【摘要】： 人類社會進入了一個嶄新的世紀，青少年犯罪繼續(xù)是一個全球關(guān)注的嚴重社會問題。作為世界三大公害之一，目前，無論是發(fā)達的西方工業(yè)國家，還是發(fā)展中國家大都面臨青少年犯罪不斷上升的嚴重狀況。從美國頻繁發(fā)生的校園槍殺案件，到日本的幾次犯罪高峰，青少年犯罪已成為困擾現(xiàn)代社會的一大世紀難題。 在我國，青少年犯罪又有其特殊性。我國自1978年實行計劃生育政策以來，青少年中絕大部分都是獨生子女。獨生子女與非獨生子女相比有其獨特的性格特征和家庭成長環(huán)境。為了更好的預(yù)防和減少獨生子女犯罪，使獨生子女能健康成長，并且成為國家有用的人才，同時也為國家完善有關(guān)立法和學者開展這方面的研究提供參考和借鑒，筆者擬將獨生子女犯罪問題作為研究課題，以引起全社會對獨生子女犯罪問題的高度重視。 本文首先從犯罪的主體、犯罪的客體、犯罪的主觀方面和犯罪的客觀方面闡述了獨生子女犯罪的構(gòu)成；接著分析了我國獨生子女犯罪的現(xiàn)狀及其危害性，認為我國當前獨生子女犯罪呈現(xiàn)犯罪性質(zhì)惡劣，重大刑事犯罪率上升，犯罪手段成人化、智能化，犯罪方式團伙化，，犯罪年齡低齡化等特點，闡述了獨生子女犯罪對獨生子女自身、家庭、同輩群體以及社會的危害；然后深入地剖析了我國獨生子女犯罪的主要主客觀原因，認為主觀原因包括缺乏正確的人生觀、價值觀，自我中心意識強，感情脆弱，依賴性強，生活自理能力差，法制觀念淡薄，人際交往能力差，擇友不慎等方面；獨生子女犯罪的客觀原因有不良的社會環(huán)境，學校教育的失誤，家庭教育的失當，社區(qū)環(huán)境的影響等。最后，在上述研究的基礎(chǔ)上，提出了一些積極有效的獨生子女犯罪防范對策，即加強獨生子女自我教育，提高獨生子女自我預(yù)防能力；改善家庭環(huán)境，增強家庭教育功能；轉(zhuǎn)變教育觀念，發(fā)揮學校教育的主導(dǎo)作用；加強社區(qū)建設(shè)，強化社區(qū)教育職能；進一步完善防范獨生子女犯罪的各種立法：嚴格司法，加大對獨生子女犯罪的懲處力度；凈化社會環(huán)境，消除不良因素的影響；堅持以人為本， ⑧羔糕S 注重違法犯罪獨生子女改造轉(zhuǎn)化等方面。 需要強調(diào)的是，除了完善一個法制之外，良好的家庭教育和環(huán)境對防治獨 生子女犯罪至關(guān)重要。家庭結(jié)構(gòu)、家庭氛圍、家長自身的素質(zhì)以及教養(yǎng)方式都 會對獨生子女的成長產(chǎn)生深遠的影響，家長必須注意加強對獨生子女的教育與 引導(dǎo)，注意改善家庭教育環(huán)境。另外，社會環(huán)境狀況對獨生子女犯罪的影響也 是相當大的。全社會都要動員起來抵制腐朽思想，加強對文化市場和娛樂場所 的監(jiān)管力度，多創(chuàng)作、出版有益于青少年健康成長的書籍、報刊，注意制作和 播放健康優(yōu)秀的廣播影視節(jié)目，加強青少年活動陣地建設(shè)，改善他們的成長環(huán) 境，使他們耳濡目染的都是真、善、美的事物，以達到預(yù)防和減少獨生子女犯 罪的目的，使廣大獨生子女健康成長，成為我們國家未來建設(shè)的中堅力量。
[Abstract]:The human society has entered a new century , and juvenile delinquency continues to be a serious social problem of global concern . As one of the three major public hazards in the world , nowadays , whether developed western industrialized countries or developing countries face the serious condition of increasing juvenile delinquency .









In our country , juvenile delinquency has its particularity . Since 1978 , most of the young people are only one child . In order to prevent and reduce the crime of single child , the only child can grow healthily and become a country ' s useful person .









Firstly , this paper expounds the constitution of the juvenile delinquency from the subject of crime , the object of crime , the subjective aspect of crime and the objective aspect of crime .
Secondly , the author analyses the present situation and harmfulness of the crime of the only child in our country . It is believed that the crime of the only child in our country is bad , the major criminal crime rate rises , the crime means becomes humanized , intelligent , the crime is organized , the age of the crime is low , etc . , the harm of the only child crime to the only child itself , the family , the peer group and the society is expounded .
Then the main subjective and objective reasons of the crimes of the only child in our country are analyzed in detail . The main reasons include lack of correct outlook on life , values , self - centered consciousness , weak feeling , strong dependence , poor living self - ability , weak legal concept , poor interpersonal communication ability and careless selection of friends .
On the basis of the above research , the author puts forward some active and effective countermeasures to prevent the crime of the only child , namely , strengthen the self - education of the only child and improve the self - prevention ability of the only child .
