【摘要】： 由于警察的特殊社會角色,襲警犯罪從表面上看所侵害的對象是警察個體,而實質上是嚴重損害了國家的法律權威。一旦這種權威被公然挑戰(zhàn),國家法律將面臨無法執(zhí)行的危險,一方面導致公眾對違法犯罪產生難以遏止的內心恐懼,甚至引發(fā)公民對法律秩序喪失信心,作為人民的保護者,自身安全就得不到保障,他如何保護人民呢?整個社會就有可能陷入混亂無序的狀態(tài)。從另一方面則可能助長暴力抗法的不良風氣,嚴重阻礙了警察執(zhí)行懲治違法犯罪、維護社會治安的職務行為,使警察士氣受挫,對社會治安產生嚴重的消極影響。襲警犯罪案件頻發(fā)引起社會的極大關注,也使人們警覺到該行為對警察權益的侵害和對國家警察權威的挑戰(zhàn)已經到了非常嚴重的地步。學界近幾年才開始從不同角度對襲警現(xiàn)象展開探討,成果多見于一些報紙和期刊上的論文。作為一名從警十五年的警察,筆者對襲警犯罪尤為關注,并對這幾年來關于這方面的材料收集整理,這里針對近年來襲警犯罪的種種形態(tài),從犯罪學的角度,先是對襲警犯罪現(xiàn)象及特征做出分析,認為襲警犯罪具有侵害對象的特殊性、犯罪的暴力性、伴生性、危害的嚴重性等特征;接著從受害人、犯罪人、社會三個不同方面探討襲警犯罪的原因及相關因素;最后在國內外對襲警犯罪防控對策比較研究的基礎上,提出合理的防控對策。主要對策有:增強自我保護意識,提高自身防范素質;夯實社區(qū)警務建設,加強社會治安防范;促進保安業(yè)發(fā)展,增強警察防御系數(shù);加強公共關系建設,改善警察執(zhí)法環(huán)境;嚴厲打擊襲警犯罪及其它伴生性犯罪,加大打擊力度等。同時,鑒于立法防控的重要性,對是否在刑法中設立“襲警罪”進行了單獨的探討,并對防控襲警犯罪活動中的幾個基本問題進行厘清,以便執(zhí)行防控措施。
[Abstract]:Because of the special social role of the police, the crime of attacking the police is the individual of the police on the surface, but in fact it seriously damages the legal authority of the state. Once this authority is flagrantly challenged, national laws will be in danger of being unenforceable, leading on the one hand to an unstoppable fear of crime and lawlessness, and even causing citizens to lose confidence in the legal order and to act as protectors of the people, His own safety is not guaranteed. How can he protect the people? The whole society is likely to fall into a state of chaos and disorder. On the other hand, it may encourage the bad atmosphere of violence and resistance to the law, seriously hinder the police from carrying out the punishment of illegal crimes, maintain the duty behavior of public security, make the police morale frustrated, and have serious negative influence on the social security. The frequent crime of attacking the police has aroused great concern of the society, and has also made people aware that the behavior infringes on the rights and interests of the police and challenges the authority of the national police to a very serious extent. In recent years, academic circles began to probe into the phenomenon of attacking police from different angles, and the results are often found in some papers in newspapers and periodicals. As a policeman for fifteen years, the author pays particular attention to the crime of attacking the police, and collects and collates the materials in this respect in the past few years. In view of the various forms of crimes committed against the police in recent years, from the perspective of criminology, First of all, by analyzing the phenomenon and characteristics of the crime of attacking the police, the author thinks that the crime of attacking the police has the particularity of the target, the violence of the crime, the accretion of the crime, the seriousness of the harm, and so on; then, from the victim, the criminal, the criminal, At last, on the basis of comparative study on crime prevention and control at home and abroad, the author puts forward reasonable prevention and control countermeasures. The main countermeasures are: strengthening self-protection consciousness, improving self-defense quality; ramming up the construction of community policing, strengthening social security prevention, promoting the development of security industry, strengthening police defense coefficient, strengthening the construction of public relations, improving the police law enforcement environment; Severely crack down on the crime of assault on police and other associated sexual crimes, and intensify the crackdown. At the same time, in view of the importance of legislative prevention and control, this paper makes a separate discussion on whether to establish the crime of attacking police in the criminal law, and clarifies several basic problems in the crime of preventing and controlling the police in order to carry out the preventive measures.
