【摘要】：職務(wù)犯罪，是在我國(guó)改革開放后的體制轉(zhuǎn)軌過程中出現(xiàn)的一類多發(fā)性犯罪，是我國(guó)在社會(huì)轉(zhuǎn)型時(shí)期出現(xiàn)的腐敗現(xiàn)象的最為極端的反映。它不僅會(huì)嚴(yán)重的危及公權(quán)力的運(yùn)行秩序，而且還極易造成社會(huì)的不穩(wěn)定，從而阻礙我國(guó)社會(huì)主義現(xiàn)代化建設(shè)和中華民族偉大復(fù)興的進(jìn)程。因此，近年來，社會(huì)各界采取了相應(yīng)的措施，加大了對(duì)職務(wù)犯罪的防范與打擊力度。同時(shí)，有關(guān)職務(wù)犯罪的各種理論研究文章也如雨后春筍般涌現(xiàn)，這些理論研究成果不僅加深了我們對(duì)職務(wù)犯罪的進(jìn)一步認(rèn)識(shí)，而且還有力的推動(dòng)了有關(guān)職務(wù)犯罪的立法與司法進(jìn)程。但是，理論界和司法界的同仁對(duì)職務(wù)犯罪的研究主要是從我國(guó)社會(huì)的整體與宏觀著眼，尚缺乏從某一特定的層面或角度對(duì)該問題的專門性、深入性的論述。作為一名長(zhǎng)期在基層檢察院從事檢察工作的檢察人員，筆者認(rèn)為我們十分有必要對(duì)基層的情況做一研究總結(jié)。因此，本論文的視角就主要限定在兩方面：第一，以基層這一特定社會(huì)結(jié)構(gòu)層面為考察范圍：第二，以最為典型的——經(jīng)濟(jì)型職務(wù)犯罪作為研究對(duì)象。 在本論中，作者主要運(yùn)用實(shí)證研究和社會(huì)學(xué)的方法就什么是基層經(jīng)濟(jì)型職務(wù)犯罪、它有何特點(diǎn)；我國(guó)現(xiàn)階段基層經(jīng)濟(jì)職務(wù)犯罪的現(xiàn)狀是怎樣的，其中包括城市現(xiàn)狀以及農(nóng)村現(xiàn)狀；基層經(jīng)濟(jì)型職務(wù)犯罪的原因及危害；我國(guó)在防范、打擊(基層經(jīng)濟(jì)型)職務(wù)犯罪方面的現(xiàn)狀與不足；以及我們應(yīng)當(dāng)怎樣構(gòu)筑一套合理且有效的預(yù)防與打擊(基層經(jīng)濟(jì)型)職務(wù)犯罪的機(jī)制等問題加以了研究與總結(jié)。此外，由于檢察機(jī)關(guān)在防范與打擊職務(wù)犯罪方面承擔(dān)著專門的職能，，再加上作者工作身份的特殊性和思維習(xí)慣的慣性，因此對(duì)此問題的關(guān)注更多的是從檢察工作著眼，并重點(diǎn)探討了(基層)檢察機(jī)關(guān)在預(yù)防和控制基層職務(wù)犯罪方面應(yīng)當(dāng)進(jìn)行的改革工作。
[Abstract]:Job-related crime is a kind of multiple crimes in the process of system transition after reform and opening up in China. It is the most extreme reflection of corruption in the period of social transformation. It not only seriously endangers the running order of public power, but also easily causes social instability, thus hindering the process of socialist modernization construction and the great rejuvenation of the Chinese nation. Therefore, in recent years, all walks of life have taken corresponding measures to step up the prevention and crackdown on job-related crimes. At the same time, various theoretical studies on job-related crimes have sprung up. These theoretical research results not only deepen our understanding of job-related crimes, It also promotes the legislative and judicial process of duty crime. However, the research on job-related crime in the theoretical and judicial circles is mainly focused on the whole and macroscopical aspects of our society, and there is still a lack of special and in-depth discussion on this issue from a specific level or angle. As a procurator engaged in procuratorial work in grass-roots procuratorates for a long time, I think it is very necessary for us to do a research and summary on the situation at the grass-roots level. Therefore, the perspective of this paper is mainly limited to two aspects: first, the grass-roots level of the specific social structure as the scope of investigation; second, the most typical-economic duty crime as the research object. In this theory, the author mainly uses the methods of empirical research and sociology on what is the basic-level economic job-related crime, what is its characteristics, and what is the present situation of the basic-level economic job-related crime in our country. It includes the present situation of the city and the countryside, the cause and harm of the economic duty crime at the grass-roots level, the present situation and the insufficiency of our country in preventing and cracking down on the duty crime at the grass-roots level. And how should we construct a set of reasonable and effective mechanism to prevent and combat (grass-roots economic type) job-related crime and so on are studied and summarized. In addition, due to the special functions of procuratorial organs in preventing and cracking down on job-related crimes, coupled with the particularity of the author's working identity and the inertia of his thinking habits, more attention has been paid to this issue from the perspective of procuratorial work. The reform of the procuratorial organ in preventing and controlling the crime of duty at the basic level is discussed emphatically.
