【摘要】：盡管犯罪模式痕跡在學(xué)術(shù)上沒有明確的界定,但是其在犯罪現(xiàn)場(chǎng)分析過程中的實(shí)踐應(yīng)用由來已久,并且相關(guān)的經(jīng)驗(yàn)體會(huì)也經(jīng)常見諸于專業(yè)論著之中。犯罪模式痕跡研究范疇的提出,正是我們以科學(xué)的方法論作指導(dǎo),采用更多種類與更多視角的研究方法,實(shí)現(xiàn)揭示犯罪規(guī)律目的的必然。實(shí)踐已證明,犯罪模式痕跡是現(xiàn)場(chǎng)勘查技術(shù)實(shí)施過程中,偵查人員進(jìn)行現(xiàn)場(chǎng)分析的重要依據(jù)。在串并案件、縮小偵查范圍、確定案件性質(zhì)等方面,均具有非常顯著的作用。全文除了引言和結(jié)論外,共分四個(gè)部分。第一部分是犯罪模式痕跡概述。該部分在解析犯罪模式痕跡主要構(gòu)成的基礎(chǔ)上,確定了犯罪模式痕跡的內(nèi)涵和外延。第二部分是犯罪模式痕跡的基礎(chǔ)理論。動(dòng)力定型原理和同一認(rèn)定原理是刑事科學(xué)技術(shù)普遍應(yīng)用的兩個(gè)原理。人的任何一種活動(dòng)習(xí)慣都是動(dòng)力定型的一種表現(xiàn)。動(dòng)力定型形成以后,當(dāng)這個(gè)系統(tǒng)不斷的被重復(fù)強(qiáng)化,就會(huì)更加穩(wěn)固,形成“自動(dòng)化”的行為。由于有些犯罪嫌疑人會(huì)不斷作案,所以在其反復(fù)實(shí)施作案活動(dòng)的過程中養(yǎng)成了穩(wěn)固的犯罪習(xí)慣,形成了犯罪動(dòng)力定型機(jī)制。動(dòng)力定型的穩(wěn)定性反映在其是按照固定程序運(yùn)行的模式,鑒于這種獨(dú)特的穩(wěn)定性,犯罪模式痕跡可以作為同一認(rèn)定的依據(jù)。第三部分是犯罪行為習(xí)慣痕跡,是犯罪模式痕跡的組成部分之一。由于個(gè)體受遺傳因素和社會(huì)環(huán)境因素的相互影響,每個(gè)人都會(huì)存在差異性。同時(shí),由于長(zhǎng)時(shí)間的行為動(dòng)作和生活習(xí)慣會(huì)養(yǎng)成一種思維定勢(shì)和行為習(xí)慣定勢(shì),犯罪嫌疑人在實(shí)施犯罪活動(dòng)時(shí)也會(huì)反映出這種特性。犯罪模式痕跡在主客觀因素的作用下,所形成的行為習(xí)慣具有鮮明的獨(dú)特性、穩(wěn)定性和反映性。通過對(duì)犯罪模式痕跡的解讀,可以分析出犯罪嫌疑人的個(gè)體生理差異和職業(yè)技術(shù)特征。第四部分是犯罪心理痕跡。研究犯罪心理痕跡,即在探討犯罪心理支配下的犯罪現(xiàn)場(chǎng)構(gòu)成的核心要素—犯罪行為,即在探討通過犯罪行為所表現(xiàn)出來的犯罪嫌疑人的心理狀態(tài)以及這種心理狀態(tài)所表現(xiàn)出來的犯罪動(dòng)機(jī)和目的。犯罪心理痕跡同樣也是犯罪模式痕跡的研究?jī)?nèi)容。本章首先探討了犯罪心理的產(chǎn)生、犯罪預(yù)備以及實(shí)施等犯罪心理外化成犯罪行為的過程,之后基于犯罪現(xiàn)場(chǎng)的物質(zhì)痕跡是犯罪心理分析的基礎(chǔ),通過對(duì)犯罪物質(zhì)痕跡的分析進(jìn)一步解讀犯罪模式痕跡。
[Abstract]:Although there is no clear academic definition of the trace of crime pattern, its practical application in the process of crime scene analysis has a long history, and the relevant experience is often found in professional works. It is the necessity for us to use more kinds of research methods and more angles of view to realize the purpose of revealing the law of crime under the guidance of scientific methodology. It has been proved by practice that the trace of crime pattern is an important basis for investigators to carry out scene analysis in the process of carrying out scene investigation technology. In serial cases, narrow the scope of investigation, determine the nature of cases, have a very significant role. In addition to the introduction and conclusions, the full text is divided into four parts. The first part is an overview of the pattern of crime. On the basis of analyzing the main components of the criminal pattern trace, this part determines the connotation and extension of the criminal pattern trace. The second part is the basic theory of criminal pattern trace. The principle of dynamic stereotyping and the principle of identical recognition are two principles that are widely used in criminal science and technology. Any kind of activity habit of human being is a kind of manifestation of dynamic stereotype. As the system is repeatedly reinforced, the system becomes more stable and forms an "automated" behavior. Because some suspects will continue to commit crimes, so in their repeated implementation of criminal activities in the process of forming a solid criminal habit, forming a criminal motive force stereotype mechanism. The stability of dynamic stereotyping is reflected in the mode of running according to the fixed procedure. In view of this unique stability, the trace of criminal pattern can be regarded as the basis of the same identification. The third part is the trace of criminal behavior, which is one of the components of the pattern of crime. Because individuals are influenced by genetic factors and social environmental factors, there are differences among individuals. At the same time, due to the long time behavior and life habits will form a set of thinking and behavior habits, criminal suspects in the implementation of criminal activities will also reflect this characteristic. Under the action of subjective and objective factors, the behavior habit formed by the criminal pattern trace has distinct uniqueness, stability and reflection. Through the interpretation of the trace of the crime pattern, we can analyze the individual physiological difference and the professional and technical characteristics of the suspect. The fourth part is the trace of criminal psychology. Studying the trace of criminal psychology, that is, the core element of the crime scene under the domination of criminal psychology, that is, criminal behavior, That is to explore the psychological state of the criminal suspect and the motive and purpose of the crime. The criminal psychological trace is also the research content of the criminal pattern trace. This chapter first discusses the process of criminal psychological externalization into criminal behavior, such as the emergence of criminal psychology, the preparation of crime and the implementation of criminal psychology, and then the material trace based on the crime scene is the basis of the analysis of criminal psychology. Through the analysis of the material trace of crime, the author further interprets the trace of the crime pattern.
