【摘要】： 交流與互動(dòng)自古以來就是科學(xué)取得長足進(jìn)展的源泉,不同思想不同方法的撞擊才能融會(huì)各家之長,激發(fā)科學(xué)靈感。任何畫地為牢閉門造車的行為都將使科學(xué)的路徑越來越窄。在筆跡鑒定領(lǐng)域,我們也需要進(jìn)一步開拓視野,了解分析異國文字的特點(diǎn),比較其與漢字的異同,在此基礎(chǔ)上,提煉出共有的屬性,剝離其獨(dú)具的特質(zhì),從而在鑒定方法上一方面在共性的基礎(chǔ)上精益求精,另一方面借鑒和吸收其獨(dú)特性,運(yùn)用到漢字筆跡鑒定中來。當(dāng)然,科學(xué)進(jìn)展不是一蹴而就的,需要漸進(jìn)的累積和滲透,因此在研究異國文字鑒定時(shí),我們不妨首先選擇目前應(yīng)用范疇最為廣泛的英文作為比較對(duì)象,在將其與漢字的特征以及鑒定方法進(jìn)行比較后,初步摸索出融合借鑒的范式。 香港名噪一時(shí)的“世紀(jì)爭產(chǎn)案”為中英文筆跡鑒定方法的比較研究提供了一個(gè)契機(jī),不同國家的不同鑒定方法和理念首次以激烈對(duì)弈的形式呈現(xiàn)在法庭面前,該案的意義在于引導(dǎo)人們對(duì)鑒定方法的差異進(jìn)行反思。長期以來,由于語言的差異和溝通的障礙,文書檢驗(yàn)在國際交流方面并不活躍,大多局限于本國文字的鑒定工作。然而隨著世界經(jīng)濟(jì)文化發(fā)展的一體化,涉外案件的逐漸增加,筆跡鑒定必須跨出傳統(tǒng)的鑒定范疇,從更宏觀的角度不斷豐實(shí)和完善自身的鑒定方法。本文正是基于這一緣由展開闡述和論證,從比較中英文筆跡鑒定方法入手,提出二者相互吸收借鑒的途徑,然后進(jìn)一步介紹了應(yīng)如何鑒定異國文字,以其對(duì)筆跡鑒定的實(shí)際工作能夠有所輔益。 全文由四個(gè)部分組成。 第一部分是方法論概述,主要起到理論基奠作用。首先提出什么是方法,為什么方法在科學(xué)研究中具有舉足輕重的作用,這也是全文的基本立意所在。其次闡釋了科學(xué)方法的含義,即經(jīng)驗(yàn)和理性的平衡,這兩方面實(shí)際上恰恰是中英文筆跡鑒定方法的各自倚重,因此,要保持方法的科學(xué)性,必須將兩者有機(jī)結(jié)合起來。最后把科學(xué)方法和筆跡鑒定程式結(jié)合起來,以例證的形式表述了什么是筆跡鑒定的科學(xué)方法,其基本程式如何。 第二部分是中英文筆跡鑒定概述,通過對(duì)基本知識(shí)的介紹為后文的比較研究奠定基礎(chǔ)。首先比較中英文筆跡鑒定的歷史,歷史研究是任何透徹的研究都不能規(guī)避和忽略的問題,只有厘清歷史發(fā)展情境,才能對(duì)事物有充足的了解。該部分正是從中英文筆跡鑒定各自的歷史發(fā)展和沿革中,發(fā)掘出它們鑒定理念和方法形成的脈絡(luò)。其次介紹了筆跡鑒定的理論基礎(chǔ),這一點(diǎn)二者大致相同,其理論依據(jù)都是源于書寫習(xí)慣的特定性、穩(wěn)定性和反映性。最后介紹了筆跡鑒定的程序——ACE法則,即筆跡的分析、比較和綜合評(píng)斷�？傮w而言,該部分除了歷史比較外,介紹的主要是二者的相似部分,包括鑒定的理論基礎(chǔ)和程序,正因?yàn)榇嬖谶@種相似性,才有了相互借鑒的可能,這是一個(gè)基本前提。 第三部分是全文的中心——中英文筆跡鑒定方法之異同。首先對(duì)中英文筆跡特征的差別進(jìn)行比較,包括字形的差別,筆順的差別,傾斜方向的差別,標(biāo)點(diǎn)符號(hào)的差別以及文字布局的差別等。筆跡特征的不同必然導(dǎo)致鑒定方法的不同,因?yàn)閷?duì)象與方法之間存在著相互對(duì)應(yīng)的關(guān)系,所以要比較方法,首先就要明確對(duì)象的差異。其次是中英文筆跡特征的分類。其中漢字將筆跡特征分為一般特征和細(xì)節(jié)特征,而英文則將筆跡特征分為字形特征、運(yùn)筆特征、書寫習(xí)慣特性變化規(guī)律特征和書寫習(xí)慣的組合特征。分類是比較研究的重要方法,通過分類的差異便可折射出中英文筆跡鑒定方法的異同。最后文章通過“中西思維方式的差異——漢英字符結(jié)構(gòu)的差異——筆跡鑒定方法的差異”這一邏輯脈絡(luò)著力論證了中英文筆跡鑒定方法的差異。即中國的直觀性和整體性思維方式對(duì)應(yīng)的漢字是方塊結(jié)構(gòu)的表意文字;西方注重分析與實(shí)證的思維方式對(duì)應(yīng)的英文是曲線結(jié)構(gòu)的表音文字。思維方法和分析對(duì)象的差異又使鑒定方法各有千秋。如漢字鑒定善于運(yùn)用系統(tǒng)的方法進(jìn)行比較分析,運(yùn)用辯證思維進(jìn)行綜合評(píng)斷;英文鑒定則更擅長運(yùn)用測(cè)量、數(shù)字統(tǒng)計(jì)以及邏輯推理。只有了解了各自的方法特點(diǎn),才能為進(jìn)一步的借鑒提供條件。 第四部分在分析完中英文筆跡鑒定方法的異同后回歸到文章寫作的主旨或者意義所在,即筆跡鑒定方法的相互借鑒。研究方法的差異只是一種手段和途徑,最終目的是要從中汲取經(jīng)驗(yàn),不斷完善鑒定理論,提高鑒定水平。