【摘要】： 市場經(jīng)濟體制的建立和經(jīng)濟一體化程度的加深,促進了人、財、物的大流動。在帶來社會生產(chǎn)力大發(fā)展的同時,跨區(qū)域犯罪日益嚴重,犯罪的動態(tài)化日益突出。為應對犯罪的新形勢、新特點,偵查實踐中,公安機關之間進一步加強了偵查協(xié)作,,偵查協(xié)作活動日益頻繁,各地公安機關按照依法規(guī)范、資源共享、優(yōu)勢互補、互惠互利、高效協(xié)同等原則,建立了許多雙邊或多邊的刑事偵查協(xié)作機制,犯罪聯(lián)系密切的區(qū)域建立了長效的偵查協(xié)作區(qū)。在聯(lián)合偵查、犯罪情報信息交流、案件線索協(xié)查協(xié)辦、犯罪嫌疑人協(xié)助羈押、犯罪預防、重大突發(fā)事件應急處置等諸多方面展開廣泛而深入的協(xié)作。偵查協(xié)作的豐富實踐推動偵查協(xié)作理論的進一步完善。 區(qū)域性偵查協(xié)作制度的研究,是偵查學理論的重要內(nèi)容之一,具有綜合性、實踐性較強的特點。本文緊密聯(lián)系公安工作實際,采用系統(tǒng)論、歷史的、比較的、社會學等研究方法,從完善我國公安機關區(qū)域性偵查協(xié)作機制的宗旨出發(fā),在研究偵查協(xié)作基本問題的基礎上,提出構建我國公安機關區(qū)域性偵查協(xié)作制度的基本構想。以期豐富和發(fā)展我國偵查協(xié)作理論,推動公安機關偵查協(xié)作實踐向縱深發(fā)展。全文共由三部分組成。 第一部分:闡明了偵查協(xié)作的基本問題。有四項內(nèi)容構成。首先,對現(xiàn)有的偵查協(xié)作概念進行評析,界定了偵查協(xié)作的概念,并分析了理由。闡明了偵查協(xié)作的主體特征是具有偵查權的偵查機關或偵查部門;偵查協(xié)作的目的為打擊犯罪,維護社會秩序;偵查協(xié)作的主體之間關系處于相對平等的地位,其權利和義務具有一致性;偵查協(xié)作是具體的偵查措施,具有刑事訴訟的性質(zhì)。在偵查協(xié)作概念的基礎上,提出了區(qū)域性偵查協(xié)作的概念。其次,按照不同標準劃分了偵查協(xié)作的類型,并分別進行分析。根據(jù)偵查協(xié)作的頻率和規(guī)范程度分為:臨時性協(xié)作和協(xié)作組織;根據(jù)偵查協(xié)作的內(nèi)容分為:聯(lián)合偵查、偵查情報信息交流和協(xié)作查緝;根據(jù)偵查協(xié)作主體的職能分為:刑偵部門與特警、交警、巡警的協(xié)作、公安機關各職能的偵查部門之間的協(xié)作、偵查的國際合作。再次,闡明了偵查協(xié)作的功能。第一,可以有效地提高公安機關打擊犯罪的整體合力。第二,可以節(jié)約偵查成本,有效整合偵查資源,提高偵查的效益。第三,可以密切偵查部門之間的關系,有效解決警力不足的問題。第四,可以更好地維護社會穩(wěn)定,保障人權。最后,論證了偵查協(xié)作的基礎。普遍聯(lián)系的觀點和系統(tǒng)論是偵查協(xié)作的哲學基礎;法學理論和法律規(guī)定是偵查協(xié)作的法治基礎;跨區(qū)域的流動犯罪急劇上升和當前犯罪的特點、偵查管理體制的現(xiàn)狀是偵查協(xié)作的現(xiàn)實基礎。 第二部分:考察了我國區(qū)域性偵查協(xié)作的歷史和現(xiàn)狀,由三項內(nèi)容構成。首先考察了我國區(qū)域性偵查協(xié)作的歷史。對區(qū)域性協(xié)作的歷史進行全面客觀地考察和理解,才能更好地理解其現(xiàn)實狀況,對其未來發(fā)展趨向作出理性的預測,并提出科學的建議。按照歷史的發(fā)展線索,劃分為我國古代、近代、新中國成立后的偵查協(xié)作三個階段,系統(tǒng)進行研究。其次,論述了我國區(qū)域性偵查協(xié)作的現(xiàn)狀。從偵查協(xié)作區(qū),偵查協(xié)查、追緝的現(xiàn)狀幾個方面展開論述其運行情況。從現(xiàn)行法律規(guī)定的內(nèi)容方面論述其法律規(guī)制情況。最后,指出了當前偵查協(xié)作運行存在的問題。主要包括:地方保護主義和本位主義嚴重;偵查協(xié)作的意識不強,認識不到位;偵查協(xié)作的絕對無償性原則阻礙偵查協(xié)作的運行;偵查協(xié)作的機制不健全;偵查協(xié)作責任規(guī)定不周全,考核不科學。 第三部分:探討了構建我國公安機關區(qū)域性偵查協(xié)作機制的基本構想,由三項內(nèi)容構成。