【摘要】： 隨著被害人學(xué)的產(chǎn)生與發(fā)展,犯罪被害人問題逐漸引起社會各界的普遍重視,人們開始從被害人角度出發(fā),來重新審視犯罪問題。強奸犯罪作為性犯罪中數(shù)量最多、性質(zhì)最嚴重的犯罪之一,其社會危害性是巨大的。強奸罪被害人在強奸行為發(fā)生及進行過程中,并不是完全被動的,在某些情況下,是由于強奸罪被害人某些行為特征而引發(fā)被害的。因此,對強奸罪被害人進行研究,有利于減少強奸犯罪的發(fā)生,具有重要的理論意義和實踐價值。本文在對于強奸罪被害人的概念、特征、分類進行分析的基礎(chǔ)之上,探究強奸罪被害人的被害原因,并針對其致害原因制定相關(guān)的預(yù)防措施,同時,從法律以及實踐層面加強對強奸罪被害人的保護,以期減少與遏制強奸被害的發(fā)生,從而達到預(yù)防、治理強奸犯罪的目的。
[Abstract]:With the emergence and development of victimology, the problem of victims of crime gradually attracted the attention of all walks of life. People began to re-examine the problem of crime from the perspective of victims. Rape is one of the most serious crimes in sexual crimes, and its social harmfulness is enormous. The victim of rape is not completely passive in the process of rape. In some cases, the victim of rape is killed because of some characteristics of his behavior. Therefore, the research on the victim of rape crime is helpful to reduce the occurrence of rape crime and has important theoretical significance and practical value. Based on the analysis of the concept, characteristics and classification of rape victims, this paper explores the causes of rape victims' victimization, and formulates relevant preventive measures against the causes of rape crime victims, at the same time, From the aspect of law and practice, we should strengthen the protection of the victims of rape in order to reduce and restrain the occurrence of rape victims, so as to achieve the purpose of preventing and controlling rape crimes.
