【摘要】：網(wǎng)絡(luò)計(jì)算機(jī)犯罪具有很強(qiáng)的技術(shù)性，而且多在虛擬的網(wǎng)絡(luò)時(shí)空實(shí)施，因此與傳統(tǒng)犯罪相比，其在偵查思路和方法上也必然有新的要求。然而，目前針對(duì)網(wǎng)絡(luò)計(jì)算犯罪的國內(nèi)外研究雖然很多，卻主要集中于刑法學(xué)、犯罪學(xué)以及證據(jù)學(xué)領(lǐng)域，以偵查的視角進(jìn)行地探討較少。其中，偵查領(lǐng)域的研究又往往將網(wǎng)絡(luò)計(jì)算機(jī)犯罪中的一些問題以及對(duì)偵查造成的負(fù)面影響非理性地夸大，而對(duì)偵查思路與各種措施的使用只進(jìn)行了粗線條的描繪。相關(guān)的著述也多是將單純的計(jì)算機(jī)技術(shù)手段作為網(wǎng)絡(luò)計(jì)算機(jī)犯罪偵查的主要內(nèi)容，而對(duì)該類犯罪中傳統(tǒng)偵查措施的介入時(shí)機(jī)以及實(shí)施方針則言之甚少。這使得偵查人員在網(wǎng)絡(luò)計(jì)算機(jī)犯罪的偵查過程中無法得到理論上的有效指導(dǎo)，還會(huì)影響到現(xiàn)有偵查措施的利用及效果發(fā)揮，從而削弱了戰(zhàn)勝此類犯罪的信心。在此情況下，筆者試以偵查的視角，對(duì)網(wǎng)絡(luò)計(jì)算機(jī)犯罪的相關(guān)問題進(jìn)行一個(gè)系統(tǒng)而深入的論述。 除前言和結(jié)語外，，全文共分為三個(gè)部分： 第一部分是對(duì)網(wǎng)絡(luò)類計(jì)算機(jī)犯罪的考察，并在考察的基礎(chǔ)上歸納了此類犯罪在偵查學(xué)意義上的特征，從而為偵查實(shí)踐工作的展開提供了背景和基礎(chǔ)。其具體內(nèi)容包括對(duì)網(wǎng)絡(luò)類計(jì)算機(jī)犯罪的概念認(rèn)識(shí)、現(xiàn)象分析和特點(diǎn)歸納； 第二部分是對(duì)網(wǎng)絡(luò)類計(jì)算機(jī)犯罪的偵查研究。這部分的內(nèi)容具體包括以下幾個(gè)要點(diǎn)：首先，在認(rèn)識(shí)網(wǎng)絡(luò)計(jì)算機(jī)犯罪特點(diǎn)的基礎(chǔ)上，理性地看待目前該類犯罪偵查工作所面臨的困境；其次，從偵查機(jī)制的建構(gòu)以及偵查程序的完善這兩個(gè)角度來尋求網(wǎng)絡(luò)計(jì)算機(jī)犯罪偵查的突破口，并在比較國內(nèi)外網(wǎng)絡(luò)計(jì)算機(jī)犯罪偵查措施的基礎(chǔ)上，結(jié)合我國國情，提出具有可操作性的偵查機(jī)制和偵查程序； 第三部分將網(wǎng)絡(luò)計(jì)算機(jī)犯罪中的一些特殊問題作為偵查的有機(jī)組成部分進(jìn)行了配套陛的研究，其中主要是以偵查的角度對(duì)網(wǎng)絡(luò)時(shí)代計(jì)算機(jī)犯罪中的法律規(guī)范問題及電子證據(jù)問題進(jìn)行了探討。 筆者希望能夠通過以上三個(gè)部分的研究，充分認(rèn)識(shí)網(wǎng)絡(luò)計(jì)算機(jī)犯罪偵查的一些基本問題，并在此基礎(chǔ)上提出若干具有可行性和操作性的構(gòu)想，從而為我國網(wǎng)絡(luò)計(jì)算機(jī)犯罪偵查工作的前行提供一點(diǎn)助力。
[Abstract]:Network computer crime is highly technical and mostly implemented in virtual network space and time. Therefore, compared with the traditional crime, it must also have new requirements in the way of investigation and methods. However, although there are a lot of domestic and foreign researches on network computing crime, it is mainly focused on criminal law, criminology and evidence science, and is less explored from the angle of investigation. Among them, the research in the field of investigation often exaggerates some problems in the network computer crime and the negative influence caused by the investigation, but only carries on the rough description to the investigation thought and the use of various measures. Most of the related works also regard the simple computer technology as the main content of the network computer crime investigation, but the intervention opportunity and the implementation policy of the traditional investigation measures in this kind of crime are very few. This makes the investigators unable to get effective guidance in theory in the process of investigation of network computer crimes, and will also affect the use and effect of existing investigative measures, thus weakening the confidence to overcome such crimes. In this case, the author tries to make a systematic and in-depth discussion on the related problems of network computer crime from the angle of investigation. In addition to the preface and conclusion, the full text is divided into three parts: the first part is the investigation of network computer crime. On the basis of investigation, this paper sums up the characteristics of this kind of crime in the sense of criminal investigation, which provides the background and foundation for the practice of investigation. Its concrete content includes the concept understanding, the phenomenon analysis and the characteristic induction to the network type computer crime; The second part is the investigation and research of network computer crime. The content of this part includes the following key points: firstly, on the basis of understanding the characteristics of network computer crime, we can rationally look at the predicament that this kind of crime investigation is facing at present; secondly, From the point of view of the construction of investigation mechanism and the perfection of investigation procedure, this paper tries to find a breakthrough in the investigation of network computer crime, and on the basis of comparing the domestic and foreign measures of network computer crime investigation, combining with the national conditions of our country, The investigation mechanism and procedure with maneuverability are put forward. In the third part, some special problems in network computer crime are studied as an organic part of investigation. This paper mainly discusses the legal norm and electronic evidence of computer crime in the network age from the angle of investigation. The author hopes that through the research of the above three parts, I can fully understand some basic problems of network computer crime investigation, and put forward some feasible and operable ideas on this basis. In order to provide a little help for our network computer crime investigation.
