【摘要】：偵查邏輯理論在當(dāng)代邏輯學(xué)、偵查學(xué)等學(xué)科研究中占有重要的地位，偵查假設(shè)理論作為偵查邏輯的重要組成部分，自然成為邏輯學(xué)界、偵查學(xué)界論述的重點(diǎn)。相關(guān)作品雖然不少，但大多數(shù)卻流于就事論事，對(duì)偵查假設(shè)理論依據(jù)的探討卻是很少見(jiàn)。本文中，筆者嘗試在探討偵查假設(shè)理論依據(jù)的基礎(chǔ)上，構(gòu)建一個(gè)完整的動(dòng)態(tài)意義上的偵查假設(shè)的運(yùn)行模式，以期對(duì)該理論的研究有所推動(dòng)。 本文立足于兩個(gè)基本觀點(diǎn)：(1)必須從狹義和廣義兩個(gè)層面來(lái)理解偵查假設(shè)。狹義上的偵查假設(shè)是對(duì)偵查中需要查明問(wèn)題的推測(cè)性解釋；廣義上的偵查假設(shè)則是由假設(shè)提出、假設(shè)推演、假設(shè)驗(yàn)證構(gòu)成的有機(jī)系統(tǒng)。(2)偵查假設(shè)與可能世界理論存在著密切關(guān)系，即可能世界理論為偵查假設(shè)提供了理論依據(jù)。在構(gòu)建偵查假設(shè)系統(tǒng)——即假設(shè)提出、假設(shè)推演，假設(shè)驗(yàn)證過(guò)程中，應(yīng)該嚴(yán)格遵循可能世界理論的相關(guān)要求，唯有如此，才能構(gòu)建科學(xué)合理的偵查假設(shè)系統(tǒng)，從而指導(dǎo)偵查工作順利進(jìn)行。 本文除了導(dǎo)言外，還有三個(gè)部分。 導(dǎo)言部分介紹了偵查假設(shè)對(duì)于偵查工作的重要性和國(guó)內(nèi)研究的概況，提出了本文的主要框架。 第一部分：偵查假設(shè)的程序模式分析 首先在批判分析學(xué)界關(guān)于偵查假設(shè)定義的基礎(chǔ)上，筆者提出應(yīng)該從狹義與廣義兩個(gè)層面上來(lái)理解偵查假設(shè)。從狹義上來(lái)分析，，偵查假設(shè)是偵查人員根據(jù)所掌握的案件事實(shí)或準(zhǔn)案件事實(shí)，結(jié)合一定的背景知識(shí)，運(yùn)用一定的思維方式和思維方法，對(duì)事實(shí)所反映出來(lái)的需要查明的問(wèn)題所作出的推測(cè)性解釋；從廣義上來(lái)分析，偵查假設(shè)是由假設(shè)提出、假設(shè)推演、假設(shè)驗(yàn)證構(gòu)成的動(dòng)態(tài)系統(tǒng)。緊接著著重分析了偵查假設(shè)相對(duì)于一般科學(xué)假說(shuō)的特殊性。其次，對(duì)偵查假設(shè)的程序模式進(jìn)行分析。重點(diǎn)在于：(1)從邏輯上提出科學(xué)合理的偵查假設(shè)的方法要求——演繹法與非演繹法；(2)驗(yàn)證偵查假設(shè)的不同情形：否定偵查假設(shè)、肯定偵查假設(shè)、偵查假設(shè)的辯證發(fā)展。 第二部分：可能世界理論 這部分以萊布尼茨的可能世界理論作為論述對(duì)象。分別論述了可能世
[Abstract]:The theory of investigation logic plays an important role in the study of modern logic, investigation science and other disciplines. As an important part of investigation logic, the theory of investigation hypothesis has naturally become the focus of discussion in the field of logic and investigation. Although there are a lot of related works, most of them focus on the subject matter, and the theoretical basis of investigation hypothesis is rare. In this paper, the author tries to explore the theoretical basis of investigation hypothesis, and build a complete dynamic investigation hypothesis of the operation model, in order to promote the study of the theory. This paper is based on two basic viewpoints: (1) the investigation hypothesis must be understood from the narrow sense and the broad sense. In a narrow sense, the investigation hypothesis is a conjectural interpretation of the problem that needs to be identified in the investigation, while in a broad sense, the investigation hypothesis is put forward by the hypothesis, which is deduced from the hypothesis. (2) the hypothesis of investigation is closely related to the theory of the possible world, that is, the theory of the possible world provides the theoretical basis for the hypothesis of investigation. In the process of constructing the investigation hypothesis system, that is, the hypothesis is put forward, the hypothesis deduction, and the hypothesis verification, we should strictly follow the relevant requirements of the possible world theory. Only in this way, can we construct a scientific and reasonable investigation hypothesis system. In order to guide the investigation work smoothly. In addition to the introduction, there are three parts in this paper. The introduction introduces the importance of the investigation hypothesis to the investigation work and the general situation of the domestic research, and puts forward the main frame of this paper. The first part: the analysis of the procedural model of the investigation hypothesis is based on the definition of the investigation hypothesis in the critical analysis field. The author suggests that the investigation hypothesis should be understood from two aspects: narrow sense and broad sense. In a narrow sense, the investigation hypothesis is that investigators use a certain mode of thinking and thinking method according to the facts of the case or the quasi-case facts that they have mastered, combined with certain background knowledge. In a broad sense, the investigation hypothesis is a dynamic system composed of hypotheses, and hypotheses. Then it analyzes the particularity of the investigation hypothesis relative to the general scientific hypothesis. Secondly, the procedure model of investigation hypothesis is analyzed. The key points are as follows: (1) the logical method of scientific and reasonable investigation hypothesis is required-deductive method and non-deductive method; (2) the different situations of verifying investigation hypothesis: negating investigation hypothesis, affirming investigation hypothesis, and dialectical development of investigation hypothesis. The second part: the theory of possible world this part takes Leibniz's theory of possible world as the object of discussion. The possible epoch is discussed separately.
