試論犯罪綜合動因論

【摘要】： 犯罪心理成因是犯罪心理學(xué)研究的重要課題和立論基礎(chǔ)，科學(xué)的犯罪心理成因理論對于犯罪心理學(xué)的理論建設(shè)與實(shí)踐應(yīng)用都具有非常重要的指導(dǎo)作用。本文在對我國現(xiàn)有的犯罪心理成因理論做出簡要評介的基礎(chǔ)上，指出了犯罪綜合動因論作為目前我國犯罪心理學(xué)界有關(guān)犯罪心理成因的權(quán)威性觀點(diǎn)所具有的特點(diǎn)與不足。為使犯罪綜合動因論有所深入和發(fā)展，本文在辯證唯物論的指導(dǎo)下，綜合運(yùn)用心理學(xué)、法學(xué)、社會學(xué)、哲學(xué)等學(xué)科的研究方法，重點(diǎn)論述了影響犯罪心理形成的主體內(nèi)外各因素間的相互影響。以此為前提，進(jìn)一步闡述了主體內(nèi)外因素相互作用影響主體犯罪心理形成的機(jī)制。 本文共分為三部分： 第一部分——主體因素間的相互作用。主體因素包括生理因素、心理因素和行為因素，各因素之間存在著復(fù)雜的相互作用關(guān)系。生理因素為心理因素、行為因素的發(fā)生和發(fā)展提供了物質(zhì)基礎(chǔ)，心理因素對行為因素具有支配和調(diào)節(jié)作用，而行為因素反作用于心理因素，強(qiáng)化或弱化主體的某些心理因素。 第二部分——主體外因素間的相互作用。主體外因素包括社會環(huán)境因素、自然環(huán)境因素、情境因素。社會環(huán)境因素可分為大社會環(huán)境和小社會環(huán)境，兩者之間的相互作用關(guān)系可以簡單地概括為：大社會環(huán)境決定小社會環(huán)境，但是由于大社會環(huán)境對主體的影響在很大程度上要依賴小社會環(huán)境進(jìn)行，使小社會環(huán)境在兩者相互作用影響主體犯罪心理形成的過程中具有相當(dāng)?shù)哪軇有�。同時(shí)，，社會環(huán)境因素與自然環(huán)境因素、情境因素之間也相互作用，影響主體犯罪心理的形成。 第三部分——主體因素與主體外因素間的相互作用。在分析主體因素與主體外因素間相互影響的基礎(chǔ)上，在辯證唯物論的指導(dǎo)下，重點(diǎn)探討主體內(nèi)外因素共同作用，影響主體犯罪心理形成的機(jī)制。
[Abstract]:The cause of formation of criminal psychology is an important subject and theoretical basis of criminal psychology research. The scientific theory of criminal psychological origin plays a very important role in the theoretical construction and practical application of criminal psychology. On the basis of a brief review of the existing theories of the causes of criminal psychology in China, this paper points out the characteristics and shortcomings of the theory of comprehensive causes of crime as the authoritative view on the causes of criminal psychology in the field of criminal psychology in our country at present. In order to deepen and develop the theory of comprehensive motivation of crime, this paper, under the guidance of dialectical materialism, synthetically applies the research methods of psychology, law, sociology, philosophy and so on. This paper focuses on the mutual influence of various factors inside and outside the subject which affect the formation of criminal psychology. Based on this premise, this paper further expounds the mechanism of the interaction between internal and external factors that influence the formation of the subject's criminal psychology. This paper is divided into three parts: the first part-the interaction between the main factors. The main factors include physiological factors, psychological factors and behavioral factors. Physiological factors provide material basis for the occurrence and development of psychological factors and behavioral factors. Psychological factors dominate and regulate behavioral factors while behavioral factors react to psychological factors and strengthen or weaken some psychological factors of the subject. The second part is the interaction between external factors. External factors include social environmental factors, natural environment factors, situational factors. Social environmental factors can be divided into large social environment and small social environment, the interaction between the two can be summarized as: large social environment determines small social environment, However, the influence of the big social environment on the subject depends on the small social environment to a large extent, so that the small social environment has considerable initiative in the process of the interaction between the two influences the subject's criminal psychology. At the same time, social environmental factors, natural environment factors and situational factors also interact with each other, affecting the formation of subjective criminal psychology. The third part-the interaction between subject factors and external factors. Based on the analysis of the interaction between the subjective factors and the extrinsic factors, and under the guidance of dialectical materialism, this paper focuses on the mechanism of the joint action of the internal and external factors of the subject and the formation of the criminal psychology of the subject.
