【摘要】：建國(guó)初期，在政治斗爭(zhēng)形勢(shì)異常嚴(yán)峻，新中國(guó)階級(jí)統(tǒng)治工具還不完善的情況下，以及為處置一些不夠刑事處罰的反革命分子、壞分子，使他們有出路，有工做，實(shí)現(xiàn)他們的就業(yè)問(wèn)題，中共中央出臺(tái)了相關(guān)的政策創(chuàng)建了極具中國(guó)特色的勞動(dòng)教養(yǎng)制度。 勞動(dòng)教養(yǎng)創(chuàng)建之初，在保衛(wèi)新生的國(guó)家政權(quán)，維護(hù)政治穩(wěn)定，維持社會(huì)治安秩序，預(yù)防、減少和控制犯罪等方面，發(fā)揮了重要的作用，也作出了重大的貢獻(xiàn)。隨著社會(huì)經(jīng)濟(jì)的發(fā)展，改革開(kāi)放以來(lái)特別是依法治國(guó)方略的提出與實(shí)施，勞動(dòng)教養(yǎng)制度已經(jīng)越來(lái)越不適應(yīng)當(dāng)前社會(huì)的政治、經(jīng)濟(jì)、法律、公共管理、人權(quán)保障的要求。改革、廢除勞動(dòng)教養(yǎng)制度的呼吁越來(lái)越激烈，成為理論界、學(xué)術(shù)界研究的熱門(mén)話題和難點(diǎn)問(wèn)題。 從表面現(xiàn)象進(jìn)行分析，勞動(dòng)教養(yǎng)制度的缺陷主要在于其理論基礎(chǔ)、法律規(guī)范、執(zhí)行體制機(jī)制等方面，造成既不合法，又侵犯人權(quán)的現(xiàn)狀。而從實(shí)質(zhì)上研究勞動(dòng)教養(yǎng)制度的缺陷，牽系到司法、行政等職能部門(mén)的部門(mén)利益和權(quán)力的配置不均衡，牽系到公權(quán)力與私權(quán)利不對(duì)等的問(wèn)題，勞動(dòng)教養(yǎng)制度改革與司法體制改革、行政體制改革密切相關(guān)。 本文將采用文獻(xiàn)研究方法、比較研究方法、調(diào)查研究方法等，綜合運(yùn)用政治學(xué)、法學(xué)、公共管理學(xué)、經(jīng)濟(jì)學(xué)等多學(xué)科的知識(shí)，主要以公共管理學(xué)為主，分析和思考了勞動(dòng)教養(yǎng)制度改革的研究現(xiàn)狀與研究背景，同時(shí)比較研究了國(guó)外與勞動(dòng)教養(yǎng)相關(guān)的制度，全面審視了勞動(dòng)教養(yǎng)制度的理論基礎(chǔ)及各個(gè)歷史階段的作用，分析和思考了勞動(dòng)教養(yǎng)制度存在的缺陷及其原因，，在此基礎(chǔ)上提出了自己關(guān)于勞動(dòng)教養(yǎng)制度改革的設(shè)想。
[Abstract]:In the early period of the founding of the People ' s Republic of China , when the political struggle situation is extremely serious , the new Chinese class rule tool is not perfect , and to deal with counter - revolutionaries and bad molecules that are not enough criminal punishment , so that they have a way out , work is done to realize their employment problems , the Central Committee of the Communist Party of China has issued relevant policies to create a labor education system with Chinese characteristics .

With the development of the social economy and the reform and opening - up , especially since the reform and opening up , the reform and opening - up have become more and more violent , which has become a hot topic and difficult problem in academic circles and academic circles .

From the analysis of the surface phenomenon , the defects of the system of reeducation through labor are mainly the theoretical basis , the legal norm , the implementation of the system mechanism and so on , which causes neither legitimacy nor violation of human rights .

This paper will use literature research methods , comparative research methods , research methods and so on , combine the knowledge of many disciplines such as politics , law , public administration , economics and so on , mainly focus on public administration , analyze and reflect on the research situation and research background of the reform of reeducation through labor . At the same time , the paper compares the theory foundation of the system of reeducation through labor and the function of each historical stage , analyzes and thinks the defects and causes of the existence of the system of reeducation through labor , and puts forward some ideas about the reform of reeducation through labor .
