轉(zhuǎn)型期女性犯罪心理探析

【摘要】：改革開放以來,我國經(jīng)濟發(fā)展突飛猛進,社會關(guān)系也發(fā)生了很多變化,進入了社會轉(zhuǎn)型的關(guān)鍵時期。在這一時期,我國社會資源重新分配,社會關(guān)系得以重新調(diào)整,社會結(jié)構(gòu)重新整合完善,同時不可避免的是各種社會矛盾凸顯,表現(xiàn)之一就是女性犯罪增多,并且犯罪類型和表現(xiàn)有了新的變化。究其原因,既有女性自身生理、心理的特殊性,又有社會因素。但正如馬克思所說,犯罪是獨立的個體反抗社會結(jié)構(gòu)的結(jié)果,因此女性犯罪數(shù)量的增多和新表現(xiàn)從本質(zhì)上說還是社會矛盾激化的結(jié)果,是在社會轉(zhuǎn)型的大環(huán)境下經(jīng)濟、社會、文化、教育、家庭等諸多方面的影響所造成的。本文將從轉(zhuǎn)型期女性犯罪的新特征、內(nèi)部和外部心理因素各方面進行探討,重點對社會轉(zhuǎn)型期女性犯罪的外部心理因素進行探析,并且談一下女性犯罪的預(yù)防。 本文主要包括以下內(nèi)容: 轉(zhuǎn)型期女性犯罪新特征。主要有犯罪數(shù)量相對較少,犯罪數(shù)量成上升趨勢,犯罪類型的變化,犯罪的社會危害性較小但影響逐步加深,犯罪群體的變化,犯罪低齡化,犯罪的主觀方面,多依附于男性形成共同犯罪。 轉(zhuǎn)型期女性犯罪因素分析方法。首先探討分類女性犯罪心理因素的特殊性,然后探討其共性。在探討共同性時分兩步走,第一步先分析女性犯罪特殊的內(nèi)部心理因素,第二步分析轉(zhuǎn)型期的環(huán)境因素。分類女性犯罪的心理因素。主要包括農(nóng)村婦女犯罪、白領(lǐng)女性犯罪和青少年女性犯罪三類分別探討。 女性犯罪特殊因素。主要有生理因素和心理因素。生理因素主要是月經(jīng)期、哺乳期、絕經(jīng)期情緒波動,心理因素包括心理成熟年齡較低,個性隱忍被動,情感豐富、思維形象化,以家庭和情感為重,享樂主義、愛攀比、嫉妒心強,依附性強、缺乏主見。 女性犯罪外部因素。主要包括市場經(jīng)濟的負作用,女性自我意識覺醒,社會控制系統(tǒng)存在缺陷、控制功能弱化,不良文化的影響,家庭暴力抬頭、父母教育存在偏差,學(xué)校教育存在問題,普法宣傳不到位、法律意識單薄、法律援助不夠。 轉(zhuǎn)型期女性犯罪預(yù)防。先對農(nóng)村女性、白領(lǐng)女性、青少年女性犯罪分開來有針對性地探討預(yù)防措施,再進行共性預(yù)防措施探討。共性預(yù)防措施包括注意化解家庭情感糾紛,注意犯罪苗頭、預(yù)防犯意向犯罪行為轉(zhuǎn)化,遏制家暴、為女性提供法律和情感援助,完善維護婦女權(quán)益的相關(guān)法律法規(guī),增加婦女就業(yè)機會、緩解女性就業(yè)壓力,加強思想道德教育、樹立女性正確的價值觀。
