【摘要】：本文以測謊技術的基本理論為切入點，通過梳理、分析、思考測謊技術面世以來的相關理論與實踐發(fā)展，來論證測謊技術在刑事偵查中的價值及所須的質(zhì)量控制。 文章共分為四個部分：導言；第一章：測謊的基本理論；第二章：測謊在刑事偵查中的價值；第三章：刑事偵查中測謊結論的質(zhì)量控制。 文章導言部分，闡述了該課題研究的理論意義和現(xiàn)實意義，通過梳理國內(nèi)外測謊相關理論和應用實踐論證研究現(xiàn)狀并預測了未來測謊的發(fā)展趨勢。文章第一部分，旨在敘述測謊的基本理論，以此作為本文研究內(nèi)容主干的理論和實踐背景。該章內(nèi)容涵蓋了測謊的概念，闡述了測謊的原理，梳理了測謊的歷史發(fā)展，，通過對其概念、原理的闡釋，輔佐上測謊實踐的發(fā)展，充分說明了測謊技術在偵查破案中的必不可少性即測謊價值屬性；也反映出了測謊技術在理論和實踐方面所存在的薄弱之處，尚需在自身技術和測試程序上進行改進和程序規(guī)制，即質(zhì)量控制。 第二部分重點論述了測謊在刑事偵查中價值；一方面，從價值意義、測謊程序體現(xiàn)當事人的意思自治性論述測謊具有法理的正當性；另一方面，詳述了各種測試方法在具體案件中的應用，并就如何發(fā)揮完善其實踐價值進行了積極探索； 第三部分主要論述了刑事偵查中測謊結論的質(zhì)量控制。首先，論文從證據(jù)的客觀性、關聯(lián)性、合法性三個角度分析了測謊結論具有的證據(jù)屬性；這也是測謊技術得以長足發(fā)展并被廣泛應用到刑事司法領域內(nèi)的關鍵因素之一；其次，客觀說明了測謊所具有的風險性；論文從被測試人員因素、測謊人員因素、測謊技術本身因素以及測謊儀器等方面剖析了存在風險的原因；最后，根據(jù)以上影響測謊結論客觀性的因素，分別從法律規(guī)制、測謊技術本身、被測試人和測試人員等層面進行了相應質(zhì)量控制探索，以期使測謊在理論和實踐中得到長足進步和廣泛應用，在刑事偵查破案中發(fā)揮更大的作用。
[Abstract]:This paper takes the basic theory of lie detection as the breakthrough point, through combing, analyzing, thinking about the relevant theory and practice development of lie detection technology since its publication, to demonstrate the value and quality control of lie detection technology in criminal investigation. The article is divided into four parts: introduction; the first chapter: the basic theory of lie detection; the second chapter: the value of lie detection in criminal investigation; the third chapter: the quality control of the conclusion of lie detection in criminal investigation. In the introduction part, this paper expounds the theoretical and practical significance of the research on the subject, and forecasts the development trend of lie detection in the future by combing the research status quo of the relevant theory and application practice of lie detection at home and abroad. The first part is to describe the basic theory of lie detection as the theoretical and practical background of this paper. This chapter covers the concept of lie detection, expounds the principle of lie detection, combs the historical development of lie detection, through the explanation of its concept and principle, assists the development of lie detection practice. It fully explains the necessity of lie detection technology in the investigation and detection of cases, that is, the value attribute of lie detection, and also reflects the weakness of lie detection technology in theory and practice. It also needs to improve and regulate its own technology and test procedure, that is, quality control. The second part focuses on the value of lie detection in criminal investigation; on the one hand, from the value significance, lie detection procedures reflect the autonomy of the parties concerned; on the other hand, This paper expounds the application of various test methods in specific cases and probes into how to improve its practical value. The third part mainly discusses the quality control of the conclusion of lie detection in criminal investigation. First of all, the paper analyzes the evidence attribute of lie detection conclusion from three angles of objectivity, relevance and legitimacy of evidence, which is one of the key factors that lie detection technology has been developed and widely used in the field of criminal justice. The paper analyzes the reasons of the risk from the factors of the person being tested, the technology of polygraph itself and the lie detector, etc. According to the above factors affecting the objectivity of lie detection, the corresponding quality control is explored from the aspects of legal regulation, lie detection technology itself, testees and testers, etc. In order to make lie detection in theory and practice to get considerable progress and wide application, in criminal investigation and solve cases play a greater role.
