【摘要】： 9·11恐怖襲擊事件已經(jīng)過(guò)去五周年,但恐怖主義犯罪越來(lái)越成為當(dāng)代世界的一大突出公害,是全人類文明社會(huì)的共同敵人,嚴(yán)重危害世界和平與安全,經(jīng)濟(jì)發(fā)展與社會(huì)進(jìn)步。當(dāng)前正值我國(guó)民航業(yè)大發(fā)展時(shí)期,民族分裂勢(shì)力活動(dòng)猖獗,社會(huì)不安定因素增多,貧富差距進(jìn)一步擴(kuò)大,各種社會(huì)不公平現(xiàn)象加劇等等,這些因素都可能成為航空恐怖主義犯罪的誘因,嚴(yán)重威脅我國(guó)航空安全。另一方面,航空恐怖主義犯罪也對(duì)舉世矚目的2008年北京奧運(yùn)會(huì)和2010年上海世博會(huì)構(gòu)成較大威脅。未雨綢繆,筆者試著從恐怖主義犯罪的概述、航空恐怖主義犯罪現(xiàn)狀和我國(guó)反航空恐怖主義犯罪對(duì)策三個(gè)部分分別加以闡述說(shuō)明。 本文共分三部分。 第一部分,從恐怖主義犯罪的字義解釋、歷史追溯來(lái)考察恐怖主義犯罪概念的歷史發(fā)展過(guò)程;通過(guò)把恐怖主義犯罪與相關(guān)概念的比較,對(duì)恐怖恐怖主義犯罪概念的四個(gè)要件逐一進(jìn)行分析,得出筆者對(duì)恐怖主義犯罪概念下的定義;通過(guò)恐怖主義犯罪的特征來(lái)分析其危害性,通過(guò)介紹傳統(tǒng)恐怖主義類型、當(dāng)代恐怖主義類型和我國(guó)恐怖主義的類型,使我們對(duì)恐怖主義犯罪的認(rèn)識(shí)更為直觀。 第二部分,考察國(guó)際航空恐怖主義犯罪的歷史,并簡(jiǎn)述航空恐怖主義犯罪的危害性;對(duì)打擊航空恐怖主義犯罪的《東京公約》、《海牙公約》、《蒙特利爾公約》和《蒙特利爾公約補(bǔ)充議定書(shū)》的國(guó)際立法意圖進(jìn)行了一般性介紹;對(duì)劫持航空器罪、危害航空器飛行安全罪、危害國(guó)際民用航空機(jī)場(chǎng)安全罪等三類航空恐怖主義犯罪類型逐一進(jìn)行分析,還對(duì)懲治航空恐怖主義犯罪的“或起訴或引渡”原則進(jìn)行了闡述;對(duì)我國(guó)航空恐怖主義犯罪概況,航空恐怖主義犯罪的法律防范措施,我國(guó)航空安全保衛(wèi)工作體系進(jìn)行了介紹,并分析了我國(guó)在反航空恐怖主義犯罪方面存在的五個(gè)問(wèn)題與不足。 第三部分,根據(jù)筆者對(duì)恐怖主義犯罪的理解和認(rèn)識(shí),結(jié)合民航公安工作實(shí)際,從加大民航反恐防范建設(shè)力度,加緊進(jìn)行反恐怖主義犯罪的專門(mén)力量建設(shè),加強(qiáng)反航空恐怖主義犯罪預(yù)案建設(shè),強(qiáng)化我國(guó)民航反恐情報(bào)信息工作,積極開(kāi)展境外航空反恐協(xié)作與交流,完善反恐怖主義犯罪的立法等六個(gè)方面對(duì)我國(guó)反航空恐怖主義犯罪課題提出筆者的對(duì)策與建議。
[Abstract]:The fifth anniversary of the terrorist attack on September 11 has passed, but the crime of terrorism has increasingly become a major public hazard in the contemporary world, a common enemy of the civilized society of all mankind, seriously endangering world peace and security, economic development and social progress. At present, during the period of great development of China's civil aviation industry, the activities of ethnic splittist forces are rampant, the factors of social instability have increased, the gap between the rich and the poor has further expanded, and various social inequities have intensified, and so on. These factors may become the inducement of aviation terrorism crime and threaten our aviation safety seriously. On the other hand, the crime of aviation terrorism also poses a great threat to the 2008 Beijing Olympic Games and the 2010 Shanghai World Expo. In advance, the author tries to explain from three parts: the summary of terrorist crime, the present situation of aviation terrorism crime and the countermeasures of anti-aviation terrorism crime in China. This paper is divided into three parts. The first part examines the historical development process of the concept of terrorist crime from the interpretation of the meaning of terrorist crime and historical retrospect. By comparing the terrorist crime with the related concepts, the four elements of the concept of terrorist crime are analyzed one by one, and the author's definition of the concept of terrorist crime is obtained. This paper analyzes the harmfulness of terrorism crime by introducing the traditional terrorism type, contemporary terrorism type and our country terrorism type, which makes us understand terrorist crime more intuitively. The second part reviews the history of international aviation terrorism crime and briefly describes the harmfulness of aviation terrorism crime. General introduction to the international legislative intent of the Tokyo Convention, the Hague Convention, the Montreal Convention and the Protocol supplementing the Montreal Convention on combating aviation terrorism; Three types of aviation terrorism crimes, such as hijacking aircraft, endangering aircraft flight safety and endangering international civil aviation airport security, are analyzed one by one. The principle of "or prosecute or extradite" for the punishment of crimes of aviation terrorism is also elaborated; This paper introduces the general situation of aviation terrorism crime in our country, the legal prevention measures of aviation terrorism crime, the work system of aviation safety and security in our country, and analyzes the five problems and deficiencies in the aspect of anti-aviation terrorism crime in our country. The third part, according to the author's understanding and understanding of the terrorist crime, combined with the reality of civil aviation public security work, from strengthening the construction of civil aviation counter-terrorism prevention, stepping up the construction of the specialized strength of anti-terrorist crimes. We will strengthen the construction of anti-aviation terrorism crime plans, strengthen our civil aviation counter-terrorism intelligence and information work, and actively carry out overseas aviation counter-terrorism cooperation and exchanges. The author puts forward the countermeasures and suggestions on the subject of anti-aviation terrorism crime from six aspects, such as perfecting the legislation of anti-terrorist crime.
