【摘要】：產(chǎn)品質(zhì)量司法鑒定由于其自身的特殊性,大大區(qū)別于已實行登記管理的前"三大類"鑒定,目前還存在著諸多可操作性不強的問題。由于沒有可操作性強的產(chǎn)品質(zhì)量司法鑒定實施程序,產(chǎn)品質(zhì)量司法鑒定機構(gòu)的業(yè)務(wù)發(fā)展必將受到嚴(yán)重阻礙,同時也會造成鑒定機構(gòu)在具體操作上的隨意性和遇到質(zhì)疑時無法尋找依據(jù)的問題。事實上,產(chǎn)品質(zhì)量司法鑒定是無法制定統(tǒng)一的技術(shù)規(guī)范的,只能制定一個適合其操作的粗線條的程序或辦法。只有在這樣一個大框架下,鑒定人才可以有理有據(jù)地回答那些委托方提出的專門性問題。
[Abstract]:Because of its own particularity, the judicial identification of product quality is greatly different from the former "three categories" of registration management. At present, there are still many problems of weak operability. Since there is no operational procedure for the judicial identification of product quality, the business development of the judicial appraisal institution of product quality will be seriously hindered. At the same time, it will result in the random operation of the appraisal organization and the problem that it can not find the basis when it is questioned. In fact, the judicial appraisal of product quality can not make uniform technical specification, but only a procedure or method suitable for its operation. Only in such a large framework can the expert answer the specific questions posed by the client in a reasonable way.
