that is, to build a flexible and multidimensional command relationship. To clarify the field subordinate relationship of many combined forces and to straighten out the internal command relations within the sub-system, second, to establish a command organization with information as the core, that is, to establish a comprehensive intelligence consciousness, It is necessary to establish a strict information and information system and reasonable allocation of intelligence personnel, and third, to establish a network type scientific command system with network expansion. With the development of society, economic, political and ethnic contradictions will become more and more complex, hostage crisis will occur at any time. Facing the increasingly severe social situation, our country urgently needs a set of perfect, scientific hostage crisis handling command system, which needs the support and cooperation of the whole society and the whole international community.