在偵查協(xié)作系統(tǒng)中,包括偵查體制、協(xié)作內(nèi)容、協(xié)作方式、協(xié)作機構以及個體對偵查協(xié)作的主管意識等諸多要素,其中,機制起著基礎性、根本性的作用。受制于經(jīng)濟狀況、現(xiàn)行體制、個體的素質(zhì)等因素,偵查協(xié)作機制的構建是一項長期復雜的系統(tǒng)工程。本文中,筆者從以下三個方面提出了基本構想: 首先,改革與完善偵查體制,創(chuàng)新偵查協(xié)作模式。改革和完善偵查體制必須堅持循序漸進、科學、合理的原則,具體作法有:保證偵查機關獨立行使偵查權,規(guī)范黨對偵查機關的領導。接著闡明了創(chuàng)新偵查協(xié)作模式的作法。充分利用刑偵信息化平臺,拓寬偵查協(xié)作的渠道;構建服務于偵查破案的大刑偵格局。筆者論述要構建大刑偵格局,必須明確各警種的職責,健全多警協(xié)作的機制,加強具有偵查權部門間的整合。 其次,論述了強化刑偵基礎業(yè)務建設,建立情報主導機制。公安基礎工作是刑偵破案的重要基礎。情報是是偵查工作始終掌握主動權的關鍵。要加強情報信息的搜集、分析、研判和服務等機制建設。 最后,詳細闡明了構建全方位、多層次的區(qū)域性偵查協(xié)作機制的作法。第一,深化協(xié)作認識,培養(yǎng)協(xié)作精神。具體包括:摒棄地方保護主義和本位主義,樹立偵查協(xié)作全局觀;提高偵查人員素質(zhì);加強偵查的物質(zhì)保障。第二,加強偵查協(xié)作機構隊伍建設,完善偵查協(xié)作的內(nèi)容,規(guī)范運作程序。加強偵查協(xié)作專門機構的建設,確立“聯(lián)絡員”制度。第三,建立健全偵查協(xié)作的考核體系,完善責任制。這是區(qū)域性偵查協(xié)作機制得以順利運行的重要保障。實行“網(wǎng)上自動監(jiān)測”;健全考核體系;建立偵查協(xié)作的投訴舉報制度;明確協(xié)作雙方的協(xié)作責任,確立責任追究制度。
[Abstract]:The establishment of the market economy system and the deepening of the degree of economic integration have promoted the great flow of people, money and things. While bringing about the great development of the social productive forces, the cross regional crime is becoming more and more serious and the dynamic of the crime is becoming more and more prominent. With the increasing frequency of investigation and cooperation activities, the public security organs have established many bilateral or multilateral criminal investigation cooperation mechanisms according to the principles of legal norms, resources sharing, complementary advantages, mutual benefit and efficient coordination, and a long effective investigation and cooperation area has been established in the areas of close criminal contact. The cooperation of the criminal suspects, the criminal suspects to assist in the detention, the crime prevention, the emergency disposal of major emergencies, and many other aspects of cooperation. The rich practice of investigation cooperation promotes the further improvement of the theory of investigation and cooperation.
