【摘要】：目前我國(guó)未成年人犯罪數(shù)量正呈現(xiàn)出逐年快速上升趨勢(shì)，且重新犯罪率很高。違法犯罪的未成年人已成為社會(huì)的極大關(guān)注。未成年犯罪人因其未成年的特點(diǎn)，在刑事司法中要本著有利于其教育挽救、健康成長(zhǎng)為出發(fā)點(diǎn)進(jìn)行教育改造；但是作為罪犯，有的未成年犯罪人也具有人身危險(xiǎn)性，因此在刑事司法中要平衡好犯罪未成年人和社會(huì)利益的關(guān)系，做到準(zhǔn)確司法，就必須對(duì)未成年犯罪人人身危險(xiǎn)性做出準(zhǔn)確的評(píng)估。 入矯前對(duì)未成年犯進(jìn)行人身危險(xiǎn)性評(píng)估有著非常重要的價(jià)值。隨著社區(qū)矯正工作的逐漸發(fā)展，呈現(xiàn)出日益增多的非監(jiān)禁刑罰的未成年人被判處進(jìn)入社區(qū)接受矯正。入矯前對(duì)未成年犯進(jìn)行人身危險(xiǎn)性評(píng)估是為其早日融入社會(huì)創(chuàng)造條件，以提高社區(qū)矯正質(zhì)量和效果。是為了更好的管教幫扶矯正對(duì)象中的這部分“特殊群體”，通過(guò)對(duì)未成年犯的人身危險(xiǎn)性進(jìn)行科學(xué)有效的評(píng)估，有利于貫徹寬嚴(yán)相濟(jì)刑事政策，提高我國(guó)未成年人刑事司法水平；有利于降低其重新犯罪率，化解社會(huì)矛盾，建設(shè)和諧社區(qū)；有利于幫助其順利回歸社會(huì)，維護(hù)社會(huì)的和諧與穩(wěn)定。科學(xué)和有效的罪犯的人身危險(xiǎn)性評(píng)估，既能夠幫助矯正人員準(zhǔn)確的、科學(xué)的認(rèn)識(shí)罪犯的犯罪行為，又能夠其準(zhǔn)確把握罪犯行為規(guī)律，從兩科學(xué)預(yù)防其犯罪，維護(hù)社會(huì)秩序及公眾安全。 但是社區(qū)矯正人身危險(xiǎn)性評(píng)估在我國(guó)才剛剛起步，目前的研究還存在許多不足尚待完善。因此本文以未成年犯入矯前為著眼點(diǎn)，以其人身危險(xiǎn)性評(píng)估為主線，展開(kāi)研究。在總結(jié)我國(guó)這方面多年實(shí)踐經(jīng)驗(yàn)，廣泛參考外國(guó)社區(qū)矯正風(fēng)險(xiǎn)評(píng)估的成功經(jīng)驗(yàn)基礎(chǔ)上，，主要介紹了未成年犯罪人的內(nèi)容、人身危危險(xiǎn)性評(píng)估的概念、基體特征及社區(qū)矯正方面概述、及未成年犯風(fēng)險(xiǎn)評(píng)估的意義，國(guó)外各社區(qū)矯正危險(xiǎn)性評(píng)估的現(xiàn)狀及分析借鑒，并指出了我國(guó)這方面存在的不足，進(jìn)而提出了一套矯前矯正未成年犯人身危險(xiǎn)性的完善建議。
[Abstract]:At present, the number of juvenile delinquency in China is increasing rapidly year by year, and the recidivism rate is very high. Minors who break the law and commit crimes have become a great concern of the society. Minor offenders, because of their underage characteristics, in the criminal justice should be in favor of their education to save, healthy growth as the starting point of education reform; However, as criminals, some minor criminals also have personal dangerousness. Therefore, in criminal justice, we should balance the relationship between juvenile delinquents and social interests, and achieve accurate justice. It is necessary to make an accurate assessment of the personal risk of minor offenders. It is very important to evaluate the personal risk of juvenile offenders before correction. With the development of community correction, there are more and more minors who are sentenced to community correction. The personal risk assessment of juvenile offenders before correction is to create conditions for their early integration into society and to improve the quality and effect of community correction. In order to better discipline, help and correct the object of this part of the "special group", through the scientific and effective assessment of the personal risk of juvenile offenders, is conducive to the implementation of the criminal policy of leniency and severe punishment. To improve the level of juvenile criminal justice in China; It is beneficial to reduce its re-crime rate, resolve social contradictions, build a harmonious community, help it to return to society smoothly, and maintain social harmony and stability. Scientific and effective personal risk assessment of criminals can not only help correct personnel's accurate and scientific understanding of criminals' criminal behavior, but also accurately grasp the criminal behavior laws, and prevent their crimes from two science, Maintain social order and public safety. But the personal risk assessment of community correction is just beginning in our country, and there are still many deficiencies in the current research. Therefore, this paper focuses on juvenile delinquents before correction, taking their personal risk assessment as the main line. On the basis of summing up our country's many years' practical experience in this field and referring widely to the successful experience of foreign community correction risk assessment, this paper mainly introduces the contents of juvenile offenders and the concept of personal danger assessment. The matrix characteristics and community correction, the significance of risk assessment of juvenile delinquents, the status quo and analysis of risk assessment of community correction in foreign countries are summarized, and the shortcomings of this aspect in China are pointed out. Furthermore, the author puts forward a set of perfect suggestions to correct the personal danger of juvenile delinquents before correction.
