文章摘要：電子數(shù)據(jù)的獲取程序是否規(guī)范直接影響電子數(shù)據(jù)真實性的認定。電子數(shù)據(jù)提取筆錄由于能夠客觀反映電子數(shù)據(jù)獲取的過程而成為對電子數(shù)據(jù)進行鑒真的重要依據(jù)，它既能夠連接電子數(shù)據(jù)與案件事實，又反映了取證過程的合法性和保管鏈條的完整性。從屬性上看，電子數(shù)據(jù)提取筆錄具有獨立的證據(jù)屬性，它不僅有別于物證、書證和證人證言，而且有別于其他筆錄類證據(jù)。對電子數(shù)據(jù)提取筆錄的證據(jù)資格和證明力的判斷也具有特殊性。當前，，可通過同步錄音錄像、引入外部監(jiān)督、明確制作人員義務等方式規(guī)范電子數(shù)據(jù)提取筆錄的適用。

Abstr：Whether the collection procedure of electronic evidence is in line with the requirements of electronic evidence, will directly influence the determination of authenticity. Because the record of collection of electronic evidence （Hereinafter referred to as ＇The Record＇） can reflect the collection procedure objectively, it plays as an important basis for the authentication of electronic evidence. The record can connect the electronic data with the facts of the case, and it also reflects the legitimacy of the evidence collection process and the integrity of the storage chain. As a kind of evidence, the record has the nature of independence; it is different from the material evidence, documentary evidence and witness testimony, and is different from other transcripts of evidence. In addition, there exists special rules in examining the evidence ability and proof of the probative force of the record. In order to regulate the application of the record, at present, we can use the methods including synchronous video taping, introducing external supervision and establishing the personnel obligations of the producers.