The study of the regional investigation and cooperation system is one of the important contents of the theory of investigation, which has the characteristics of comprehensive and practical. This paper closely links with the practice of public security, adopts the research methods of system theory, history, comparison, sociology and so on, and starts from the purpose of perfecting the regional investigation and cooperation mechanism of the public security organs of our country. On the basis of investigating the basic problems of cooperation, this paper puts forward the basic conception of constructing the regional investigation cooperation system of public security organs of our country, with a view to enriching and developing the theory of investigation cooperation in China and promoting the development of the investigation and cooperation of the public security organs. The full text is composed of three parts.
The first part is to clarify the basic problems of investigation cooperation. There are four contents. First, the concept of investigation cooperation is evaluated, the concept of investigation cooperation is defined, and the reasons are analyzed. The main features of the investigation cooperation are the investigative organs or detection departments with the power of investigation; the purpose of the investigation and cooperation is to combat crime, and the purpose of the investigation and cooperation is to fight crime and dimension. To protect the social order; the relationship between the subjects of the investigation and cooperation is in a relatively equal position, and its rights and obligations are consistent; investigation cooperation is a specific investigation measure, with the nature of criminal litigation. On the basis of the concept of investigation and cooperation, the concept of regional investigation cooperation is put forward. Secondly, the investigation cooperation is divided according to different standards. According to the frequency and standard degree of investigation cooperation, it is divided into: temporary cooperation and cooperation organization; according to the content of investigation cooperation, it is divided into joint investigation, investigation of information exchange and cooperation and arrest. Finally, it demonstrates the basis of investigation cooperation. The second part examines the history and present situation of regional investigation cooperation in China, which consists of three contents. First, the history of regional investigation cooperation in China is investigated. The third part: discussing the basic conception of constructing the regional investigation cooperation mechanism of the public security organs of our country, which consists of three contents. In this paper, the author puts forward the basic ideas from the following three aspects:
First, reform and perfect the investigation system and innovate the mode of investigation cooperation. Reform and perfect the investigation system must adhere to the gradual, scientific and reasonable principles. The concrete methods are as follows: ensuring the investigative organs to exercise the power of investigation independently and standardize the leadership of the party to the investigation organs. In order to build a pattern of criminal investigation for criminal investigation, the author states that the responsibility of all kinds of police must be clearly defined, the mechanism of multi police cooperation should be improved, and the integration of the departments with investigative power should be strengthened.
Secondly, it expounds the construction of strengthening the basic business of criminal investigation and the establishment of the information leading mechanism. The basic work of the public security is the important foundation of the criminal investigation, and the information is the key to the investigation work always mastering the initiative. It is necessary to strengthen the construction of information collection, analysis, research and service.
Finally, it expounds the construction of a comprehensive and multi-level regional investigation cooperation mechanism in detail. First, deepen the understanding of cooperation and cultivate the spirit of cooperation. It includes: abandoning the local protectionism and departmentalism, setting up the overall view of investigation cooperation, improving the quality of investigator, strengthening the material guarantee of investigation. Second, strengthening the investigation and cooperation organization. Construction of the team, perfect the content of investigation cooperation, standardize the operation procedure, strengthen the construction of the specialized agency for investigation and cooperation, establish the "liaison officer" system. Third, establish and improve the evaluation system of investigation cooperation and perfect the responsibility system. This is the important guarantee for the smooth operation of the regional investigation and cooperation mechanism. The nuclear system; the establishment of a complaint reporting system for investigation cooperation; the coordination responsibilities of the two parties should be clearly defined, and the accountability system should be established.
