【摘要】：行賄犯罪是國際社會最為關(guān)注的高發(fā)性犯罪,也是世界各國政府無一例外勵精圖治著重打擊的嚴重刑事犯罪活動。行賄犯罪不但助長了當今社會腐敗現(xiàn)象的蔓延,嚴重損害國家機關(guān)及工作人員的公眾形象和社會威信,而且嚴重擾亂了市場交易的正常秩序,破壞了市場經(jīng)濟公平競爭的要求,妨礙經(jīng)濟健康發(fā)展,危害黨風(fēng)廉政建設(shè)和社會風(fēng)氣,具有嚴重的社會危害性。 本文共分四部分。第一部分,對當前行賄手段的新形式進行了歸納對其特點進行了分析；第二部分,對行賄手段新特點地成因進行分析；第三部分,探討當前司法適用的誤區(qū)及法律分析；第四部分是筆者著力對行賄犯罪立法完善的思考。
[Abstract]:Bribery crime is the most concerned crime in the international community, and it is also a serious criminal activity that the governments of the world try their best to crack down on. The crime of bribery not only contributes to the spread of corruption in today's society, seriously harms the public image and social prestige of state organs and staff, but also seriously disturbs the normal order of market transactions and undermines the requirements of fair competition in the market economy. Hinders the healthy development of the economy, endangers the construction of party style and clean government and social ethos, and has serious social harmfulness. This paper is divided into four parts. The first part analyzes the new forms of bribery methods; the second part analyzes the causes of the new characteristics of bribery means; the third part discusses the misunderstanding and legal analysis of the current judicial application; The fourth part is the author tries to perfect the legislation of bribery crime.
