【摘要】： 本文在犯罪學(xué)意義上從黑社會(性質(zhì))組織的概念、黑社會性質(zhì)組織與黑社會組織的區(qū)別入手，，通過對我國刑法規(guī)定的分析從與黑社會(性質(zhì))組織自身直接相關(guān)的犯罪和有組織犯罪集團(tuán)所實(shí)施的犯罪行為兩個方面界定了黑社會性質(zhì)犯罪案件的概念。從組織結(jié)構(gòu)、經(jīng)濟(jì)實(shí)力、非法保護(hù)和社會危害等四個方面概括了黑社會性質(zhì)犯罪的特征。簡要闡述了黑社會性質(zhì)犯罪的分類原則以及以不同標(biāo)準(zhǔn)對黑社會性質(zhì)犯罪的分類。研究分析黑社會性質(zhì)犯罪在我國發(fā)展的階段及特點(diǎn)，從而揭示出黑社會性質(zhì)犯罪向黑社會轉(zhuǎn)化、對經(jīng)濟(jì)領(lǐng)域和社會的控制、向政治領(lǐng)域滲透和國際化趨勢的四個變化趨勢。文章重點(diǎn)從社會結(jié)構(gòu)和經(jīng)濟(jì)結(jié)構(gòu)、社會制約的相對弱化、政治腐敗、立法的相對滯后、亞文化的作用、境外黑社會組織的滲透六個方面分析黑社會性質(zhì)犯罪的成因，提出并構(gòu)建了我國黑社會性質(zhì)犯罪的宏觀和微觀預(yù)防、文化控制、刑事立法對策、刑法懲罰和教育對策等五個方面的預(yù)防控制體系及預(yù)警機(jī)制。
[Abstract]:In the sense of criminology, this paper starts with the concept of underworld (nature) organization, the difference between underworld organization and underworld organization. Through the analysis of the criminal law of our country, this paper defines the concept of the criminal case of the underworld nature from two aspects: the crime directly related to the underworld (nature) organization and the criminal act committed by the organized criminal group. This paper summarizes the characteristics of underworld crime from four aspects: organizational structure, economic strength, illegal protection and social harm. This paper briefly expounds the classification principle of underworld crime and the classification of underworld crime with different standards. This paper studies and analyzes the stage and characteristics of the underworld crime in our country, thus reveals four changing trends of the transformation from the underworld crime to the underworld, the control of the economic field and the society, the infiltration into the political field and the trend of internationalization. The article analyzes the causes of underworld crime from six aspects: social structure and economic structure, relative weakening of social constraints, political corruption, relative lag of legislation, the role of subculture, infiltration of overseas triad organizations. This paper puts forward and constructs the prevention and control system and early warning mechanism in five aspects: macro and micro prevention, cultural control, criminal legislation, punishment of criminal law and educational countermeasures.
