【摘要】： 當(dāng)前,在偵查學(xué)研究領(lǐng)域主要研究方向多是在偵查程序、偵查手段、偵查機(jī)制上,而對(duì)偵查再現(xiàn)的研究少有論及,即便有也僅限于概念與內(nèi)容,缺乏系統(tǒng)認(rèn)識(shí)。其實(shí),偵查再現(xiàn)犯罪在國(guó)外某些國(guó)家的偵查領(lǐng)域,正逐步成為偵查學(xué)界專家學(xué)者研究的一個(gè)課題。究其原因,是因?yàn)閭刹樵佻F(xiàn)犯罪是系統(tǒng)地運(yùn)用邏輯方法對(duì)現(xiàn)場(chǎng)的痕跡物證等分析研究,從而全面而成體系的重建犯罪現(xiàn)場(chǎng)的過(guò)程。正是因?yàn)槿绱?筆者擬以證據(jù)理論和犯罪心理痕跡為視角,對(duì)偵查再現(xiàn)犯罪進(jìn)行一個(gè)概括和提升。 本文首先從偵查再現(xiàn)的三論方法論——信息論、系統(tǒng)論和控制論等方面入手,搭建偵查再現(xiàn)的基本的方法論體系。首先,犯罪信息既是偵查得以再現(xiàn)的基礎(chǔ)和中介,又是偵查決策的前提和基礎(chǔ),整個(gè)偵查再現(xiàn)的過(guò)程可以說(shuō)是圍繞著收集犯罪信息即收集犯罪相關(guān)證據(jù)而進(jìn)行的。因此,信息理論是偵查再現(xiàn)基本理論之一。其次,偵查本身是一個(gè)系統(tǒng)工程,偵查再現(xiàn)活動(dòng)又是收集信息、處理信息和運(yùn)用信息的系統(tǒng)工程,并且,整個(gè)犯罪行為、犯罪過(guò)程也是一個(gè)由犯罪行為人自主調(diào)控的系統(tǒng)工程。不論是偵查系統(tǒng)還是犯罪系統(tǒng),都包含若干個(gè)子系統(tǒng)。再次,偵查再現(xiàn)活動(dòng)還是系統(tǒng)控制活動(dòng),整個(gè)偵查再現(xiàn)活動(dòng)中充滿著控制與反控制的沖突,在對(duì)抗中得以偵破案件,實(shí)現(xiàn)再現(xiàn)犯罪的偵查任務(wù)。所以運(yùn)用信息論、系統(tǒng)論、控制論的觀點(diǎn)和方法解決偵查再現(xiàn)的問(wèn)題就具有理論意義和現(xiàn)實(shí)意義。 接著,本文以證據(jù)1理論的系統(tǒng)分析為切入點(diǎn),并詳重分析了證據(jù)與偵查再現(xiàn)的關(guān)系。證據(jù)之于偵查階段乃至整個(gè)刑事訴訟程序的意義都非同一般。證據(jù)是整個(gè)訴訟程序的核心,無(wú)論是在偵查、檢察,還是審判階段,對(duì)于公檢法系統(tǒng)的執(zhí)法、司法人員而言,要證明某一已發(fā)生的案件的真實(shí)性,就需要他們廣泛收集案件事實(shí)發(fā)生整個(gè)過(guò)程中所產(chǎn)生的印記,這些印記存在于客觀世界和主觀世界之中,這些印記就是證據(jù),就是用來(lái)證明案件事實(shí)已經(jīng)發(fā)生及如何發(fā)生的依據(jù)。偵查人員在偵查過(guò)程中,要實(shí)現(xiàn)某個(gè)犯罪案件的現(xiàn)場(chǎng)重建,所依據(jù)的也是證據(jù)。本文首先從痕跡物證入手,因?yàn)榇_定案犯所留的痕跡物證是偵破案件、揭露和證實(shí)犯罪嫌疑人的重要依據(jù),2也是偵查再現(xiàn)的關(guān)鍵所在。 接著,基于現(xiàn)代刑事犯罪日趨智能化、有組織化,常規(guī)的偵查手段已不能滿足與刑事犯罪做斗爭(zhēng)的需要,在運(yùn)用傳統(tǒng)的偵查模式不能很好的對(duì)抗犯罪的時(shí)候,我們?cè)谠械膫刹榉椒ê褪侄紊闲枰行碌耐黄?而犯罪心理痕跡的分析對(duì)偵查再現(xiàn)則顯示出其愈益重要的作用,故本文以犯罪心理痕跡的分析為視角,著重分析了犯罪心理痕跡之于偵查再現(xiàn)的意義。 最后,基于偵查再現(xiàn)犯罪在實(shí)踐中所遇到的問(wèn)題和不足這樣一個(gè)事實(shí),故本文對(duì)偵查再現(xiàn)在實(shí)踐中的不足也作一膚淺的研究,從偵查再現(xiàn)的實(shí)務(wù)中分析偵查再現(xiàn)的關(guān)鍵點(diǎn)在于在現(xiàn)場(chǎng)勘查時(shí)收集證據(jù)要全面細(xì)致,加強(qiáng)對(duì)犯罪心理痕跡的分析,以及評(píng)價(jià)再現(xiàn)的標(biāo)準(zhǔn)應(yīng)該客觀合理。
[Abstract]:At present, the main research direction in the field of investigative research is mainly in investigation procedure, investigation means, investigation mechanism, and few studies on investigation and reproduction, even if there are only concepts and contents, and lack of systematic understanding. In fact, the investigation and reproduction crime is gradually becoming the expert and scholar of the investigation field. The reason is that the investigation and reproduction of crime is the process of the systematic application of logical method to the spot evidence of the scene, so as to reconstruct the crime scene comprehensively and systematically. It is precisely because of this, the author intends to take a perspective of evidence theory and criminal psychological trace to carry out a general investigation of criminal investigation and reproduction crime. Including and promotion.
This paper first sets up the basic methodology system of investigation and reproduction from the three theories of investigation and reproduction: information theory, system theory and cybernetics. First, criminal information is the basis and intermediary of the reappearance of investigation, and the premise and foundation of investigation decision. The whole process of investigation and reproduction can be said to be gathered around the collection. The information theory is to collect the related evidence of the