【摘要】：隨著網(wǎng)絡(luò)技術(shù)的發(fā)展和計算機(jī)網(wǎng)路的普及應(yīng)用,大學(xué)生網(wǎng)絡(luò)犯罪的案件呈上升趨勢,日益成為干擾校園秩序、社會安定和社會主義市場經(jīng)濟(jì)秩序有序運(yùn)行的嚴(yán)重問題,越來越得到高校和社會的普遍關(guān)注。本文首先對當(dāng)代大學(xué)生網(wǎng)絡(luò)犯罪的現(xiàn)狀及特點(diǎn)進(jìn)行了分析,然后對大學(xué)生網(wǎng)絡(luò)犯罪的原因進(jìn)行了調(diào)研,最后針對大學(xué)生網(wǎng)絡(luò)犯罪的原因?qū)Ψ婪洞髮W(xué)生網(wǎng)絡(luò)犯罪的對策進(jìn)行了探討,以預(yù)防為主,從技術(shù)、管理、教育、法律等多方面對大學(xué)生進(jìn)行教育,培育良好網(wǎng)絡(luò)道德,以實(shí)現(xiàn)對大學(xué)生網(wǎng)絡(luò)犯罪的有效預(yù)防,促其健康成長和成才。本文將從四個部分對當(dāng)代大學(xué)生網(wǎng)絡(luò)犯罪及其防控對策進(jìn)行研究。 第一部分：大學(xué)生網(wǎng)絡(luò)犯罪的現(xiàn)狀及特點(diǎn)。筆者通過較為廣泛地調(diào)查研究對大學(xué)生網(wǎng)絡(luò)犯罪的現(xiàn)狀、表現(xiàn)形式及其特點(diǎn)進(jìn)行了分析。 第二部分：大學(xué)生網(wǎng)絡(luò)犯罪的概念、類型及定義。筆者對大學(xué)生網(wǎng)絡(luò)犯罪的概念進(jìn)行了分析進(jìn)而從刑法學(xué)和犯罪學(xué)兩方面對大學(xué)生網(wǎng)絡(luò)犯罪進(jìn)行了分類,從而對大學(xué)生網(wǎng)絡(luò)犯罪給予認(rèn)定。 第三部分：大學(xué)生網(wǎng)絡(luò)犯罪的成因。筆者通過調(diào)研,從主觀原因、客觀原因和社會原因等幾方面對大學(xué)生網(wǎng)絡(luò)犯罪的成因進(jìn)行了分析。 第四部分：防范大學(xué)生網(wǎng)絡(luò)犯罪的對策。筆者從網(wǎng)絡(luò)防范技術(shù)、倫理道德教育、法制教育、法律規(guī)范等幾個方面對防范大學(xué)生網(wǎng)絡(luò)犯罪的對策進(jìn)行了探討。
[Abstract]:With the development of network technology and the popularization and application of computer network, the cases of college students' network crime are on the rise, which is becoming a serious problem that interferes with the campus order, social stability and the orderly operation of the socialist market economy order. Getting more and more attention from colleges and society. This paper first analyzes the current situation and characteristics of college students' cybercrime, and then investigates the causes of college students' cybercrime. Finally, aiming at the reasons of college students' network crime, this paper probes into the countermeasures of preventing college students' network crime, focusing on prevention, educating college students from the aspects of technology, management, education, law and so on, and cultivating good network morality. In order to achieve the effective prevention of college students' network crime, promote their healthy growth and talent. This article will carry on the research from four parts to the contemporary university student network crime and its prevention and control countermeasure. The first part: the present situation and characteristics of college students' network crime. The author analyzes the present situation, forms and characteristics of college students' cybercrime through extensive investigation and research. The second part: the concept, type and definition of college students'cybercrime. The author analyzes the concept of college students' network crime and classifies it from two aspects of criminal law and criminology, so as to identify the university students' network crime. The third part: the causes of network crime of college students. Through investigation, the author analyzes the causes of college students' network crime from subjective reasons, objective reasons and social reasons. The fourth part: the countermeasures to prevent college students from cyber crime. The author probes into the countermeasures of preventing college students' network crime from several aspects, such as network prevention technology, ethics education, legal norm and so on.
