【摘要】：犯罪作為一種社會(huì)現(xiàn)象,跟隨著人類社會(huì)發(fā)展的腳步呈現(xiàn)出許多新的特點(diǎn),如何做好新時(shí)期的犯罪預(yù)防和控制工作,是擺在所有人面前的一道難題。刑罰歷來(lái)作為預(yù)防和控制犯罪的重要方式之一,如何更有效的發(fā)揮刑罰自身的作用,也是需要認(rèn)真思考和研究的一個(gè)問(wèn)題。而刑罰在犯罪防控中發(fā)揮作用主要是通過(guò)刑罰心理效應(yīng),因此通過(guò)對(duì)刑罰心理效應(yīng)相關(guān)問(wèn)題的研究,并結(jié)合當(dāng)前我國(guó)犯罪的新形勢(shì),才能充分激發(fā)刑罰心理效應(yīng)的正能量,從而達(dá)到犯罪防控的目的。文章共分為引言、正文、結(jié)語(yǔ)三個(gè)部分。引言部分主要介紹了文章的選題背景、選題目的,介紹了當(dāng)前學(xué)界就這一問(wèn)題的研究成果,并且簡(jiǎn)要介紹了當(dāng)前研究上存在的不足之處,從而引出文章的寫(xiě)作意義。正文部分是文章的寫(xiě)作重點(diǎn),由三個(gè)部分構(gòu)成：刑罰心理效應(yīng)的理論概述、我國(guó)犯罪防控的現(xiàn)狀及分析、刑罰心理效應(yīng)視角下的犯罪防控路徑選擇。其中第一部分主要從刑罰心理效應(yīng)理論的歷史發(fā)展脈絡(luò)、分類、表現(xiàn)及發(fā)生機(jī)制等幾個(gè)方面對(duì)刑罰心理效應(yīng)的相關(guān)理論進(jìn)行了簡(jiǎn)單的梳理和分析。通過(guò)對(duì)這些基本理論的分析,明確了刑罰針對(duì)不同的主體可能產(chǎn)生的心理效應(yīng)以及如何對(duì)人產(chǎn)生心理效應(yīng)等問(wèn)題,為犯罪防控路徑的選擇提供了理論依據(jù)。第二部分主要介紹了當(dāng)前我國(guó)的犯罪形勢(shì)和犯罪特點(diǎn),并在此基礎(chǔ)上介紹了針對(duì)當(dāng)前犯罪形勢(shì)和犯罪特點(diǎn)已經(jīng)采取的一些犯罪防控措施以及這些措施存在的不足。通過(guò)對(duì)當(dāng)前形勢(shì)的分析,有助于更清楚的認(rèn)識(shí)當(dāng)前的犯罪以及犯罪防控現(xiàn)狀,從而更好的為正文第三部分的開(kāi)展提供現(xiàn)實(shí)依據(jù)。第三部分在前面兩部分論述的基礎(chǔ)上,提出了當(dāng)前在犯罪防控路徑選擇上如何有效的發(fā)揮刑罰的心理效應(yīng)。具體而言：一是思想觀念的更新,認(rèn)識(shí)到犯罪的相對(duì)性、刑罰的有限性及高效性；二是應(yīng)遵循的基本原則,即在刑罰適用過(guò)程中要遵循合法性原則、公開(kāi)性原則、確定性原則、適度性原則、及時(shí)性原則；三是塑造健康的個(gè)體心理機(jī)制,一方面積極推動(dòng)個(gè)體的社會(huì)化進(jìn)程；另一方面引導(dǎo)自我修養(yǎng),加強(qiáng)自我控制；四是通過(guò)構(gòu)建良好的司法環(huán)境、營(yíng)造良好的刑事法制環(huán)境、有效發(fā)揮現(xiàn)代媒介的信息傳播功能從而構(gòu)建良好的社會(huì)法制氛圍。結(jié)語(yǔ)部分對(duì)前文的內(nèi)容進(jìn)行了系統(tǒng)的總結(jié),并且分別從主觀和客觀兩方面說(shuō)明了文章研究的不足之處。
[Abstract]:Crime as a social phenomenon, following the pace of human social development presents many new characteristics, how to do a good job of crime prevention and control in the new period, is placed in front of everyone a difficult problem. Penalty has always been one of the important ways to prevent and control crime. How to play the role of penalty itself more effectively is also a problem that needs to be seriously considered and studied. The function of penalty in crime prevention and control is mainly through the psychological effect of penalty. Therefore, through the study of the problems related to the psychological effect of penalty and the new situation of crime in our country, the positive energy of psychological effect of penalty can be fully stimulated. In order to achieve the purpose of crime prevention and control. The article is divided into three parts: introduction, text and conclusion. The introduction mainly introduces the background and purpose of the topic, introduces the current academic research on this issue, and briefly introduces the shortcomings of the current research, thus leading to the writing significance of the article. The main body is the focus of the article, which consists of three parts: the theoretical overview of the psychological effect of penalty, the present situation and analysis of crime prevention and control in China, and the choice of the path of crime prevention and control from the perspective of the psychological effect of punishment. The first part mainly from the historical development of the theory of psychological effect of punishment, classification, performance and occurrence mechanism of several aspects of the psychological effect of penalty theory is simply combed and analyzed. Through the analysis of these basic theories, this paper clarifies the possible psychological effects of punishment for different subjects and how to produce psychological effects on people, which provides a theoretical basis for the choice of the path of crime prevention and control. The second part mainly introduces the current crime situation and characteristics of our country, and on this basis introduces some crime prevention and control measures that have been taken in view of the current crime situation and characteristics and the shortcomings of these measures. Through the analysis of the current situation, it is helpful to understand the current situation of crime and crime prevention and control, so as to provide a practical basis for the development of the third part of the text. In the third part, on the basis of the former two parts, the author puts forward how to give full play to the psychological effect of punishment on the choice of crime prevention and control path. Concretely speaking, the first is the renewal of ideology, recognizing the relativity of crime, the limitation and efficiency of penalty, and the basic principles to be followed, that is, the principle of legality, the principle of openness and the principle of certainty in the course of penalty application. The principle of moderation, the principle of timeliness, the third is to shape a healthy individual psychological mechanism, on the one hand to actively promote the individual socialization process; on the other hand, guide self-cultivation, strengthen self-control; fourth, through the construction of a good judicial environment, Create a good criminal legal environment, effectively play the role of modern media information dissemination to build a good social legal atmosphere. The conclusion part systematically summarizes the contents of the above, and explains the shortcomings of the research from the subjective and objective aspects.
