【摘要】：當(dāng)前,黑社會(huì)(性質(zhì))組織犯罪正逐漸成為一個(gè)全球性的犯罪問(wèn)題,我國(guó)的黑社會(huì)性質(zhì)組織犯罪活動(dòng)也愈演愈烈,引起了國(guó)際社會(huì)和我國(guó)政府的高度關(guān)注。特別是伴隨著我國(guó)經(jīng)濟(jì)的快速發(fā)展,黑社會(huì)性質(zhì)組織向經(jīng)濟(jì)領(lǐng)域的滲透程度不斷加劇,使犯罪組織的經(jīng)濟(jì)基礎(chǔ)更加雄厚,發(fā)展更加成熟,嚴(yán)重?cái)_亂了社會(huì)經(jīng)濟(jì)、生活秩序,對(duì)國(guó)家安定和經(jīng)濟(jì)安全構(gòu)成了重大現(xiàn)實(shí)威脅。而目前,對(duì)黑社會(huì)性質(zhì)組織向經(jīng)濟(jì)領(lǐng)域滲透的問(wèn)題研究工作相對(duì)滯后,專(zhuān)門(mén)論述的文獻(xiàn)不多,為此,作者在老師的悉心指導(dǎo)下,認(rèn)真查閱資料,細(xì)細(xì)加以體會(huì),采用實(shí)證、比較和系統(tǒng)分析等方法,對(duì)黑社會(huì)性質(zhì)組織向經(jīng)濟(jì)領(lǐng)域滲透的定義及性質(zhì)進(jìn)行了界定,對(duì)合法經(jīng)濟(jì)領(lǐng)域與非法經(jīng)濟(jì)領(lǐng)域進(jìn)行了辨析,粗略的對(duì)境內(nèi)外黑社會(huì)(性質(zhì))組織犯罪的起源及向經(jīng)濟(jì)領(lǐng)域滲透進(jìn)行了歷史考察,集中論述了國(guó)內(nèi)當(dāng)前黑社會(huì)性質(zhì)組織向經(jīng)濟(jì)滲透的現(xiàn)狀和趨勢(shì),在原因追問(wèn)的基礎(chǔ)上,從社會(huì)、立法、司法三個(gè)層面詳細(xì)探討了遏制黑社會(huì)性質(zhì)組織向經(jīng)濟(jì)領(lǐng)域滲透的對(duì)策。囿于學(xué)識(shí)所限,研究仍較為膚淺,也算是拋磚引玉,聊以自慰。
[Abstract]:At present, the organized crime of underworld is gradually becoming a global crime problem, and the criminal activities of the underworld organization in our country are becoming more and more serious, which has aroused the high attention of the international community and our government. In particular, with the rapid economic development of our country, the infiltration degree of the underworld organizations into the economic field is increasing, which makes the economic base of the criminal organizations stronger and more mature, seriously disrupting the social, economic and life order. It poses a real threat to national stability and economic security. At present, however, the research work on the infiltration of underworld organizations into the economic field is relatively lagging behind, and there is not much literature specifically discussed. Therefore, under the careful guidance of the teacher, the author carefully consulted the information, carefully understood it, and adopted empirical evidence. By means of comparison and systematic analysis, this paper defines the definition and nature of the infiltration of underworld organizations into the economic field, and discriminates between the legal economic field and the illegal economic field. This paper makes a historical investigation of the origin of the organized crime in and out of the country and its infiltration into the economic field, and focuses on the present situation and trend of the infiltration of the underworld organization into the economy in China. On the basis of the reasons, From the social, legislative and judicial levels, this paper discusses in detail the countermeasures to curb the infiltration of underworld organizations into the economic field. Limited by knowledge, the research is still superficial, and it is also a reference to masturbate.
