【摘要】： 目前，我國廣大科技工作者正積極投身在民族復(fù)興的歷史使命中，但也有少數(shù)人員利用職務(wù)的便利實(shí)施了破壞性極強(qiáng)的犯罪。事實(shí)證明，，科技人員利用職務(wù)便利實(shí)施的犯罪，所造成的危害更大，更需要良好的預(yù)防措施。因而，加強(qiáng)對(duì)科技人員職務(wù)犯罪的研究，充分認(rèn)識(shí)此類犯罪的危害并提出前瞻性的預(yù)防措施已成為一項(xiàng)重要課題。而目前國內(nèi)外刑法學(xué)和犯罪學(xué)領(lǐng)域?qū)Υ藛栴}的研究，大多是針對(duì)具體的個(gè)案加以論證與說明，缺乏整體、系統(tǒng)的研究和把握。作為一名在科研單位從事檢察工作的檢察人員，筆者認(rèn)為有必要對(duì)科技人員這一特定人群的職務(wù)犯罪問題進(jìn)行研究探討。 在本論中，筆者主要運(yùn)用實(shí)證研究的方法從科技人員職務(wù)犯罪的概念及內(nèi)涵界定出發(fā)，對(duì)此類犯罪的特點(diǎn)進(jìn)行概括和總結(jié)；并通過對(duì)現(xiàn)階段科技人員職務(wù)犯罪現(xiàn)狀的剖析，從此類犯罪的成因及危害、目前在防范、打擊此類犯罪方面的現(xiàn)狀與不足、以及我們應(yīng)當(dāng)怎樣構(gòu)筑一套合理且有效的預(yù)防與打擊此類犯罪的機(jī)制等幾個(gè)方面進(jìn)行論證，同時(shí)結(jié)合筆者工作實(shí)際，重點(diǎn)探討檢察機(jī)關(guān)在預(yù)防和控制此類犯罪方面應(yīng)當(dāng)進(jìn)行的改革工作。
[Abstract]:At present, the vast number of scientific and technological workers in our country are actively engaged in the historical mission of national rejuvenation, but there are also a few people who have committed extremely destructive crimes by taking advantage of the convenience of their posts. It has been proved that scientific and technological personnel make use of their position to facilitate the commission of crimes, which cause more harm and need more good preventive measures. Therefore, it has become an important subject to strengthen the research on the position crime of scientific and technological personnel, fully understand the harm of this kind of crime and put forward forward-looking preventive measures. At present, the research on this problem in the field of criminal law and criminology at home and abroad is mostly based on the demonstration and explanation of specific cases, lacking of the whole and systematic research and understanding. As a procurator engaged in procuratorial work in scientific research institutions, the author thinks that it is necessary to study the problem of duty crime of scientific and technological personnel as a specific group. In this theory, the author mainly uses the method of empirical research to summarize and summarize the characteristics of this kind of crime from the definition of the concept and connotation of the crime of science and technology personnel, and through the analysis of the present situation of the crime of science and technology personnel, From the causes and harm of such crimes, the current situation and shortcomings in preventing and combating such crimes, and how we should build a reasonable and effective mechanism to prevent and combat such crimes, and so on, At the same time, combined with the author's actual work, the author emphatically discusses the reform work that should be carried out by procuratorial organs in the prevention and control of such crimes.
