國家工作人員涉黑犯罪對(duì)策研究

【摘要】： 國家工作人員涉黑犯罪是在改革開放的新形勢(shì)下、以黑社會(huì)性質(zhì)組織及其犯罪為生長(zhǎng)土壤和發(fā)展溫床的新型犯罪。國家工作人員涉黑犯罪是與黑社會(huì)性質(zhì)組織相互勾結(jié)的官員腐敗，它嚴(yán)重地破壞了社會(huì)的安定局面和經(jīng)濟(jì)的健康發(fā)展，同時(shí)還損害了黨和政府的廉潔形象。近年，我國的黑社會(huì)性質(zhì)組織開始膨脹壯大、黑社會(huì)性質(zhì)組織犯罪日益猖獗，與黑社會(huì)性質(zhì)組織相互滲透、惡性循環(huán)的國家工作人員涉黑犯罪也不斷地滋生蔓延。嚴(yán)厲打擊黑社會(huì)性質(zhì)組織犯罪、徹底鏟除與之糾纏的國家工作人員涉黑犯罪是黨、政府和全國人民最迫切的愿望。 本文針對(duì)國家工作人員涉黑犯罪這一熱點(diǎn)問題，展開論述并試圖在剖析國家工作人員涉黑犯罪成因、特點(diǎn)的基礎(chǔ)上，提出有效的國家工作人員涉黑犯罪預(yù)防對(duì)策和偵查對(duì)策。全文共分為三個(gè)部分。 第一部分，國家工作人員涉黑犯罪概述。 黑社會(huì)性質(zhì)組織是國家工作人員涉黑犯罪的屬概念，準(zhǔn)確把握黑社會(huì)性質(zhì)組織是正確認(rèn)識(shí)國家工作人員涉黑犯罪理論的起點(diǎn)。本文在探究黑社會(huì)性質(zhì)組織的歷史發(fā)展形態(tài)的基礎(chǔ)上，首先明確黑社會(huì)性質(zhì)組織的概念：黑社會(huì)性質(zhì)組織即是以暴力、威脅或者其他手段有組織地破壞經(jīng)濟(jì)、社會(huì)生活秩序的非法組織。然后，從黑社會(huì)性質(zhì)組織的組織結(jié)構(gòu)、經(jīng)濟(jì)實(shí)力、社會(huì)背景及作案手段等四個(gè)方面揭示出黑社會(huì)性質(zhì)組織的本質(zhì)特征。并且從組織程度、犯罪目的、經(jīng)濟(jì)實(shí)力及犯罪行為方式等四個(gè)方面將黑社會(huì)性質(zhì)組織與一般犯罪集團(tuán)加以區(qū)別，以強(qiáng)調(diào)黑社會(huì)性質(zhì)組織的特殊性。 在準(zhǔn)確把握黑社會(huì)性質(zhì)組織的概念及特征的前提下，提出國家工作人員涉黑犯罪的概念，即國家工作人員組織、領(lǐng)導(dǎo)、參加黑社會(huì)性質(zhì)組織及其犯罪，或者包庇、縱容、保護(hù)黑社會(huì)性質(zhì)組織及其犯罪，嚴(yán)重侵犯我國刑法所保護(hù)的社會(huì)關(guān)系，危害社會(huì)，依法應(yīng)受刑罰處罰的行為。然后，將國家工作人員涉黑犯罪劃分為組織領(lǐng)導(dǎo)、積極參與、包庇保護(hù)、瀆職放縱等四種類型。接著，開始剖析國家工作人員涉黑犯罪的特點(diǎn)。研究國家工作人員涉黑犯罪的特點(diǎn)是偵查機(jī)關(guān)制定偵查對(duì)策的基礎(chǔ)和前提，是偵查機(jī)關(guān)在開展國家工作人員涉黑犯罪的偵查工作中取得主動(dòng)權(quán)的保證。因此，本文從犯罪主體、犯罪時(shí)間、犯罪行為等三個(gè)方面對(duì)國家工作人員涉黑犯罪的特點(diǎn)進(jìn)行詳細(xì)闡 述。 第二部分，國家工作人員涉黑犯罪的預(yù)防對(duì)策。 我國解決國家工作人員腐敗問題的總方針是綜合治理。本文論述的預(yù)防 對(duì)策亦以綜合治理為豐瞇指導(dǎo)方針，綜合使用政治、經(jīng)濟(jì)、行政、文化、思 想教育等各種方法和措施。 本部分主要從以下八個(gè)方面進(jìn)行闡述:強(qiáng)化權(quán)力制約，其實(shí)質(zhì)就是保證 國家工作人員既能有效地行使權(quán)力，又能制止超越、濫用職權(quán)等對(duì)權(quán)力的非 規(guī)范運(yùn)用;加強(qiáng)檢察監(jiān)督，檢察機(jī)關(guān)基于法律監(jiān)督職能而進(jìn)行的預(yù)防國家工 作人員涉黑犯罪工作具有法定性、強(qiáng)制性、專業(yè)性和權(quán)威性的優(yōu)點(diǎn)加強(qiáng)思 想道德教育，以德治國對(duì)于預(yù)防國家工作人員涉黑犯罪指出了一條新路;完 善法制環(huán)境，主要從制定和完善國家工作人員行為的準(zhǔn)則、實(shí)現(xiàn)檢察機(jī)關(guān)對(duì) 預(yù)防國家工作人員涉黑犯罪的法制化以及完善規(guī)定國家工作人員涉黑犯罪 的相關(guān)法律三個(gè)方面加以闡述;加強(qiáng)和發(fā)揮人大代表的監(jiān)督職能作用，組成 國家的各級(jí)權(quán)力機(jī)關(guān)并對(duì)國家工作人員的工作實(shí)施監(jiān)督，是防止國家工作人 員涉黑犯罪的一個(gè)重要環(huán)節(jié);建立國家工作人員的財(cái)產(chǎn)申報(bào)簾峻，可以促使 國家工作人員廉潔自律;重視國家工作人員的養(yǎng)廉，合理改善國家工作人員 的經(jīng)濟(jì)待遇，是加強(qiáng)廉正建設(shè)的一個(gè)重要措施;健全和完善舉報(bào)制度，是依 靠關(guān)大群眾揭露和懲治國家工作人員涉黑犯罪的有效形式。 