【摘要】：“重整羞恥理論”80年代由西方犯罪學(xué)者首倡,然而至今,西方犯罪學(xué)界對此的研究并未深入,國內(nèi)犯罪學(xué)界對此的研究更是空白。本文第一章是對該理論的本體進(jìn)行了解讀,意在使讀者對該理論的全貌有一個大概的了解。第二章是對該理論本土化的一系列問題進(jìn)行了思考,其中包括本土化的原因、本土化的有利與不利條件、本土化途徑的一些不成熟構(gòu)想以及本土化過程中筆者的一些擔(dān)心。 在本文第一章中,筆者從一個圖表入手,對該理論進(jìn)行了詳細(xì)的分解,明確了該理論最基本的主張便是:社區(qū)成員要積極參與向犯罪人進(jìn)行羞惡,使他們感到羞恥;并一致參與把犯罪人重整到守法公民之社區(qū)。當(dāng)社區(qū)成員通過這樣做而成為主要的犯罪控制者時,犯罪就最好地得到了控制。其次,筆者探討了該理論提出具有的幾方面重大意義:一是在刻板的法律之外尋求了一種新的犯罪控制乃至社會控制的策略,開辟了一種新的思維方式;二是在刑事法律方面,不僅倡導(dǎo)了一種積極的犯罪人概念,還形成了與恢復(fù)性司法互動的局面。本章的最后,筆者試著從心理學(xué)、動機(jī)沖突、類型犯罪及實證的角度論證了“重整羞恥理論”在犯罪控制乃至社會控制方面可發(fā)揮的功能,也是在論證下一章“重整羞恥理論”的本土化的意義所在。 本文第二章,主要是筆者這幾年來對“重整羞恥理論”本土化所
[Abstract]:The theory of recombining shame was initiated by western criminologists in the 1980s, but up to now, the research on it has not been thoroughly studied in the western criminologists, and the research on it has become a blank in the domestic criminologists. In the first chapter, the author interprets the ontology of the theory in order to make readers have a general understanding of the whole picture of the theory. The second chapter is to consider a series of problems of the localization of the theory, including the reasons of localization, the advantages and disadvantages of localization. In the first chapter of this paper, the author starts with a chart and decomposes the theory in detail. The most basic idea of the theory is that the community members should actively participate in the shame and evil to the criminals and make them feel ashamed, and participate unanimously in reorganizing the criminals into the community of law-abiding citizens. When community members do so and become the main crime controllers, crime is best controlled. Secondly, the author discusses the significance of the theory in several aspects: first, seeking a new strategy of crime control and even social control in addition to the rigid law, opening up a new way of thinking; second, in the criminal law, Not only advocated a positive concept of offenders, but also formed a situation of interaction with restorative justice. At the end of this chapter, the author tries to demonstrate the function of the theory of "reforming shame" in crime control and even social control from the angle of psychology, motive conflict, type crime and demonstration. The second chapter of this paper is mainly about the localization of the theory of regrouping shame in the past few years.
