【摘要】： 職務犯罪是腐敗現(xiàn)象最集中、最嚴重的表現(xiàn)。職務犯罪是指國家公職人員利用職權(quán)實施的貪污賄賂、瀆職等破壞公務活動廉潔性的行為。職務犯罪偵查權(quán)是檢察機關(guān)法律監(jiān)督權(quán)的重要組成部分。檢察一體化視野下的職務犯罪偵查制度和機制建設(shè)是檢察機關(guān)為適應查辦職務犯罪的客觀選擇,是由法治國家建設(shè)的要求、反腐敗的客觀現(xiàn)實、當前職務犯罪的特點、當前偵查主體的不適應性所決定的。檢察機關(guān)職務犯罪偵查要確立職務犯罪偵查法治觀,實現(xiàn)偵查理念由側(cè)重懲治向控辯平衡兼顧轉(zhuǎn)變,偵查模式由供到證向由證到供轉(zhuǎn)變,程序法優(yōu)先于實體法的觀念轉(zhuǎn)變,對懲治職務犯罪與保障人權(quán)進行合理平衡。確立在“檢察一體化”下的職務犯罪偵查的大偵查觀,形成整體聯(lián)動的大偵查格局。 論文研究的主要內(nèi)容及結(jié)果如下: 1、通過中外職務犯罪偵查制度的比較研究,立足于當代中國的國情和檢察機關(guān)職務犯罪偵查實踐,從檢察機關(guān)法律監(jiān)督者角色的憲法定位考察職務犯罪偵查權(quán)及其機構(gòu)設(shè)置。 2、顯著有別于普通刑事犯罪的職務犯罪的固有屬性是職務犯罪偵查制度、偵查機構(gòu)建立的基礎(chǔ),當代中國,要在法治精神的指引下善待職務犯罪偵查權(quán),在“檢察一體化”的憲法定位下完善職務犯罪偵查制度,真正實現(xiàn)職務犯罪偵查法治化。 3、我國檢察機關(guān)職務犯罪偵查機構(gòu)設(shè)置不夠合理,應對我國職務犯罪偵查機構(gòu)進行重構(gòu),改革現(xiàn)有的偵查機構(gòu)分散狀態(tài),在“檢察一體化”下建立權(quán)威高效的職務犯罪偵查機構(gòu)。
[Abstract]:Duty crime is the most concentrated and serious manifestation of corruption. Duty crime refers to the corruption and bribery, dereliction of duty, and so on, which are used by state public officials to destroy the integrity of public activities. The investigation power of duty crime is an important part of the procuratorial organ's legal supervision power. The investigation system and mechanism construction of duty crime under the view of procuratorial integration is the objective choice of procuratorial organs to adapt to the investigation of duty crime, the requirement of building a country under the rule of law, the objective reality of anti-corruption, and the characteristics of present duty crime. At present, the inadaptability of the subject of investigation is determined. The investigation of duty crime in procuratorial organs should establish the concept of rule of law in investigation of duty crime, change the concept of investigation from focusing on punishment to balance between prosecution and defense, change the mode of investigation from supply to evidence to supply, and change the concept of procedural law taking precedence over substantive law. Strike a reasonable balance between punishing job-related crimes and safeguarding human rights. Establishing the concept of duty crime investigation under the condition of "procuratorial integration", forming the overall pattern of joint investigation. The main contents and results of this paper are as follows: 1. Through the comparative study of the investigation system of duty crime between China and foreign countries, based on the situation of contemporary China and the practice of investigation of duty crime of procuratorial organs, the investigation power of duty crime investigation and its establishment are investigated from the constitutional orientation of the role of legal supervisor of procuratorial organs. 2. The inherent attribute of duty crime, which is obviously different from ordinary criminal crime, is the foundation of duty crime investigation system and the establishment of investigation organization. In contemporary China, under the guidance of the spirit of rule of law, the right to investigate duty crime should be treated well. Under the constitutional orientation of "procuratorial integration", we should perfect the investigation system of duty crime, and truly realize the legalization of duty crime investigation. 3. The establishment of investigation organization of duty crime of procuratorial organ in our country is not reasonable, so we should reconstruct the investigation organization of duty crime in our country and reform the decentralized state of existing investigation organization. Under the condition of "procuratorial integration", an authoritative and efficient investigation organization of duty crime should be established.
