【摘要】： 社區(qū)矯正作為一種全新的司法社會工作實踐,已引起實務部門與學者的廣泛關注。社區(qū)矯正制度較之傳統(tǒng)的行刑制度優(yōu)勢是明顯的,目前我國在試行過程中暴露出來一些突出問題。而恢復性司法理念對于建立與完善社區(qū)矯正制度提供重要理論支撐。結(jié)合實踐,本文就我國社區(qū)矯正中存在的問題和恢復性司法理念下重構(gòu)社區(qū)矯正制度展開論述。文章由引言和三章組成。文章第一部分:是論述社區(qū)矯正的基本問題。作者首先闡述社區(qū)矯正的概念,闡述目前國內(nèi)權(quán)威的定義。隨后論述社區(qū)矯正的特點、歷史發(fā)展、理論依據(jù)及價值,并對理論依據(jù)進行討論。第二部分:論述我國社區(qū)矯正的狀況。作者首先闡述了我國社區(qū)矯正的試點情況,其次引用本地區(qū)實證調(diào)查報告的情況,重點論述了存在的問題,然后對產(chǎn)生問題的原因進行了分析,認為存在問題的根本原因是報應性司法理念的反映,由此引出社區(qū)矯正需要運用恢復性司法理念來完善。第三部分:論述恢復性司法理念下的社區(qū)矯正制度構(gòu)建問題。作者首先論述恢復性司法的基本問題,然后闡述恢復性司法理念為社區(qū)矯正提供價值理念,通過對恢復性司法理念對社區(qū)矯正理論價值的貢獻,我們重新審視現(xiàn)今的社區(qū)矯正機制,要建立一個符合恢復性司法理念背景下的矯正模式,可以從主體、范圍、程序、法律制度四個方面去重構(gòu)。
[Abstract]:As a new judicial and social work practice, community correction has attracted wide attention of practical departments and scholars. Compared with the traditional execution system, the community correction system has obvious advantages. At present, some outstanding problems are exposed in the process of trial in our country. The concept of restorative justice provides important theoretical support for the establishment and improvement of community correction system. Combined with practice, this paper discusses the problems existing in community correction in China and the reconstruction of community correction system under the concept of restorative justice. The article consists of an introduction and three chapters. The first part of the article is to discuss the basic problems of community correction. The author first expounds the concept of community correction and the definition of domestic authority. Then discusses the characteristics, historical development, theoretical basis and value of community correction, and discusses the theoretical basis. The second part discusses the situation of community correction in our country. The author first expounds the pilot situation of community correction in our country, then quotes the situation of the local empirical investigation report, discusses the existing problems, and then analyzes the causes of the problems. The root cause of the problems is the reflection of the retributive judicial idea, which leads to the need to improve the community correction by using the restorative justice concept. The third part discusses the construction of community correction system under the concept of restorative justice. The author first discusses the basic problems of restorative justice, and then expounds that the concept of restorative justice provides the value concept for community correction, through the contribution of restorative justice concept to the theoretical value of community correction. We should re-examine the current community correction mechanism and set up a correction model in accordance with the concept of restorative justice. We can reconstruct it from four aspects: subject, scope, procedure and legal system.
