【摘要】：各國(guó)社會(huì)學(xué)界、精神病學(xué)界通常將網(wǎng)絡(luò)自殺(Cybersuicide)、網(wǎng)絡(luò)自殺協(xié)議(InternetSuicidePacts)視作新的自殺類型,實(shí)際上,網(wǎng)絡(luò)自殺協(xié)議中存在多種促進(jìn)、激勵(lì)甚至直接導(dǎo)致死亡的人為因素,屬于互聯(lián)網(wǎng)時(shí)代與自殺相關(guān)的網(wǎng)絡(luò)殺人行為。本文分析了網(wǎng)絡(luò)自殺協(xié)議中之犯罪場(chǎng)及這一犯罪場(chǎng)中各因素的作用機(jī)制,并提出應(yīng)以減少自殺者和有自殺企圖者為目標(biāo),主張采取結(jié)合疏導(dǎo)、減少有自殺念頭者和遏制影響自殺的外部消極因素這兩方面措施的對(duì)策。本文還對(duì)網(wǎng)絡(luò)自殺協(xié)議相關(guān)法律問題進(jìn)行了分析,對(duì)我國(guó)網(wǎng)絡(luò)自殺協(xié)議相關(guān)犯罪立法提出了完善建議。
[Abstract]:The sociological community and psychiatry of various countries usually regard (Cybersuicide), network suicide protocol (InternetSuicidePacts) as a new type of suicide. In fact, there are many kinds of human factors that promote, motivate and even lead to death directly in network suicide protocols. Belongs to the Internet era and suicide related network killing behavior. This paper analyzes the crime scene in the network suicide agreement and the action mechanism of each factor in the crime field, and proposes that the aim should be to reduce the number of suicides and those who have attempted suicide. Measures to reduce the number of suicidal thoughts and to contain the external negative factors affecting suicide. This paper also analyzes the legal problems related to the network suicide agreement, and puts forward some suggestions to improve the legislation of the crime related to the network suicide agreement in our country.
