【摘要】：本文的基本思路是：通過研究形成供述的心理基礎(chǔ)，找出影響犯罪嫌疑人如實供述或拒絕供述的心理因素，并針對這些因素，論述幾種促使犯罪嫌疑人如實供述的心理學(xué)策略，為偵查實踐服務(wù)。之后在文章的最后一章筆者指出，為了更好的運(yùn)用這些策略，科學(xué)、有效的訊問工具是必不可少的，接著列舉了幾種偵查訊問輔助措施，作為貫徹這些策略并檢驗其效果的輔助工具。 因此，本文共分為六大部分： 第一部分：為前言，闡述了獲取犯罪嫌疑人口供在整個刑事訴訟過程中的重要作用，指出將心理學(xué)理論應(yīng)用于偵查訊問程序有助于獲取真實供述、遏制刑訊逼供現(xiàn)象的發(fā)生。 第二部分：為本文的第一章，為文章的中心內(nèi)容做理論鋪墊。主要論述心理現(xiàn)象的基本理論、訊問中犯罪嫌疑人的心理狀態(tài)、供述的形成過程。結(jié)合心理學(xué)的基本理論，重點論述犯罪嫌疑人個性心理對訊問策略的影響。 第三部分：為本文的第二章，也是深入分析的部分。主要論述影響犯罪嫌疑人拒絕供述和如實供述的心理因素，重點介紹了在心理強(qiáng)制和生理強(qiáng)制作用下，，虛假供述出現(xiàn)的原因、分類，以及偽供的審查。
[Abstract]:The basic idea of this paper is to find out the psychological factors that affect the criminal suspect's truthful confession or refusal to confess, and to discuss several psychological strategies to promote the criminal suspect's truthful confession by studying the psychological basis of the confession, and find out the psychological factors that affect the criminal suspect's truthful confession or refuse to confess. To serve the investigation practice. In the last chapter of the article, the author points out that in order to make better use of these strategies, scientific and effective interrogation tools are essential. Therefore, this paper is divided into six parts: the first part: foreword, elaborated the important function of obtaining suspect's confession in the whole process of criminal proceedings, It is pointed out that the application of psychological theory to the procedure of investigation and interrogation is helpful to obtain true confessions and curb the phenomenon of extorting confessions by torture. The second part: the first chapter of this paper makes a theoretical foundation for the central content of the article. This paper mainly discusses the basic theory of psychological phenomena, the psychological state of suspects in interrogation, and the forming process of confessions. Combining with the basic theory of psychology, this paper focuses on the influence of the suspect's personality psychology on the interrogation strategy. The third part is the second chapter of this paper, which is also the part of in-depth analysis. This paper mainly discusses the psychological factors that affect the criminal suspect's refusal and truthfulness of confession, and emphatically introduces the reasons, classification and examination of false confession under the action of psychological and physiological compulsion.