crime. Therefore, the information theory is one of the basic theories of the investigation and reproduction. Secondly, the investigation itself is a systematic project, and the investigation and reproduction activity is a systematic project of collecting information, dealing with information and using information, and the whole crime is also a criminal act self. The systematic engineering of the main regulation, whether it is the investigation system or the criminal system, contains a number of subsystems. Again, the investigation and reproduction activities or the system control activities are full of the conflict of control and anti control in the whole reappearance of the investigation, the detection of cases in the confrontation and the realization of the investigation task of reproducing the crime. The viewpoint and method of cybernetics is of theoretical and practical significance in solving the problem of reappearance of investigation.
Then, this article takes the systematic analysis of the 1 theory of evidence as the breakthrough point, and analyzes the relationship between the evidence and the reappearance of the investigation. The significance of the evidence in the investigation stage and the whole criminal procedure is not the same. The evidence is the core of the whole procedure, whether it is in the investigation, procuratorial, or trial, and the law enforcement of the public inspection system, In order to prove the authenticity of a case that has been taken by the judiciary, it is necessary for them to collect the imprints produced in the whole process of the fact that the facts occur in the whole process. These imprints exist in the objective world and in the subjective world. These imprints are evidence, which are used to prove the fact that the case has occurred and how to take place. In the process of investigation, in order to realize the reconstruction of a crime case, the evidence is based on the evidence. Firstly, this article starts with the trace evidence, because it is the important basis for detecting and confirming the criminal suspect, and 2 is the key to the reconnaissance.
Then, based on the increasing intelligence and organization of modern criminal crime, the conventional means of investigation can not meet the needs of the struggle against criminal offences. When the traditional investigation mode is not good against the crime, we need new breakthrough in the original methods and means of investigation, and the analysis of criminal psychological traces is the key to the investigation. The investigation and reproduction shows its more important role, so this article focuses on the analysis of the criminal psychological trace, focusing on the significance of the criminal psychological trace to the investigation and reproduction.
Finally, based on the fact that criminal investigation and reproduction of crime encountered problems and shortcomings in practice, this paper makes a superficial study on the shortage of investigation and reproduction in practice. The key point of analyzing the reappearance of investigation in the practice of investigation and reproduction is that the evidence of the collection of evidence should be comprehensive and meticulous in the field investigation and the psychological trace of the crime is strengthened. The standard of analysis and evaluation and reproduction should be objective and reasonable.
