【摘要】：森林公安是國(guó)家設(shè)立在林業(yè)系統(tǒng)，具有武裝性質(zhì)的治安行政和刑事執(zhí)法力量。在公安機(jī)關(guān)內(nèi)部及警察學(xué)、公安學(xué)研究中，習(xí)慣將其稱為專業(yè)公安機(jī)關(guān)。與鐵路、交通、民航公安等專業(yè)公安機(jī)關(guān)一樣，，森林公安的建立與發(fā)展有其特定的歷史背景，但隨著市場(chǎng)經(jīng)濟(jì)體制的建立，國(guó)家行政管理體制改革的深入，森林公安暴露出較多與其職能不相適應(yīng)的弊端與缺陷。究其根源，還得從森林公安現(xiàn)行體制中尋找答案。 本文從森林公安建立、發(fā)展入手，分析現(xiàn)行管理體制之缺陷，結(jié)合介紹國(guó)外森林警察概況，提出改革與完善森林公安現(xiàn)行體制的目標(biāo)與構(gòu)想。全文由引言和六大部分組成，引言提出文章寫作的目的、意義和主要內(nèi)容；第一部分是森林公安的歷史沿革。從古代森林警察的雛形，到新中國(guó)成立前森林警察的創(chuàng)立，理清森林公安建立與發(fā)展的脈絡(luò)；第二部分是森林公安現(xiàn)行體制介紹。包括森林公安的任務(wù)、職能、設(shè)置、管轄與管理體制；第三部分是森林公安現(xiàn)行體制缺陷。詳細(xì)分析了現(xiàn)行體制下森林公安諸多缺陷與弊端；第四部分是境外、國(guó)外森林警察概況。介紹了我國(guó)臺(tái)灣地區(qū)和意大利森林警察的基本情況，以及從中得到的有益啟示；第五部分是改革和完善森林公安的必要性和重要性。簡(jiǎn)介森林具有的重要經(jīng)濟(jì)、生態(tài)價(jià)值，以及我國(guó)森林資源特點(diǎn)，分析破壞森林和野生動(dòng)、植物資源違法犯罪的現(xiàn)狀，結(jié)合縱向、橫向比較與借鑒，論證改革和完善森林公安的重要性和必要性；第六部分是森林公安的改革構(gòu)想。按照建立符合統(tǒng)一人民警察體制的要求、警察權(quán)力的配置原則等思路，提出改變現(xiàn)行森林公安雙重領(lǐng)導(dǎo)體制，將森林公安從林業(yè)行政部門和森工企業(yè)的管理中剝離出來(lái)，以及關(guān)于改革森林公安機(jī)構(gòu)設(shè)置、編制、經(jīng)費(fèi)保障等的對(duì)策與思考。
[Abstract]:Forest public security is a state established in the forestry system, armed with the nature of public security administration and criminal law enforcement forces. In the study of public security organs and the study of police science, it is customary to call them professional public security organs. Like professional public security organs such as railways, traffic and civil aviation, the establishment and development of forest public security has its specific historical background. However, with the establishment of the market economy system and the deepening of the reform of the state administration system, The forest public security has exposed many disadvantages and defects which are not suitable for its functions. Investigate its root, still have to look for an answer from forest public security current system. Starting with the establishment and development of forest public security, this paper analyzes the defects of the current management system, introduces the general situation of foreign forest police, and puts forward the goal and conception of reforming and perfecting the present system of forest public security. The full text consists of introduction and six parts, the introduction puts forward the purpose, significance and main content of the article writing; the first part is the historical evolution of the forest public security. From the embryonic form of the ancient forest police to the establishment of the forest police before the founding of New China, this paper clarifies the context of the establishment and development of the forest public security; the second part is the introduction of the present system of the forest public security. It includes the tasks, functions, establishment, jurisdiction and management system of the forest public security; the third part is the defects of the present system of the forest public security. The fourth part is the general situation of foreign forest police. This paper introduces the basic situation of forest police in Taiwan and Italy and the beneficial enlightenment from it. The fifth part is the necessity and importance of reforming and perfecting forest public security. This paper briefly introduces the important economic and ecological value of forest, as well as the characteristics of forest resources in China, analyzes the present situation of illegal and criminal activities of destroying forest, wild animals and plants, and combines vertical, horizontal comparison and reference. The sixth part is the reform conception of forest public security. In accordance with the idea of establishing a unified people's police system and the principle of the allocation of police power, it is proposed to change the current dual leadership system of forest public security, and to separate the forest public security from the management of forestry administrative departments and forest industrial enterprises. And about the reform forest public security organization establishment, the funds guarantee and so on the countermeasure and the ponder.
