【摘要】：近幾年來(lái)，隨著經(jīng)濟(jì)和科技的迅猛發(fā)展，國(guó)際犯罪的形勢(shì)也愈加嚴(yán)峻，各種犯罪日益猖獗，尤其是恐怖主義犯罪、經(jīng)濟(jì)犯罪，嚴(yán)重影響整個(gè)國(guó)際社會(huì)的秩序和管理，對(duì)我們國(guó)際偵查合作提出了新的挑戰(zhàn)�，F(xiàn)代化交通工具的發(fā)達(dá)、國(guó)家邊界的開(kāi)放，以及現(xiàn)代化科學(xué)技術(shù)的廣泛應(yīng)用，為犯罪分子逃避法律制裁提供了極大的便利條件。面對(duì)如此嚴(yán)峻的形勢(shì)，，我們應(yīng)加強(qiáng)與世界各國(guó)、國(guó)際刑警組織和其他國(guó)際社會(huì)力量的交流和合作，建立長(zhǎng)期有效地合作機(jī)制，廣泛地傳遞犯罪的情報(bào)和線索，形成一個(gè)國(guó)際性的“法網(wǎng)”，徹底地預(yù)防和打擊國(guó)際犯罪、跨國(guó)犯罪以及涉外犯罪。 本文共分為四個(gè)部分： 第一部分首先對(duì)國(guó)際偵查合作的概念進(jìn)行界定，以區(qū)別于國(guó)際偵查協(xié)作、國(guó)際警務(wù)合作以及刑事司法協(xié)助等相關(guān)概念，同時(shí)進(jìn)一步對(duì)國(guó)際偵查合作的適用對(duì)象進(jìn)行闡述，以確定國(guó)際偵查合作的范圍。 第二部分主要論述國(guó)際偵查合作的具體方式和原則。國(guó)際偵查合作具體方式主要包括犯罪信息的交流、追繳犯罪收益、控制下交付、緝捕犯罪嫌疑人等等。而本文將從國(guó)際法意義上的國(guó)際偵查合作的基本原則和國(guó)際偵查合作所特有的基本原則兩個(gè)方向?qū)?guó)際偵查合作的原則進(jìn)行闡述。 第三部分歸納分析了我國(guó)國(guó)際偵查合作運(yùn)行的現(xiàn)狀以及所遇到的障礙與難題，并為引出第四部分做了鋪墊。 第四部分是本文的重中之重，即國(guó)際偵查合作的現(xiàn)狀和完善，只有了解現(xiàn)狀，尋找、發(fā)現(xiàn)問(wèn)題，才能更好的解決問(wèn)題。面對(duì)經(jīng)濟(jì)全球化和科技迅猛的發(fā)展給我們帶來(lái)的新挑戰(zhàn)，我們應(yīng)根據(jù)新情況著力調(diào)整各國(guó)在法律上的銜接關(guān)系，以強(qiáng)化在預(yù)防和控制國(guó)際犯罪上的國(guó)際偵查合作。
[Abstract]:In recent years, with the rapid development of economy and science and technology, the situation of international crime has become more and more serious, and various kinds of crimes have become increasingly rampant, especially terrorist crimes and economic crimes, which have seriously affected the order and management of the entire international community. It poses a new challenge to our international investigative cooperation. The development of modern means of transportation, the opening of national borders, and the wide application of modern science and technology provide a great convenience for criminals to evade legal sanctions. In the face of such a serious situation, we should strengthen exchanges and cooperation with countries around the world, Interpol and other forces of the international community, establish long-term and effective cooperation mechanisms, and widely disseminate criminal intelligence and clues. To form an international legal network to prevent and combat international, transnational and foreign crimes. This paper is divided into four parts: the first part defines the concept of international criminal investigation cooperation, which is different from the related concepts such as international investigation cooperation, international police cooperation and criminal judicial assistance. At the same time, the applicable object of international investigation cooperation is expounded to determine the scope of international investigation cooperation. The second part mainly discusses the concrete ways and principles of international investigation cooperation. The specific ways of international investigation cooperation mainly include the exchange of criminal information, the recovery of criminal proceeds, the controlled delivery, the arrest of criminal suspects and so on. This article will expound the principle of international investigation cooperation from two aspects: the basic principles of international investigation cooperation in the sense of international law and the special basic principles of international investigation cooperation. The third part summarizes and analyzes the current situation, obstacles and difficulties in the operation of international investigative cooperation in China, and paves the way for the introduction of the fourth part. The fourth part is the most important part of this paper, that is, the status quo and perfection of international investigative cooperation, only to understand the current situation, to find out the problem, can better solve the problem. In the face of the new challenges brought by the economic globalization and the rapid development of science and technology, we should adjust the legal connection of various countries according to the new situation in order to strengthen the international investigation cooperation in the prevention and control of international crime.
