【摘要】：從宏觀層面看,社區(qū)矯正取得制度實(shí)效重在利用和培育民間力量,而非創(chuàng)設(shè)新的國(guó)家管理部門或制訂專門法規(guī);司法行政系統(tǒng)發(fā)揮矯正管理作用之時(shí),審判部門的支配角色不應(yīng)忽視。從技術(shù)層面看,社區(qū)矯正對(duì)象宜排除單處資格刑的罪犯,增加受教養(yǎng)人和暫緩不起訴人。此外,社區(qū)矯正的主要方式是觀護(hù)和賠償,強(qiáng)制公益勞動(dòng)限于特定受刑人。
[Abstract]:From the macro level, the effectiveness of the community correction system is to use and cultivate the folk power, not to create new national management departments or to formulate special laws and regulations; when the judicial administration system plays the role of corrective management, The dominant role of the judiciary should not be ignored. From the technical point of view, the community correction object should exclude the single qualified criminal, and increase the educated person and the reprieve non-prosecution person. In addition, the main way of community correction is nursing and compensation, compulsory public service labor is limited to specific inmates.
