【摘要】： 隨著人類社會經濟與文化的發(fā)展,刑罰的執(zhí)行也越來越注重人格的尊重和行刑成本的降低。伴隨這種趨勢,社區(qū)矯正制度逐漸興起,并在過去的幾十年中取得了長足發(fā)展。社區(qū)矯正是與監(jiān)禁矯正相對的行刑方式,是指將符合條件的罪犯置于社區(qū)內,由專門的國家機關在相關社會團體和民間組織以及社會志愿者的協(xié)助下,在判決、裁定或決定確定的期限內,矯正其犯罪心理和行為惡習,并促進其順利回歸社會的非監(jiān)禁刑罰執(zhí)行活動。我國通過近5年來社區(qū)矯正工作試點,社區(qū)矯正工作已經取得了明顯成效。我國的社區(qū)矯正制度還處在剛剛起步的階段,在理論和實踐中還有很多值得探索的問題。社區(qū)矯正具有重要的社會意義,我們必須對社區(qū)矯正的實現(xiàn)原則及完善途徑進行深入研究。本文通過對我國社區(qū)矯正制度現(xiàn)狀的研究,并與西方發(fā)達國家及香港地區(qū)社區(qū)矯正制度相對比,從而探索我國的社區(qū)矯正制度完善之路。
[Abstract]:With the development of human economy and culture, the execution of penalty pays more and more attention to respect of personality and lower execution cost. Along with this trend, the community correction system gradually rises, and has made great progress in the past few decades. Community correction is a form of execution opposite to that of imprisonment correction. It refers to placing eligible criminals in the community, with the assistance of relevant social organizations and non-governmental organizations and social volunteers, by specialized state organs. Non-custodial penal enforcement activities that correct their criminal psychology and behaviour and facilitate their smooth return to society within a fixed period of time. In the past five years, our country has made remarkable progress in community correction. China's community correction system is still in its infancy, and there are still many problems worth exploring in theory and practice. Community correction has important social significance, we must study the realization principle and perfect way of community correction in depth. By studying the present situation of the community correction system in China and comparing it with the community correction system in the developed countries and Hong Kong, this paper explores the way to perfect the community correction system in our country.
