【摘要】： 隨著經(jīng)濟的飛速發(fā)展,科學技術日新月異,在我國的各個行政管理領域科學技術被廣泛的運用。在科技與法治之間,因某些制度的不完善,使得科學技術在實際的執(zhí)法運用中受到了一定的阻力。近年來,隨著交通行政管理部門“電子眼”、雷達測速等高科技設備的逐漸運用、普及,交通行政管理領域的非現(xiàn)場執(zhí)法現(xiàn)象的出現(xiàn),在給交通管理部門帶來便利的同時也帶來了新的挑戰(zhàn)。 交通管理非現(xiàn)場執(zhí)法在國外的運用十分廣泛,而且對行政管理作用巨大。近年來,我國公安交通管理部門將非現(xiàn)場執(zhí)法運用到交通管理行政執(zhí)法實踐當中,適應了新時期公安交通管理工作的需要。本文以我國交通行政管理執(zhí)法為視角,從交通管理非現(xiàn)場執(zhí)法的概念切入,厘清了交通管理非現(xiàn)場執(zhí)法與交通管理現(xiàn)場執(zhí)法、交通管理非現(xiàn)場執(zhí)法與暗中執(zhí)法的邊界,講明了交通管理非現(xiàn)場執(zhí)法的必要性和優(yōu)越性,進而梳理了交通管理非現(xiàn)場執(zhí)法應遵循的基本原則,為如何正確引導交通管理非現(xiàn)場執(zhí)法作了鋪墊。然后,指出我國交通管理非現(xiàn)場執(zhí)法存在的缺陷和不足,最后就如何改進和完善交通管理非現(xiàn)場執(zhí)法模式提出了對策和建議。
[Abstract]:With the rapid development of economy and the rapid development of science and technology, science and technology are widely used in various administrative fields of our country. Between science and technology and the rule of law, because of the imperfection of some systems, science and technology in the actual application of law has been a certain resistance. In recent years, with the gradual use and popularization of high-tech equipment such as "electronic eyes" and radar velocimetry in traffic administration departments, the phenomenon of off-site law enforcement in the field of traffic administration has emerged. It not only brings convenience to traffic management department, but also brings new challenges. Non-site law enforcement of traffic management is widely used in foreign countries, and it plays an important role in administration. In recent years, China's public security traffic management departments apply off-site law enforcement to traffic management administrative law enforcement practice, which meets the needs of public security traffic management work in the new period. From the perspective of law enforcement of traffic administration in China, this paper clarifies the boundary between off-site law enforcement and traffic management law enforcement, traffic management off-site law enforcement and secret law enforcement, from the concept of off-site traffic management law enforcement, traffic management off-site law enforcement and traffic management off-site law enforcement. This paper explains the necessity and superiority of off-site law enforcement of traffic management, combs the basic principles that should be followed in traffic management off-site law enforcement, and paves the way for how to guide traffic management off-site law enforcement correctly. Then, it points out the defects and shortcomings of off-site traffic management law enforcement in China, and finally puts forward some countermeasures and suggestions on how to improve and perfect the off-site law enforcement mode of traffic management.
