【摘要】：當前,我國的社區(qū)矯正制度處于工作試點與理論研討同步摸索與推進的態(tài)勢,但種種舉措均局限在修補的層面,喧囂而無序,尤其對未成年犯而言,我國的未成年犯社區(qū)矯正還處在摸索階段,在矯正主體、矯正項目、矯正方法上還存在重大缺陷。應當融入契約理念,"以人為本",使未成年犯社區(qū)矯正之內(nèi)涵與功能更為豐富。同時,鑒于未成年犯的身心特點及權(quán)益保障,應當對"教育為主、懲罰為輔"下的制度進行改進和創(chuàng)新,例如建立監(jiān)護人或"合格成年人"參與制度、志愿者聘請制度、異地矯正制度和權(quán)利救濟制度等。
[Abstract]:At present, the community correction system in our country is in the situation of simultaneous exploration and promotion of pilot work and theoretical research, but all kinds of measures are confined to the level of mending, noisy and disorderly, especially for juvenile delinquents. The community correction of juvenile delinquents in our country is still in the stage of groping, and there are still major defects in the subject, items and methods of correction. The concept of contract should be integrated and "people-oriented", so as to enrich the connotation and function of community correction for juvenile delinquents. At the same time, in view of the physical and mental characteristics of juvenile offenders and the protection of their rights and interests, the system under "education first, supplemented by punishment" should be improved and innovated, such as the establishment of a system for the participation of guardians or "qualified adults" and a system for the recruitment of volunteers, The system of correction in different places and the relief system of right, etc.
