【摘要】： 社區(qū)矯正作為一種移植并大量借鑒于國外的刑罰制度,在我國還是一種新的嘗試。要完全地與我國現(xiàn)有的刑罰制度相融合,需要不斷的實(shí)踐和探索,有關(guān)部門和學(xué)者們對(duì)于這一問題進(jìn)行了大量的研究,并取得了豐碩的成果。但是關(guān)于社區(qū)矯正性質(zhì)缺乏專門的論證,因而無法揭示社區(qū)矯正性質(zhì)對(duì)制度設(shè)置影響。根據(jù)國外社區(qū)矯正發(fā)展的歷史以及現(xiàn)狀,可以得知社區(qū)矯正主要表現(xiàn)為刑罰種類和刑罰執(zhí)行方法兩種形式。在我國,關(guān)于社區(qū)矯正的性質(zhì)的確定,存在分歧,主要還包括了“保安處分說”、“社會(huì)工作說”、“替代措施說”等觀點(diǎn)。這些觀點(diǎn)在認(rèn)定社區(qū)矯正性質(zhì)上都缺乏合理性。而爭議的焦點(diǎn)主要集中在是刑種還是刑罰執(zhí)行方法上。在我國,將社區(qū)矯正作為刑罰執(zhí)行方法是符合我國的實(shí)際需要的,在理論上也是成立的。作為刑罰執(zhí)行方法的社區(qū)矯正必然與原有刑罰制度發(fā)生聯(lián)系。一般而言,社區(qū)矯正以刑罰的判處為前提,這實(shí)際上就界定了社區(qū)矯正的范圍。不能夠任意地?cái)U(kuò)展社區(qū)矯正的適用范圍,以免濫用。而我國現(xiàn)行制度中將暫予監(jiān)外執(zhí)行納入社區(qū)矯正的范圍也是不合理的。社區(qū)矯正作為刑罰的執(zhí)行方法還具有改善和實(shí)現(xiàn)刑罰功能的意義。在刑罰種類保持相對(duì)穩(wěn)定的情形下,改革刑罰執(zhí)行方法對(duì)于迎合刑罰理念的轉(zhuǎn)變具有重要意義。在確定了社區(qū)矯正的性質(zhì)以后,應(yīng)當(dāng)在制度設(shè)置上與性質(zhì)相符合。我國現(xiàn)行的很多社區(qū)矯正制度中,存在著與社區(qū)矯正性質(zhì)不符合的內(nèi)容。應(yīng)當(dāng)設(shè)立統(tǒng)一的執(zhí)行機(jī)關(guān),不應(yīng)將原本統(tǒng)一的刑罰執(zhí)行活動(dòng)人為地割裂開來由兩個(gè)或多個(gè)主體實(shí)施。而社區(qū)矯正作為執(zhí)行方法,不能夠由法院決定實(shí)施,而應(yīng)當(dāng)由具體執(zhí)行機(jī)關(guān)在對(duì)犯罪人進(jìn)行充分考察的基礎(chǔ)上決定實(shí)施,需要建立合理的程序?qū)ι鐓^(qū)矯正的決定和實(shí)施進(jìn)行規(guī)范。
[Abstract]:Community correction as a transplant and a large number of foreign penalty system, in our country is a new attempt. In order to integrate completely with the existing penalty system of our country, it is necessary to practice and explore continuously. The relevant departments and scholars have carried out a great deal of research on this issue, and have achieved fruitful results. But there is no special argumentation about the nature of community correction, so it can not reveal the influence of community correction on system setting. According to the history and present situation of the development of community correction in foreign countries, we can know that the main forms of community correction are penalty types and penalty execution methods. In our country, there are differences about the nature of community correction, including "security measures theory", "social work theory", "alternative measures theory" and so on. These viewpoints are lack of rationality in determining the nature of community correction. The focus of the dispute is mainly on the type of punishment or the execution of punishment. In our country, community correction as a penalty execution method is in line with the actual needs of our country, in theory is also true. Community correction, as a penalty execution method, must be connected with the original penalty system. Generally speaking, community correction is based on punishment, which actually defines the scope of community correction. The scope of application of community correction cannot be expanded arbitrarily to avoid abuse. It is also unreasonable to include the temporary execution outside the prison into the community correction in the current system of our country. Community correction, as the execution method of penalty, also has the significance of improving and realizing the penalty function. Under the condition that the type of penalty remains relatively stable, it is of great significance to reform the method of penalty execution in order to meet the change of penalty concept. After determining the nature of community correction, the system should be in accordance with the nature. In many current community correction systems in China, there are some contents which are inconsistent with the nature of community correction. A unified executive organ should be set up, and the original unified penalty enforcement activities should not be artificially separated by two or more subjects. As an enforcement method, community correction cannot be decided by the court, but should be decided by the specific enforcement organ on the basis of the full investigation of the offender. It is necessary to establish reasonable procedures to regulate the decision and practice of community correction.
