【摘要】： 中國在經(jīng)歷從計(jì)劃經(jīng)濟(jì)體制向市場經(jīng)濟(jì)體制轉(zhuǎn)換的過程中,社會(huì)層級結(jié)構(gòu)迅速嬗變。在新的社會(huì)層級結(jié)構(gòu)中,一個(gè)特殊社會(huì)群體——“社會(huì)弱勢群體”開始顯現(xiàn)出來。當(dāng)前,據(jù)不完全統(tǒng)計(jì),中國的弱勢群體已接近2億人口,且其數(shù)量還呈不斷增長的趨勢。 當(dāng)個(gè)體處于弱勢境遇時(shí),社會(huì)地位的變化使他們在政治地位、生活質(zhì)量、競爭機(jī)會(huì)等各方面處于不平等的劣勢,從而引發(fā)各種不平衡的心態(tài),最終可能造成各種越軌和犯罪行為的發(fā)生。弱勢群體犯罪問題的凸顯,是社會(huì)轉(zhuǎn)型階段各種矛盾的集中反映。其已經(jīng)成為了影響社會(huì)穩(wěn)定和發(fā)展的重要阻礙,應(yīng)當(dāng)引起社會(huì)各方面、各階層的足夠重視。 本文在對弱勢群體犯罪特征和犯罪原因進(jìn)行詳盡分析的基礎(chǔ)上,提出了對弱勢群體進(jìn)行保護(hù)是解決弱勢群體犯罪問題根本途徑的新觀點(diǎn),并具體從對弱勢群體進(jìn)行法律保護(hù)、社會(huì)扶助、文化教育及心理預(yù)防等方面,闡述了對弱勢群體犯罪問題的防控對策。文章主要通過三大部分內(nèi)容進(jìn)行論述: 第一部分:通過對弱勢群體涵義、分類及其犯罪類型、特征的分析,揭示弱勢群體犯罪問題的起因及其嚴(yán)峻現(xiàn)實(shí)。 第二部分:通過對中國現(xiàn)階段弱勢群體犯罪原因的分析,揭示當(dāng)前的社會(huì)因素對造成弱勢群體犯罪的重大影響,并指出當(dāng)社會(huì)外部原因結(jié)合弱勢群體自身不足時(shí)就會(huì)產(chǎn)生犯罪。 第三部分:以弱勢群體犯罪成因?yàn)榛A(chǔ),提出唯有對弱勢群體進(jìn)行有效保障才能消除弱勢群體犯罪問題。具體措施包括:通過對弱勢群體進(jìn)行法律保護(hù)、社會(huì)扶助、文化教育及心理救助等方面的多方位保障,從而有效地對弱勢群體犯罪進(jìn)行多方位防控。 筆者認(rèn)為,弱勢群體犯罪問題在中國日趨嚴(yán)重,有其深刻的歷史和社會(huì)原因。但在消除弱勢群體犯罪的斗爭中,只要在社會(huì)公正理念的指引下,從立法源頭和制度層面對弱勢群體加以保障,在社會(huì)層面消除弱勢群體的不利地位,就能長久、有效地控制弱勢群體犯罪問題。
[Abstract]:In the process of transition from planned economy system to market economy system, the social hierarchy structure changes rapidly in China. In the new social hierarchy, a special social group-"social vulnerable group" began to emerge. At present, according to incomplete statistics, China's vulnerable population is close to 200 million, and its number is still increasing. When individuals are in a weak position, changes in social status place them at an unequal disadvantage in terms of political status, quality of life, competitive opportunities, etc., thus leading to a variety of unbalanced attitudes. Eventually, all sorts of transgressions and criminal acts may occur. The crime problem of the vulnerable group is the concentrated reflection of all kinds of contradictions in the stage of social transformation. It has become an important hindrance to social stability and development. Based on the detailed analysis of the crime characteristics and causes of the vulnerable groups, this paper puts forward a new viewpoint that the protection of the vulnerable groups is the fundamental way to solve the crime problems of the vulnerable groups, and specifically from the legal protection of the vulnerable groups. In the aspects of social support, cultural education and psychological prevention, the countermeasures of crime prevention and control for vulnerable groups are expounded. The article is mainly discussed through three parts: the first part: through the analysis of the meaning, classification, crime types and characteristics of vulnerable groups, To reveal the causes of the crime of vulnerable groups and its grim reality. The second part: through the analysis of the causes of the crime of the vulnerable groups in China at the present stage, it reveals the great influence of the current social factors on the crime of the vulnerable groups, and points out that the crime will occur when the external social reasons are combined with the weakness of the vulnerable groups themselves. The third part: based on the causes of the crime of the vulnerable groups, the author puts forward that only the effective protection of the vulnerable groups can eliminate the crime problems of the vulnerable groups. The specific measures include legal protection, social assistance, cultural education and psychological assistance, so as to effectively prevent and control crimes committed by vulnerable groups. The author believes that the crime problem of vulnerable groups is becoming more and more serious in China, which has profound historical and social reasons. However, in the struggle to eliminate the crime of the vulnerable groups, as long as under the guidance of the concept of social justice, the vulnerable groups are protected from the legislative source and the system level, and the disadvantaged position of the vulnerable groups can be eliminated in the social level, it will last a long time. Effectively control the crime of vulnerable groups.
