問題與路徑：社區(qū)矯正本土化研究

【摘要】： 20世紀30、40年代,社區(qū)矯正在歐美國家興起,經過幾十年的發(fā)展,目前已成為世界行刑領域的主流,被公認為是一種人道、經濟、文明、有效的行刑方式。許多國家適用社區(qū)矯正的人數(shù)大大超過監(jiān)禁人數(shù),美國、英國、加拿大等西方發(fā)達國家的社區(qū)矯正已經有了完善的法律制度和健全的工作網絡。而我國自2003年7月啟動全國性社區(qū)矯正試點工作以來,目前試點范圍已擴展到25個省(區(qū)、市),試點實踐中,我們探索總結了很多成功經驗和有效做法,但我國社區(qū)矯正工作仍處于本土化過程的推進階段,客觀上仍存在著許多亟待解決的困難和問題,諸如社區(qū)矯正刑罰文化支撐薄弱、社區(qū)矯正本土化法律突破與創(chuàng)新不足、社區(qū)矯正本土化的經費保障機制不完善、社區(qū)矯正體制機制的獨立性不強、社區(qū)資源和社會力量的作用未能充分發(fā)揮,等等。本文著力對社區(qū)矯正本土化的內涵、國內訴求、價值理念認同、現(xiàn)實狀況和本土化的推進策略和前瞻等方面進行理論和實踐上的探討,旨在為本土化工作理清思路、排除障礙,進而為推進我國社區(qū)矯正本土化進程與改革和完善我國的刑事執(zhí)行體系建言獻策。
[Abstract]:In the 1930s and 1940s, community correction rose in Europe and the United States. After decades of development, community correction has become the mainstream in the field of execution in the world, which is recognized as a humane, economic, civilized and effective execution method. In many countries, the number of people applying community correction is much higher than the number of incarceration. The United States, Britain, Canada and other western developed countries have a sound legal system and a sound working network. Since the national community correction pilot work was launched in July 2003, the scope of the pilot project has been expanded to 25 provinces (districts, municipalities). In the pilot practice, we have explored and summarized many successful experiences and effective practices. However, the work of community correction in our country is still in the process of promoting localization, and there are still many difficulties and problems to be solved objectively, such as the weak cultural support of community correction, the lack of legal breakthrough and innovation in the localization of community correction. The funds guarantee mechanism of community correction localization is not perfect, the independence of community correction system mechanism is not strong, the role of community resources and social forces is not fully developed, and so on. This paper focuses on the theoretical and practical discussion on the connotation, domestic demand, value concept identity, reality situation and the strategy and prospect of the localization of community correction, in order to clear the way of thinking and remove the obstacles for the localization work. Further, suggestions are put forward to promote the localization of community correction and to reform and perfect the criminal execution system of our country.
