【摘要】： 城市公交扒竊犯罪是指以非法占有為目的,在城市公共交通工具上或公交乘車候車場所,乘被害人不備之機,通過采用手掏、劃包、夾取、剪取等秘密手段竊取他人隨身攜帶財物的犯罪行為。 城市公交扒竊犯罪是盜竊犯罪的一種特殊形式,是技術(shù)性較強的智能型犯罪,針對的是不特定的多數(shù)乘客,作案頻繁、被害人數(shù)多,擾亂社會秩序。如果不能得到有效遏制,將嚴重影響人民群眾的生活安全感和城市文明形象,使公安機關(guān)打擊犯罪、保護人民的執(zhí)法形象受損,人民群眾對黨和政府執(zhí)政能力信任度降低。 隨著時代發(fā)展,城市公交扒竊犯罪呈現(xiàn)新的狀況、特點,主要是:發(fā)案數(shù)逐年增長,犯罪組織集團化、網(wǎng)絡(luò)化,扒竊人員跨區(qū)域流竄作案程度加大反偵查意識增強,結(jié)構(gòu)呈低齡化,特殊人員、女性比例不斷增大,混合型犯罪增多,公交站點的車下扒竊發(fā)案增多,發(fā)案時空具有明顯規(guī)律,侵害目標選擇具有較明顯的針對性,破案難度加大,扒竊犯罪主體特點突出。 此類案件多發(fā)原因包括立法和司法面臨的困境、社會原因、犯罪主體因素、被害人因素等多方面。 基于其特性,對城市公交扒竊犯罪的綜合治理應(yīng)遵循“懲罰與預(yù)防相結(jié)合、重在預(yù)防”、“人防與技防并重,強化防范手段”、“齊抓共管,落實措施”的指導(dǎo)思想。完善刑事立法,加大對組織利用聾啞人、未成年犯罪的懲處力度,規(guī)范對聾啞人扒竊犯罪的量刑,建立有力打擊懲處扒竊犯罪工作機制,加強對扒竊人員的教育、改造及安置,加大宣傳力度,調(diào)動社會力量防扒反扒,加強青少年和聾啞人教育,完善社會保障,全面打擊和預(yù)防扒竊犯罪。
[Abstract]:The crime of urban public transport pickpocketing refers to the crime of taking advantage of the unprepared opportunity of the victim on the city public transport or the bus waiting place for the bus, with the purpose of illegal possession, by using the hand to pull out, draw the bag, and pick it up. The criminal act of stealing other people's belongings by secret means such as clipping. Urban public transportation pickpocketing is a special form of theft, which is a kind of intelligent crime with strong technology. It is aimed at the majority of passengers, who commit crimes frequently, the number of victims is many, and the social order is disturbed. If it cannot be effectively contained, it will seriously affect the people's sense of security in life and the image of urban civilization, make the public security organs crack down on crime, protect the people's image of enforcing the law, and reduce the people's trust in the Party and the government's governing ability. With the development of the times, the urban public transportation pickpocketing crime presents a new situation, the characteristics of which are: the number of criminal cases increases year by year, the criminal organizations are grouped, the network, the degree of movement of pickpocketing personnel across the region increases the awareness of anti-investigation. The structure is younger, the proportion of special personnel, female is increasing, the proportion of mixed crime is increasing, the number of pickpocketing cases under the bus station is increasing, the time and space of the crime is obviously regular, the choice of the target of infringement has obvious pertinence, and the difficulty of solving the crime is increasing. The main features of pickpocketing crime are prominent. The reasons include the predicament of legislation and judicature, the social reason, the main factor of crime, the factor of victim and so on. Based on its characteristics, the comprehensive management of urban public transport pickpocketing crime should follow the guiding ideology of "combination of punishment and prevention, emphasis on prevention", "equal emphasis on civil air defense and technical prevention, strengthening preventive means" and "joint management and implementation of measures". To improve criminal legislation, to increase the punishment for the organization of the use of deaf and mute persons and juvenile crimes, to standardize the sentencing of crimes committed by deaf and mute persons, to establish a working mechanism capable of cracking down on pickpocketing crimes, and to strengthen the education, reform and placement of pickpocketing personnel. We should step up publicity, mobilize social forces to prevent pickpockets, strengthen the education of young people and deaf and mute people, improve social security, and comprehensively crack down on and prevent pickpocketing.
