勞動(dòng)教養(yǎng)工作績效考核機(jī)制研究

【摘要】: 勞動(dòng)教養(yǎng)機(jī)關(guān)是指國家為保證準(zhǔn)確、有效的執(zhí)行勞動(dòng)教養(yǎng)法律、法規(guī),收容、管理和教育挽救勞動(dòng)教養(yǎng)人員,完成勞動(dòng)教養(yǎng)工作任務(wù)而依法設(shè)置的國家行政執(zhí)法機(jī)關(guān)。勞動(dòng)教養(yǎng)機(jī)關(guān)隸屬于國務(wù)院、省(區(qū)、市)和市(地)司法行政部門,是依法設(shè)立、行使行政職權(quán)、履行行政職責(zé)的行政機(jī)關(guān),其依法實(shí)施的具體行政行為具有法定的確定力、強(qiáng)制力和執(zhí)行力。 勞動(dòng)教養(yǎng)工作人民警察是依法履行勞動(dòng)教養(yǎng)工作職責(zé)、納入國家行政編制、由財(cái)政全額保證工資福利的國家公務(wù)員,其考核制度必須遵循相關(guān)法律法規(guī)的規(guī)定。同時(shí),由于工作任務(wù)的特殊性,其考核又必須有自身的特點(diǎn)。 勞動(dòng)教養(yǎng)工作歷經(jīng)50年發(fā)展,在績效考核的工作實(shí)踐中,在人事部門多年的努力下,已初步形成了具有本系統(tǒng)行業(yè)特點(diǎn)的績效考核制度。但是隨著社會(huì)文明進(jìn)程的推進(jìn)和國家法治建設(shè)的加快,隨著近年來我國公務(wù)員制度的改革和新時(shí)期勞動(dòng)教養(yǎng)工作職能、工作任務(wù)和工作特點(diǎn)的轉(zhuǎn)化,對勞動(dòng)教養(yǎng)工作績效考核制度提出了更高的要求。只有不斷深化對績效考核考核制度的研究,認(rèn)真思考現(xiàn)行制度的缺陷與不足,針對性地提出可操作的改革對策,并在實(shí)踐中加以檢驗(yàn)和調(diào)整,才能使勞動(dòng)教養(yǎng)工作績效考核制度日臻成熟和完善。 本文著眼于形勢任務(wù)的快速發(fā)展對深化我國勞教系統(tǒng)績效考核工作提出的更高要求,通過對現(xiàn)行勞動(dòng)教養(yǎng)績效考核制度的調(diào)研分析,詳細(xì)闡述了目前勞動(dòng)教養(yǎng)績效考核制度存在的突出問題,并進(jìn)一步剖析了產(chǎn)生這些問題的原因。在此基礎(chǔ)上筆者提出了完善和發(fā)展勞動(dòng)教養(yǎng)績效考核制度的思路和對策,以期對勞動(dòng)教養(yǎng)績效考核工作實(shí)踐起到積極作用。
[Abstract]:Reeducation-through-labor organs are the national administrative law enforcement agencies set up according to law to ensure the accurate and effective enforcement of the laws, regulations, reception, management and education of reeducation through labour personnel and to complete the task of reeducation through labor. The organs of re-education through labour are subordinate to the judicial administrative departments of the State Council, provinces (districts, municipalities) and municipalities (prefectures). They are administrative organs established according to law, exercising their administrative functions and powers, and performing their administrative duties. The specific administrative acts they carry out in accordance with the law have a statutory determination power. Enforcement and execution. The people's police of the reeducation through labor work is the national civil servant who performs the duty of reeducation through labor according to law, which is included in the national administrative system and guaranteed the salary and welfare by the full amount of finance, and its appraisal system must follow the provisions of the relevant laws and regulations. At the same time, due to the particularity of the task, its examination must have its own characteristics. After 50 years of development, in the practice of performance appraisal, under the efforts of the personnel department for many years, the performance appraisal system with the characteristics of this system has been formed. However, with the advancement of social civilization and the acceleration of the construction of the country's rule of law, with the reform of the civil service system in recent years and the transformation of the functions, tasks and characteristics of reeducation through labour in the new period, Put forward higher request to the performance appraisal system of reeducation through labor. Only by deepening the study of the performance appraisal system, seriously thinking about the defects and shortcomings of the current system, putting forward the operational reform countermeasures, and testing and adjusting in practice, Only in this way can the performance appraisal system of reeducation through labor become more mature and perfect. This paper focuses on the higher requirements of the rapid development of the task of the situation to deepen the performance appraisal of the re-education through labor system in China, through the investigation and analysis of the current performance appraisal system of re-education through labor. This paper expounds in detail the outstanding problems existing in the performance appraisal system of reeducation through labor at present, and further analyzes the causes of these problems. On this basis, the author puts forward the ideas and countermeasures of perfecting and developing the performance appraisal system of reeducation through labor, in order to play a positive role in the practice of performance appraisal of reeducation through labor.
