【摘要】： 非現(xiàn)場執(zhí)法是公安機(jī)關(guān)交通管理部門在行使道路交通安全管理職權(quán)過程中采取的一種執(zhí)法方式，是利用現(xiàn)代化科學(xué)技術(shù)手段對交通違章行為實施數(shù)碼圖像記錄，通過計算機(jī)信息網(wǎng)絡(luò)進(jìn)行保全，事后進(jìn)行查處的交通管理方式。由于目前我國道路交通管理非現(xiàn)場執(zhí)法的應(yīng)用尚處于初始階段，深入研究相關(guān)的行政法問題，，對于行政法的理論研究和實踐發(fā)展都具有重要的意義。本文主要從行政法的視角，在理論和實踐兩個方面探討非現(xiàn)場執(zhí)法相關(guān)的法律問題。 正文第一章對非現(xiàn)場執(zhí)法的基本內(nèi)涵與法律屬性特征進(jìn)行了闡述，明晰了有關(guān)概念，從合法性角度對非現(xiàn)場執(zhí)法進(jìn)行了分析。第二章分析了非現(xiàn)場執(zhí)法的制度價值，闡述了非現(xiàn)場執(zhí)法行為在保障道路交通安全秩序、養(yǎng)成依法通行的法律文化、提高主管機(jī)關(guān)行政效能等方面的法律價值。第三章從法律和實務(wù)兩個層面分析了目前在交警非現(xiàn)場執(zhí)法過程中存在的一些問題，其中法律層面包括立法、執(zhí)法、司法方面的缺陷和困惑，重點是執(zhí)法行為的合法性及合理性方面存在的問題；實務(wù)層面主要從執(zhí)法環(huán)境、執(zhí)法監(jiān)督、隊伍建設(shè)、交通基礎(chǔ)設(shè)施落后、科技手段制約等實際操作方面出現(xiàn)的問題及缺陷來進(jìn)行闡述。第四章針對交警非現(xiàn)場執(zhí)法中存在的問題提出相應(yīng)的解決對策，并就改進(jìn)與完善我國道路交通管理非現(xiàn)場執(zhí)法提出了有關(guān)思考與建議。
[Abstract]:Off-site law enforcement is a law enforcement method adopted by the traffic management department of public security organs in the course of exercising the power of road traffic safety management. It uses modern scientific and technological means to record traffic violations with digital images. Through the computer information network preservation, after the investigation and punishment of traffic management. Since the application of off-site law enforcement of road traffic management in China is still in its initial stage, it is of great significance for the theoretical research and practical development of administrative law to deeply study the related administrative law issues. From the perspective of administrative law, this paper discusses the related legal problems in both theory and practice. The first chapter expounds the basic connotation and legal attributes of off-site law enforcement, clarifies the relevant concepts, and analyzes the off-site law enforcement from the perspective of legality. The second chapter analyzes the system value of off-site law enforcement, and expounds the legal value of off-site law enforcement in ensuring road traffic safety order, cultivating legal culture of passing according to law, and improving the administrative efficiency of competent authorities. The third chapter analyzes some problems existing in the off-site law enforcement process of traffic police from the two aspects of law and practice, in which the legal level includes the defects and puzzles in the aspects of legislation, law enforcement and administration of justice. The focus is on the legitimacy and reasonableness of the law enforcement, and mainly from the aspects of the law enforcement environment, the law enforcement supervision, the construction of the team, and the backward transportation infrastructure. The technical means restrict and so on the practical operation aspect appears the question and the flaw carries on the elaboration. The fourth chapter puts forward the corresponding solutions to the problems existing in the off-site law enforcement of traffic police, and puts forward some thoughts and suggestions to improve and perfect the off-site law enforcement of road traffic management in China.
