【摘要】： 司法鑒定機構(gòu)制度是司法鑒定機構(gòu)運行的規(guī)程或行動準則,是司法鑒定制度的重要組成部分,它直接體現(xiàn)并影響著司法鑒定管理體制的格局與模式,因此在整個司法鑒定制度改革中,規(guī)范并設置好司法鑒定機構(gòu)制度將會對整個司法鑒定制度的改革產(chǎn)生積極的作用。本文在考察我國建國以來司法鑒定機構(gòu)改革的歷史與現(xiàn)狀的基礎上,反思了導致目前我國司法鑒定機構(gòu)制度混亂狀況的原因和有關改革的一些認識誤區(qū),分析了兩大法系主要國家存在的兩大類型司法鑒定機構(gòu)制度以及對我國司法鑒定機構(gòu)制度改革發(fā)展的借鑒,提出了在我國建立單軌制多元分散的司法鑒定機構(gòu)制度,及其基本的架構(gòu)與一些具體的制度設計。針對公安司法機關和檢察機關內(nèi)部設立的鑒定機構(gòu),從既能保證偵查、檢察工作需要出發(fā),又要保持其鑒定機構(gòu)的客觀中立性角度探討了其機構(gòu)改革的一些設想。通過本文的探討,希望能對我國司法鑒定機構(gòu)制度的改革與發(fā)展獻計獻策。
[Abstract]:The institution system of judicial expertise is a procedure or a standard of action for the operation of a judicial identification institution. It is an important part of the judicial identification system. It directly reflects and influences the pattern and pattern of the judicial expertise management system. Therefore, in the whole reform of judicial expertise system, standardizing and setting up the system of judicial expertise institution will play a positive role in the reform of the whole judicial expertise system. Based on the investigation of the history and present situation of the reform of judicial expertise institutions since the founding of the people's Republic of China, this paper reflects on the causes of the confusion in the system of judicial expertise institutions in our country and some misunderstandings about the reform. This paper analyzes the two types of judicial expertise institution systems in the main countries of the two major legal systems and draws lessons from the reform and development of the judicial expertise institution system in our country, and puts forward the establishment of the monorail system of the multi-dispersed judicial expertise institution system in our country. And its basic structure and some specific system design. In view of the establishment of appraisal institutions within the public security judicial organs and procuratorial organs, this paper probes into some ideas of the institutional reform from the point of view of not only guaranteeing the investigation and the need of procuratorial work, but also maintaining the objective neutrality of its appraisal organs. Through the discussion of this paper, the author hopes to offer suggestions for the reform and development of the system of judicial expertise in China.
