【摘要】：證券違法犯罪會(huì)降低證券市場(chǎng)的效率，對(duì)其監(jiān)管被認(rèn)為是一場(chǎng)迄今“沒(méi)有取得勝利的戰(zhàn)爭(zhēng)”。罪犯犯罪的概率取決于監(jiān)管成本和發(fā)現(xiàn)犯罪行為后對(duì)市場(chǎng)的彌補(bǔ)收益，監(jiān)管者監(jiān)管的概率取決于罪犯的犯罪成本和犯罪收益。監(jiān)管者如不能全面加強(qiáng)監(jiān)管力度，也可以通過(guò)降低監(jiān)督成本，，加大懲罰力度降低證券市場(chǎng)犯罪的概率。
[Abstract]:Security crimes reduce the efficiency of the securities market, and its regulation is regarded as a "war without victory" so far. The probability of criminal crime depends on the cost of supervision and the compensatory benefit to the market after the discovery of the criminal behavior, while the probability of supervision by the supervisor depends on the criminal cost and the proceeds of the crime. If the supervisor can not strengthen the supervision comprehensively, he can reduce the probability of the crime in the securities market by reducing the supervision cost and increasing the punishment.
