【摘要】：假釋是行刑社會(huì)化的一項(xiàng)重要制度,在世界各國(guó)的刑罰執(zhí)行的實(shí)踐中有著很高的適用率。2003年7月,我國(guó)首次明確將假釋的犯罪分子列為社區(qū)矯正的對(duì)象之一。在實(shí)行試點(diǎn)后,由于各種原因,對(duì)假釋罪犯的社區(qū)矯正也不盡理想,存在各種問題。因此,以社區(qū)矯正為視角重新審視我國(guó)的假釋制度,對(duì)于促進(jìn)假釋制度的完善發(fā)展,具有重大的意義。 筆者以假釋和社區(qū)矯正的基本理論為出發(fā)點(diǎn),介紹了中外假釋制度的歷史演變和發(fā)展現(xiàn)狀,通過對(duì)中外假釋罪犯的社區(qū)矯正適用的比較,指出我國(guó)假釋社區(qū)矯正理論研究與實(shí)踐和發(fā)達(dá)國(guó)家相比存在的各種問題,進(jìn)而對(duì)改革和發(fā)展我國(guó)假釋制度提出了一些有針對(duì)性的設(shè)想,以期完善我國(guó)假釋罪犯的社區(qū)矯正制度。 本文的創(chuàng)新點(diǎn)有：1、目前國(guó)內(nèi)以社區(qū)矯正為視角探討假釋制度完善問題研究不多。以社區(qū)矯正為視角研究假釋制度,不僅僅針對(duì)假釋犯的監(jiān)督考察,還包括對(duì)假釋犯的矯正、教育和改造。2、本文以假釋罪犯的社區(qū)矯正應(yīng)用問題為切入點(diǎn),具體分析在社區(qū)矯正過程中應(yīng)完善的各項(xiàng)制度和措施,尤其是對(duì)假釋犯在社區(qū)矯正過程中的人格調(diào)查和危險(xiǎn)預(yù)測(cè)制度、改造和教育假釋罪犯的各種舉措等方面進(jìn)行詳細(xì)地論述,對(duì)假釋罪犯社區(qū)矯正制度的完善提出了自己的見解。
[Abstract]:Parole is an important system of socialization of execution and has a high rate of application in the practice of penalty execution in various countries in the world. In July 2003, criminals on parole were explicitly listed as one of the objects of community correction in our country for the first time. After the trial, community correction of parolee criminals is not ideal because of various reasons. Therefore, it is of great significance to re-examine the parole system in China from the perspective of community correction. Based on the basic theories of parole and community correction, the author introduces the historical evolution and development of parole system in China and abroad. This paper points out the problems existing in the theoretical research of parole community correction in China compared with the practice in developed countries, and then puts forward some targeted ideas for the reform and development of parole system in China, with a view to perfecting the community correction system of parole criminals in China. The innovation of this paper is: 1. At present, there are few researches on the perfection of parole system in China from the perspective of community correction. To study parole system from the perspective of community correction, not only the supervision and investigation of parole offenders, but also the correction, education and reform of parole offenders. This paper takes the application of community correction of parolee criminals as the starting point. The system and measures that should be perfected in the process of community correction are analyzed in detail, especially the personality investigation and risk prediction system of parole offenders in the process of community correction, and various measures to reform and educate parolee criminals, etc. The author puts forward his own opinion on the perfection of community correction system of parolee criminals.
