【摘要】：社區(qū)矯正,是一種不使罪犯與社會隔離并利用社區(qū)資源改造罪犯的方法,是所有在社區(qū)環(huán)境中管理教育罪犯方式的總稱。它是刑罰執(zhí)行制度由嚴(yán)趨寬的國際趨勢的體現(xiàn),也是非監(jiān)禁刑逐步取代監(jiān)禁刑占主導(dǎo)地位的國際行刑趨勢的主要標(biāo)志之一。社區(qū)矯正制度起源于英美等西方國家,在英美等西方國家已是一項比較成熟發(fā)達(dá)的制度。目前在我國北京、上海等地對被判處管制、宣告緩刑、裁定假釋、暫予監(jiān)外執(zhí)行和剝奪政治權(quán)利的5類罪犯正在進(jìn)行社區(qū)矯正試點工作。為何社區(qū)矯正能夠在國內(nèi)外大行其道、具有如此強的生命力,社區(qū)矯正有著什么樣的價值和理論基礎(chǔ)等諸多問題是值得探討的,本文即旨在分析社區(qū)矯正這一非監(jiān)禁措施的價值基礎(chǔ)和理論基礎(chǔ)。 本文由引言和三章組成。 第一章是社區(qū)矯正的內(nèi)涵問題。通過對國內(nèi)外不同社區(qū)矯正概念的介紹和比較分析,筆者發(fā)現(xiàn)盡管社區(qū)矯正的概念眾多,但是他們有著相同之處:強調(diào)刑罰執(zhí)行場所與執(zhí)行主體的變更:監(jiān)獄——社區(qū);國家司法機關(guān)——社會(區(qū))力量。同時,筆者指出,廣義和狹義上的社區(qū)矯正區(qū)別在于適用對象不同。另外,介紹了一些與社區(qū)矯正相關(guān)的概念。 第二章是社區(qū)矯正的理論基礎(chǔ)問題。任何事物背后總有一定的理論基礎(chǔ)作為支撐,只有認(rèn)識了事物的理論基礎(chǔ)才能從更深層次上全面認(rèn)識事物。通過分析,筆者發(fā)現(xiàn)社區(qū)矯正的出現(xiàn)并不是偶然,其背后有著深厚的理論基礎(chǔ)。這不僅體現(xiàn)在刑事政策、監(jiān)禁刑弊端、行刑目的上,而且行刑社會化、恢復(fù)性司法等新理論的出現(xiàn)也進(jìn)一步促進(jìn)了社區(qū)矯正的誕生。 第三章是社區(qū)矯正的價值基礎(chǔ)問題。價值分析在法學(xué)研究中具有重要地
[Abstract]:Community correction is a method of not separating criminals from society and using community resources to reform criminals. It is a general name of all the ways of managing and educating criminals in the community environment. It is the embodiment of the international trend of penalty enforcement system from strictness to broadness, and it is also one of the main symbols of the international execution trend in which non-custodial punishment gradually replaces imprisonment penalty. Community correction system originated from western countries, such as the United States and the United States, and has become a relatively mature and developed system in western countries such as the United States and the United States. At present, in Beijing and Shanghai, five kinds of criminals who have been sentenced to control, suspended, ordered on parole, temporarily executed outside prison and deprived of political rights are carrying out community correction pilot work. Why can community correction be popular at home and abroad, with such strong vitality, what kind of value and theoretical basis community correction has is worth discussing, The purpose of this paper is to analyze the value and theoretical basis of community correction. This paper consists of introduction and three chapters. The first chapter is the connotation of community correction. Through the introduction and comparative analysis of different concepts of community correction at home and abroad, the author finds that although there are many concepts of community correction, they have the same points: emphasizing the change between the place of execution of punishment and the subject of execution: prison-community; State judicial organs-social (regional) forces. At the same time, the author points out that the difference between broad sense and narrow sense lies in the difference of applicable object. In addition, some concepts related to community correction are introduced. The second chapter is the theoretical basis of community correction. There is always a certain theoretical basis behind anything. Only when we know the theoretical basis of things can we fully understand things at a deeper level. Through analysis, the author found that the emergence of community correction is not accidental, behind which there is a deep theoretical basis. This is not only reflected in the criminal policy, the malpractice of imprisonment, the purpose of execution, but also the socialization of execution, restorative justice and other new theories have further promoted the birth of community correction.
