行為科學視角下的嚴重暴力犯罪探討

【摘要】： 犯罪學所研究的各類犯罪行為尤其是嚴重暴力犯罪,其產(chǎn)生的深層原因都離不開人類心態(tài)失調(diào)所導致的人性扭曲。探究作案者心理不僅是打擊和預(yù)防該類犯罪的有效途徑,也是參與司法實踐的刑偵、審判人員以及相關(guān)專家學者所面臨的重要課題。由于暴力犯罪罪犯心理難以捉摸、不愿吐露自己的真實思想以及犯罪心理研究的難以實驗或不可實驗性,在這一領(lǐng)域的心理研究較之其他領(lǐng)域的心理研究難度更大。而行為科學研究正是在一定范疇內(nèi)探究違法犯罪者的心理行為規(guī)律,通過掌握規(guī)律性來提高法政部門預(yù)測其未來行為、引導在押者改過自新以及進一步控制潛在人群行為的能力,為犯罪預(yù)防工作開辟了新的途徑。本文就選擇這一方向,應(yīng)用行為科學對于嚴重暴力犯罪進行深入探討,具體提出了研究的意義并重點論述了嚴重暴力犯罪因素分析和嚴重暴力犯罪人的個性心理分析,形成對國內(nèi)司法實踐有積極意義的借鑒與啟發(fā)。
[Abstract]:All kinds of criminal behaviors studied by criminology, especially serious violent crimes, can not be separated from the distortion of human nature caused by the imbalance of human mentality. It is not only an effective way to crack down and prevent this kind of crime, but also an important subject for criminal investigation, judges and related experts and scholars involved in judicial practice. Because the psychology of violent criminals is elusive and unwilling to reveal their true thoughts and the study of criminal psychology is difficult to experiment or unexperimental, the psychological research in this field is more difficult than that in other fields. The behavioral science research is to explore the law of psychological behavior of offenders in a certain scope, and to improve the law departments to predict their future behavior by mastering the regularity. The ability to guide prisoners to reform and further control the behavior of potential populations opens up a new way for crime prevention. In this paper, the author makes a deep discussion on the application of behavioral science to the serious violent crime, and puts forward the significance of the research and focuses on the analysis of the factors of the serious violent crime and the personality psychological analysis of the serious violent offender. The formation has the positive significance to the domestic judicial practice to draw lessons from and enlightens.