例如數(shù)字統(tǒng)計(jì)分析在漢字鑒定中的運(yùn)用,系統(tǒng)、靈活的分析方法,科學(xué)表達(dá)鑒定結(jié)論。最后,文章跳出單純的中英文比較的局限,把視角擴(kuò)大到如何做好異國文字的鑒定,從而提升到一個(gè)新的高度。具體而言,要做好異國文字的鑒定要做好相應(yīng)的準(zhǔn)備工作,如熟悉該國語言文字,收集相關(guān)的信息,然后從筆跡的分析、比較和評(píng)斷這三個(gè)階段,展開具體的鑒定工作。文章最后介紹了對(duì)以一國語言為母語或非母語的書寫人書寫筆跡的檢驗(yàn),這樣筆跡鑒定的對(duì)象就是本國文字、異國文字、一國人所書寫的另一國文字的三位一體的結(jié)合,從而形成一個(gè)系統(tǒng)的完整的筆跡鑒定體系。
[Abstract]:In the field of handwriting identification , we also need to further expand the field of view to understand the characteristics of different Chinese characters and to compare the characteristics of different Chinese characters . On the other hand , we should choose the most extensive English as the comparative object on the basis of the commonness on the basis of the identification method , and then compare it with the characteristics of Chinese characters and the methods of identification .


This paper provides an opportunity for the comparative study of Chinese and English handwriting identification methods in the " Century War Case " . The significance of the case is to guide people to reflect on the differences of the methods of identification . The first part is the summary of methodology , which mainly plays the role of theoretical basis . First of all , what is the method and why the method plays an important role in scientific research is the basic idea of the whole text . The second part is an overview of Chinese and English handwriting identification , which lays the foundation for the comparison of the basic knowledge . First , the history and historical research on the identification of Chinese and English handwriting can not be avoided and neglected .


The third part is the similarities and differences between Chinese and English handwriting identification methods . Firstly , the differences between Chinese and English handwriting features are compared . The differences between Chinese and English handwriting identification methods are discussed .


The fourth part , after analyzing the similarities and differences between Chinese and English handwriting identification methods , returns to the subject or meaning of the writing of the article , that is to say , the differences of the methods are only a means and means .
