農(nóng)村“留守兒童”犯罪現(xiàn)狀、原因及對(duì)策分析

【摘要】:近年來(lái),隨著產(chǎn)業(yè)結(jié)構(gòu)調(diào)整、社會(huì)經(jīng)濟(jì)發(fā)展、城市化進(jìn)程加快,農(nóng)村外出務(wù)工人員不斷增多,農(nóng)村“留守兒童”呈逐年上升趨勢(shì)。兒童時(shí)期是一個(gè)人的情感、品德、性格等形成和發(fā)展的關(guān)鍵時(shí)期,需要家長(zhǎng)的悉心照顧和耐心引導(dǎo),但農(nóng)村“留守兒童”由于長(zhǎng)期與父母分離,生活上缺少必要的關(guān)愛(ài),情緒易消極,產(chǎn)生失落和自卑感。同時(shí),由于對(duì)信息社會(huì)中大量良莠不齊的資訊缺乏辨別力,導(dǎo)致農(nóng)村“留守兒童”傷人或被傷害的安全事件時(shí)有發(fā)生。論文主要從農(nóng)村“留守兒童”的現(xiàn)狀、犯罪特點(diǎn)、犯罪原因等方面有針對(duì)性地分析如何加強(qiáng)農(nóng)村“留守兒童”的法制教育,旨在探討如何加強(qiáng)農(nóng)村“留守兒童”的法制教育,這既是提高公民法律素質(zhì)的治本要求,又是保護(hù)未成年人合法權(quán)益、預(yù)防未成年人違法犯罪的一項(xiàng)基礎(chǔ)性工作和重要舉措。論文中提出各項(xiàng)措施運(yùn)用到農(nóng)村“留守兒童”犯罪中,以期在社會(huì)實(shí)踐中加強(qiáng)農(nóng)村“留守兒童”的法律意識(shí),規(guī)范他們的行為,從而有效預(yù)防和減少農(nóng)村“留守兒童”的違法犯罪現(xiàn)象。 本文分為四個(gè)部分,主要是在明晰農(nóng)村“留守兒童”概念的基礎(chǔ)上,緊密結(jié)合現(xiàn)下農(nóng)村“留守兒童”的生存發(fā)展現(xiàn)狀,指出其犯罪的特殊性,對(duì)農(nóng)村“留守兒童”犯罪原因進(jìn)行有效探討,針對(duì)原因,從家庭、學(xué)校及社會(huì)等三個(gè)不同層面提出預(yù)防措施,以期將農(nóng)村“留守兒童”納入有效的家庭、學(xué)校和社會(huì)的監(jiān)管之下,使其真正感受來(lái)自家庭、學(xué)校及社會(huì)的關(guān)愛(ài),扭轉(zhuǎn)心態(tài),在留守這樣一個(gè)特殊環(huán)境下,健康成長(zhǎng)。 第一部分從不同角度和層面明確農(nóng)村“留守兒童”的概念和內(nèi)涵,指出農(nóng)村“留守兒童”現(xiàn)象出現(xiàn)的歷史背景和現(xiàn)實(shí)原因。同時(shí),以事實(shí)說(shuō)話,通過(guò)對(duì)實(shí)際數(shù)據(jù)的表格例證,對(duì)農(nóng)村“留守兒童”的發(fā)展現(xiàn)狀作了簡(jiǎn)要的概括和分析,指出該特殊群體的社會(huì)影響。 第二部分重點(diǎn)闡述農(nóng)村“留守兒童”的犯罪現(xiàn)狀。該部分將視角同時(shí)落在農(nóng)村“留守兒童”作為犯罪行為實(shí)施者的情況及其作為犯罪行為受害者兩個(gè)問(wèn)題上通過(guò)農(nóng)村“留守兒童”犯罪現(xiàn)狀分析指出,近幾年,農(nóng)村留守犯罪數(shù)量呈上升趨勢(shì)、犯罪類型以財(cái)產(chǎn)型犯罪為首。因農(nóng)村“留守兒童”犯罪主體非常特殊,其犯罪主觀多為故意,暴力性、貪利性突出,突發(fā)性、盲目性、隨機(jī)性明顯。 第三部分從不同的社會(huì)化主體,即家庭、學(xué)校、社會(huì)及自身四個(gè)方面,指出其對(duì)農(nóng)村“留守兒童”犯罪的負(fù)面影響,分析造成農(nóng)村“留守兒童”犯罪的原因所在。農(nóng)村“留守兒童”家庭原有功能缺失,一定程度上積極的學(xué)校教育能促進(jìn)或彌補(bǔ)家庭教育的不足。若學(xué)校教育一旦缺失,留守兒童走向犯罪的可能性就越大 第四部分主要是在分析造成農(nóng)村兒童犯罪的原因的基礎(chǔ)上,從家庭、學(xué)校、社會(huì)及留守兒童自身等四個(gè)社會(huì)化主體出發(fā),提出有效控制和預(yù)防農(nóng)村“留守兒童”犯罪的應(yīng)對(duì)措施,幫助其走出人生困惑,重新踏上人生新的旅程。
[Abstract]:In recent years , with the adjustment of industrial structure , the development of social economy , the acceleration of urbanization and the increasing number of migrant workers in rural areas , it is a basic task and important measure to strengthen the legal education of the children in rural areas .
This paper is divided into four parts , mainly based on the concept of " left behind children " in rural areas , and points out the particularity of the crime , and puts forward preventive measures at three different levels , such as family , school and society , with a view to integrating rural " left behind children " under the supervision of effective family , school and society .
In the first part , the concept and connotation of the " left - behind children " in rural areas are clearly defined from different angles and levels , and the historical background and the realistic reasons of the phenomenon of " left - behind children " in rural areas are pointed out . At the same time , the present situation of the " left - behind children " in rural areas is summarized and analyzed with the facts , and the social impact of the special group is pointed out .
The second part focuses on the present situation of the crime of " left behind children " in rural areas .
The third part points out its negative influence on the crime of " left behind children " in rural areas from four aspects , namely , family , school , society and itself . It analyzes the causes of the crime of " left behind children " in rural areas . The former function of the rural " left behind children " is missing , some positive school education can promote or compensate for the shortage of family education . If the school education is missing , the greater the possibility of leaving the child to crime .
In the fourth part , based on the analysis of the causes of rural children ' s crime , from the four socialization bodies , such as family , school , society and left - behind children themselves , this paper puts forward countermeasures to effectively control and prevent the crime of " left behind children " in rural areas .