第三部分，國家工作人員涉黑犯罪的偵查對(duì)策。這是本文研究的重點(diǎn)。 首先剖析國家工作人員涉黑犯罪偵查的特點(diǎn)。研究國家工作人員涉黑犯 罪偵查的特點(diǎn)旨在把握國家工作人員涉黑犯罪偵查的規(guī)律，為制定行之有效 的偵查對(duì)策提供認(rèn)識(shí)方法上的前提。國家工作人員涉黑犯罪偵查主要有四個(gè) 方面的特點(diǎn):從事到人、從人再到事的偵查過程;偵查過程中矛盾雙方的對(duì) 抗性;案件線索少以及取證難。 然后分析有效性偵查對(duì)策的基本條件。要最大限度地實(shí)現(xiàn)國家工作人員 涉黑犯罪偵查對(duì)策的有效性，，有必要解決三個(gè)方面的問題:重視國家工作人 員涉黑犯罪的偵查工作，加強(qiáng)國家工作人員涉黑犯罪偵查的研究工作，重視 國家工作人員涉黑犯罪偵查的情報(bào)工作。 接著，重點(diǎn)分析國家工作人員涉黑犯罪的偵查對(duì)策。依據(jù)偵查對(duì)策的功 能范圍，偵查對(duì)策可以分為基本偵查對(duì)策和具體偵查對(duì)策。基本偵查對(duì)策為 偵查的.線略目標(biāo)服務(wù);具體偵查對(duì)策為偵查的戰(zhàn)術(shù)目標(biāo)服務(wù)。本文亦將國家 工作人員涉黑犯罪偵查對(duì)策分為基本偵查對(duì)策和具體偵查對(duì)策。 國家工作人員涉黑犯罪偵查的基本對(duì)策貫穿于國家工作人員涉黑犯罪 偵查工作的始終，是具體偵查對(duì)策得以實(shí)現(xiàn)的保證。制定國家工作人員涉黑 犯罪偵查基本對(duì)策的基本出發(fā)點(diǎn)，就是在政策精神和法律規(guī)定的范圍內(nèi)，根 據(jù)斗爭(zhēng)形式的需要，以最優(yōu)的謀略、最少的偵查力量，準(zhǔn)確、即時(shí)地揭露和 證實(shí)偵查對(duì)象的犯罪事實(shí)。
[Abstract]:Under the new situation of reform and opening up, the crime of state functionaries involved in underworld is a new type of crime which takes the underworld-like organizations and their crimes as the growing soil and the hotbed of development. In recent years, China's gangland-like organizations have begun to expand, gangland-like organizations have become increasingly rampant, infiltrated into each other with gangland-like organizations, and the vicious circle of state workers'Gangland-related crimes have been growing and spreading. Mafia-like organization is a concept belonging to the state functionaries'crime involving mafia, and accurately grasping the mafia-like organization is the starting point to correctly understand the theory of the state functionaries' crime involving mafia. That is to say, it is an illegal organization that destroys the order of economy and social life by violence, threat or other means.
