【摘要】：隨著我國全面試行社區(qū)矯正工作,檢察機(jī)關(guān)作為社區(qū)矯正工作的監(jiān)督者參與其中,并且積極配合公安、法院、司法等相關(guān)司法機(jī)關(guān)的工作。然而,在司法實(shí)踐中,我國社區(qū)矯正的檢察監(jiān)督工作尚處于起步階段,檢察監(jiān)督理論及實(shí)踐的相關(guān)問題研究得還不夠深入透徹,對于社區(qū)矯正的檢察監(jiān)督制度還有待于進(jìn)一步完善。為了防止在司法實(shí)踐中出現(xiàn)檢察監(jiān)督難的困境,本文以社區(qū)矯正制度的起源、目前社區(qū)矯正檢察監(jiān)督的現(xiàn)狀為出發(fā)點(diǎn),詳細(xì)分析了完善社區(qū)矯正檢察監(jiān)督制度的必要性,并著力探討完善我國社區(qū)矯正檢察監(jiān)督制度的構(gòu)想。以希望本文的論證能夠得到理論支撐,更希盼能為司法實(shí)踐所運(yùn)用,從而進(jìn)一步推動(dòng)我國社區(qū)矯正檢察監(jiān)督工作的發(fā)展。 本文共分為三個(gè)部分： 第一部分主要閱述社區(qū)矯正制度與法律監(jiān)督。首先,在介紹了社區(qū)矯正的含義、內(nèi)容和功能；其次從思想、制度起源兩個(gè)方面著手,詳述了社區(qū)矯正制度在國外和我國的發(fā)展；第三,著重論述社區(qū)矯正對檢察監(jiān)督的需求,舉例介紹了中外社區(qū)矯正法律監(jiān)督機(jī)關(guān)后,論述了社區(qū)矯正檢察監(jiān)督的必要性；第四,從法律監(jiān)督的概念、我國法律監(jiān)督機(jī)關(guān)入手,論述了法律監(jiān)督與檢察監(jiān)督的關(guān)系。 第二部分主要閱述目前我國社區(qū)矯正檢察監(jiān)督存在的問題。首先是明確了我國社區(qū)矯正法律監(jiān)督的含義及主體；其次,按多種標(biāo)準(zhǔn)將我國社區(qū)矯正法律監(jiān)督內(nèi)容進(jìn)行分類；第三,從外部因素、內(nèi)部因素兩個(gè)層面著手,詳細(xì)閱述了司法實(shí)踐中我國社區(qū)矯正檢察監(jiān)督所面臨的困境。 第三部分主要閱述完善社區(qū)矯正檢察監(jiān)督的制度安排。首先,從三個(gè)方面閱述完善社區(qū)矯正檢察監(jiān)督的必要性；其次,詳細(xì)闡述完善社區(qū)矯正檢察監(jiān)督的途徑。
[Abstract]:With the comprehensive trial of community correction in our country, the procuratorial organ, as the supervisor of the community correction, participates in it, and actively cooperates with the work of the public security, court, judicial and other relevant judicial organs. However, in judicial practice, the procuratorial supervision of community correction in our country is still in its infancy, and the research on the theory and practice of procuratorial supervision is not thorough enough. The procuratorial supervision system of community correction needs to be further improved. In order to prevent the difficulty of procuratorial supervision in judicial practice, this paper analyzes in detail the necessity of perfecting the procuratorial supervision system of community correction, taking the origin of community correction system and the present situation of community correction procuratorial supervision as the starting point. And focus on improving the procuratorial supervision system of community correction. It is hoped that the argument in this paper can be supported by theory and be applied in judicial practice so as to further promote the development of procuratorial supervision of community correction in our country. This article is divided into three parts: the first part mainly read the community correction system and legal supervision. Firstly, it introduces the meaning, content and function of community correction; secondly, it elaborates the development of community correction system in foreign countries and China from two aspects of thought and system origin; third, it emphasizes on the demand of community correction for procuratorial supervision. After introducing the legal supervision organs of community correction at home and abroad, this paper discusses the necessity of the procuratorial supervision of community correction. Fourthly, starting with the concept of legal supervision, the relationship between legal supervision and procuratorial supervision is discussed. The second part mainly reviews the problems existing in the procuratorial supervision of community correction in our country. Firstly, it clarifies the meaning and subject of legal supervision of community correction in our country; secondly, classifies the content of legal supervision of community correction in our country according to various standards; thirdly, it starts from two aspects of external factors and internal factors. In this paper, the dilemma of procuratorial supervision of community correction in our country is described in detail. The third part mainly read and perfect the system arrangement of community correction procuratorial supervision. Firstly, the necessity of improving the procuratorial supervision of community correction is discussed from three aspects; secondly, the ways to perfect the procuratorial supervision of community correction are elaborated in detail.
